Mandate to collate and assign to Malachy Omachan, a canon of Achonry (Akaden.), who says he is of noble birth, the rectory of rural lands of Docharam and Muta in the diocese of Achonry, with cure and value not exceeding 25 marks sterling, void by the death of Bernard Macdonchid; notwithstanding that he has been lately received by authority of the ordinary as a canon in the churches of Achonry and Elphin. To the archdeacon of Cadiz (Gadicen.), and David de Angulo and Odo Oruyly, canons of Tuam. Mandate to collate and assign to Dermit Oscara, a canon of Tuam (who is a priest, and was lately dispensed by papal authority, on account of illegitimacy as the son of a priest, an Augustinian canon, and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, in virtue of which he was so promoted and obtained the rectory of the parish church of Mayo, in the diocese of Tuam, by canonical collation) the rectory of rural lands of Balemgarga (fn. 2) in the said diocese, with cure and of the patronage of laymen, and value not exceeding 4 marks sterling, and wont to be given to secular clerks for a title of a perpetual benefice, so long void, because the late John Penndrogas (sic), having obtained it by canonical collation, held it for more than a year without having himself ordained priest and without dispensation, and afterwards died without the Roman court, that its collation has by the Lateran statutes lapsed to the apostolic see; notwithstanding that he holds a canonry of Tuam and the prebend of Clonmor therein and the rectory of the parish church, called the deanery, of Mayo in the said diocese, (fn. 3) value not exceeding 1 and 8 marks sterling respectively. The pope hereby dispenses Dermit to receive the said rectory of Balemgarga, and to retain it together with the said parish church of Mayo for three years only, before the expiry of which he is to resign whichever of them he prefers for a benefice compatible with the remaining one; if not, after the said three years he is to resign the said rectory of Mayo. To the abbot of Corcomroe (de Petra fertili) in the diocese of Kilfenora (Finaboren.), and the precentor and the official of Kilfenora. Mandate (the pope having been informed by Geoffrey Odonnchw, perpetual vicar of the parish church of Ardrathyn in the diocese of Kilmacduagh (Duacen.), that William Ocorcrahyn, rector of the parish church of Cillthomays in the said diocese, an open and notorious fornicator, has kept a concubine in his own house by whom he has begotten sons and daughters still living, and has converted the fruits etc. of the rectory to the uses of the said concubine and offspring, and, although thrice monished by his ordinary under pain of deprivation to put away the said concubine, still keeps her, does not reside in the said church, and neglects the cure of souls of the parishioners and divine offices, and does not serve the said church, to the shame of the clerical order) if and after Geoffrey (who is a priest, alleges that he is of a great race of nobles by both parents, was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, and alleges that in the city and diocese of Kilmacduagh there are no dignitaries (fn. 4) to whom such a commission could be conveniently made without lawful suspicion of the parties) accuses William before the above three, to summon William and others concerned, and if they find the foregoing to be true, to deprive and remove William, and in that event to collate and assign the rectory, of the patronage of laymen and value not exceeding 16 marks sterling, to Geoffrey, provided that the said patrons consent; notwithstanding that he holds the said vicarage, value not exceeding 8 marks sterling, and the rectory in rural fee of Yflancacd (recte Yflancaed) within the bounds of the parish of the parish church of Cillcade in the diocese of Killaloe, without cure and value not exceeding 6 marks sterling. Mandate (the pope having learned that the late Fergallus Oflaynd, perpetual vicar of the parish church of Baccharachu in the diocese of Kilmore, resigned it before witnesses for want of a notary public (fn. 5); and having been informed by John Omulmothory (recte Omulmochory), a canon of Kilmore, that Bernard Offlaind, perpetual vicar of the parish church of Drumermolaygh in the said diocese, has openly kept a kinswoman (fn. 6) as his concubine, and committed simony and perjury) if and after John (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, before which he had himself made a clerk, and to whom the present pope lately made provision of a canonry with reservation of a prebend of Kilmore, and reservation of a benefice with or without cure in the collation etc. of the bishop and the archdeacon and the dean and chapter etc. of Ardagh, dispensing him by the same letters to receive and retain such canonry and prebend and benefice) accuses Bernard before the above three, to summon Bernard and others concerned, and if they find the foregoing to be true, or one of them enough for the purpose, to deprive and remove Bernard, and in the event of their doing so, and after they have found the said resignation by Fergallus to have been lawful, to receive and admit it by papal authority, for this turn only, and, after so doing, to erect the said vicarage of Vacchaachu (sic), value not exceeding 3 marks sterling, into a prebend of Kilmore for John's life, provided that the chapter of Kilmore or the greater part thereof consent, and after such erection to unite the said vicarage of Drumermolaygh, value likewise not exceeding 3 marks sterling, to the prebend thus [e]rected, and to collate and assign the vicarage, thus erected into a prebend, and the other [vicarage], thus united thereto, to the said John. To the prior of St. Mary's, Cluayn Tuaysgertha Omayne, in the diocese of Clonfert. Mandate (the pope having been informed by Malachy Makayg, clerk, of the diocese of Clonfert, that John Ochormachayn, a canon of Clonfert, aspiring to a canonry of Clonfert and the prebend of Fy[n]diur therein, made a simoniacal bargain with their then holder Donatus Ohathnyn, to the effect that John should give Donatus a certain sum of money and that Donatus should resign the canonry and prebend in John's favour, under pretext of which bargain Donatus resigned to Cornelius bishop of Clonfert, and John got provision made to him by authority of the ordinary; and that the said John, an open and notorious fornicator, has neglected divine offices in the said church of Clonfert) if and after Malachy accuses John before the above prior, to summon John and others concerned, and if he find the foregoing to be true, or one of them enough for the purpose, to deprive and remove John, and in that event to collate and assign the canonry and prebend, value not exceeding 3 marks sterling, to Malachy, if found fit. To the bishop of Clogher, Luke de. Vivianis, a canon of Ferentino, and Thady Macgillacosgly, a canon of Clogher. Mandate as below. The recent petition of Bernard Ocathasaich, priest, of the diocese of Clogher, contained that after Bartholomew Ocathasaich, scholar, of the said diocese, had falsely set forth to the late Calixtus III that the said Bernard had celebrated in contempt of the Keys, and therefore deserved to be deprived and removed from the perpetual vicarage of the parish or collegiate church of St. Laserianus (fn. 7) de Damynis in the said diocese, which he was then and is now holding, the said pope ordered certain judges [not here named], after the usual accusation etc., to deprive and remove Bernard, and in that event to collate and assign the vicarage to Bartholomew; that, after the letters had been presented to the said judges, and after citation only had been made, an agreement by oath was made by the intervention of a friendly compositor to the effect that Bartholomew should give up all right belonging to him and the said letters, and that Bernard should pay [to him] a certain portion of tithe yearly etc.; and that afterwards, upon Bartholomew's renouncing the said agreement, Bernard, wishing to be agreeable to Bartholomew, (fn. 8) promised by oath to pay him a certain sum of money yearly, which he has hitherto done, thereby incurring the sentences etc. promulgated for simony. The pope therefore has ordered the above three by other letters to absolve Bernard from the guilt of simony, and from his oath, and from all sentences etc. incurred on account of the foregoing, enjoining penance etc., and to dispense him on account of irregularity contracted, and rehabilitate him, the pope at the same time requiring him to resign the vicarage. The vicarage being therefore still void as above, the pope hereby orders the above three to collate and assign it, value not exceeding 4 marks sterling, to Bernard. Mandate (the pope having been informed by Emundus Osehacnasay, (fn. 9) clerk, of the diocese of Kilmaduagh, that Dermit Odonchua, rector of the parish church de Behehac de Rinalacga (fn. 10) (recte Kinalacga) hyererach in the said diocese, an open and notorious fornicator, has dilapidated etc. and uselessly converted to the evil uses of his concubine and offspring, which is still living, the goods etc. of the rectory, and has neglected divine worship in the said church and other ecclesiastical sacraments, to the shame of the clerical order) if and after Emundus accuses Dermit before the above chancellor, to summon Dermit and others concerned, and if he find the foregoing true to deprive and remove Dermit, and in that event to collate and assign the rectory, of the patronage of laymen and value not exceeding 8 marks sterling, to Emundus, if found fit; whether it become void by such deprivation, or be void by the death of Cornelius Ydonnchua or Thomas Odubgilla, clerks, of the said diocese, or by the resignation of Denis Ynyellayn, clerk, of the said diocese, or of the said Dermit, or be void in any other way.Dignum arbitramur.
