1460. 5 Id. Aug. (9 Aug.) Siena. (f. 9.)	[To John Kerss', a canon of the Augustinian monastery of Inchcolm (Insule sancti Columbe de Emonea) in the diocese of Dunkeld.] (fn. 2) Reservation and assignment to him (the pope having admitted his resignation of the said monastery, and having by other letters ordered provision to be made to Michael Harwar, a canon thereof) of a yearly pension for life of 8l. sterling, worth 40l. of the money of Scotland, upon the lands, farms and yearly rents of Donybyrsill Bothethlak and the mill and tithes of sheaves and lesser tithes of the same, together with the tithes of sheaves of the town of Luthald, belonging to the said monastery, (fn. 3) to be paid half on Christmas day, half on St. John Baptist's by the said Michael, who has consented, and by his successors; with penalties for delay in payment, etc.
	To the bishop of Dunkeld, the abbot of Coupar-Angus in the diocese of St. Andrews, and the chancellor of Chartres. Mandate—the pope having this day reserved and assigned to John Kerss', a canon of the Augustinian monastery of Inchcolm (Insule sancti Columbe de Emonea) in the diocese of Dunkeld, a yearly pension for life of 8l. etc. as above (here with the spelling ‘Donybirsill’), as is contained more fully in the pope's letters to that effect (viz. the foregoing)—to cause the said pension to be paid and assigned to the said John, and to enforce payment by excommunication at his request, whenever necessary. Mandate to reserve to his gift, and upon voidance to collate and assign to Edmund Archer, a canon of the Augustinian priory of St. Edmund, Athassil, in the diocese of Cashel, if found fit, the said priory, conventual, with cure and elective, value not exceeding 120 marks sterling, to become void by the present pope's promotion of David Haket, elect of Ossory, to that church, and by the consecration to be administered to him; even if it be actually (actu) void by the death of Robert Stacbol or Richard de Burgo, or by the resignation of the said elect, or in any other way. 17 Kal. July. (15 June.) Petriolo in the diocese of Siena. (f. 83d.)	To the abbot of Holy Trinity, Tuam (Taumen., recte Tuamen.), and Thady Ohanly, a canon of Tuam (Taumen.). Mandate (the pope having been informed by Thady Oruadgri, a canon of Tuam (Taumen.), that William de Burgo, abbot of the Cistercian monastery of St. Mary, Knockmoy (Collis victorie), in the diocese of Tuam (Taumen.), an open and notorious fornicator, has committed simony and, a dissolute vagabond, has neglected to reside in the said monastery, (fn. 5) has dilapidated its goods and has committed other enormous crimes [not here expressed]), if and after Thady (who desires to enter the said monastery as a religious, and who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders, and hold a benefice even with cure) accuses William before the above two, to summon William and others concerned, and if they find the foregoing to be true, or one of them enough for the purpose, to deprive and remove William, and in that event to cause Thady to be received as a monk of the said monastery and the regular habit to be given to him, etc., and to receive his profession, and moreover, if they find him fit, to make to him, after he has made his profession, provision of the monastery, value not exceeding 50 marks sterling; whether it become void by such deprivation, or be void by the death of Cornelius Micaedgayn or Malachy Ykaearwall, monks of the said order, or by the resignation of Malachy Ykeallay, a monk of the said order, or of the said William or any other, or be void in any other way. They are further to grant that he may be blessed by any catholic bishop, and the pope grants him dispensation hereby to be appointed abbot and to rule the monastery in spirituals and temporals, notwithstanding the said defect etc. Ex suscepte servitutis. 7 Kal. July. (25 June.) Petriolo in the diocese of Siena. (f. 100.)	To the bishop of Achonry (Achaden.). Mandate, at the recent petition of Cormac Ykassy, an Augustinian friar (containing that the prior and convent of the house of Corpus Christi, Bennafada, of the said order, in the diocese of Achonry, the greater part of whom are related in the third and fourth degrees of kindred, (fn. 6) do all capitular acts and utterly and entirely dispose at their pleasure, contrary to the regular observance, of all the goods belonging in common to the prior and convent without asking, and rather in contempt of, the consent of the other brethren who are not related, (fn. 7) to the grave prejudice and hurt of the said other non-relatives (fn. 8) ) to summon the said prior and kinsmen and relatives (fn. 9) and others concerned, and if he find the foregoing to be true, to inhibit the said prior and kinsmen and relatives (fn. 10) to attempt or dispose of anything in the said house which requires the assent of the whole convent, without the consent of the said Cormac and other nonrelatives (fn. 11) in the convent. 11 Kal. July. (21 June.) Petriolo in the diocese of Siena. (f. 126.)	To Dermit Oscara, Rory Oconrid (or Oconind), and Edmund Walsh (Edimundo Valenti), canons of Tuam. Mandate to collate and assign to Magonius Oconchuyr, a canon of the Augustinian monastery of St. Michael de Maro (recte Maio) in the diocese of Tuam, who is a priest and was lately dispensed by papal authority, on account of illegitimacy as the son of a priest religious and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, the rectory of rural lands of Drumugakarg in the diocese of Tuam, of the patronage of laymen, with cure and value not exceeding 4 marks sterling, so long void (because John de Angiylo, (fn. 12) having obtained it by canonical collation, did not have himself ordained priest within a year, without having a dispensation super hoc), that its collation has by the Lateran statutes lapsed to the apostolic see. 1460. 10 Kal. Sept. (23 Aug.) Siena. (f. 140.)	To the bishop of Ossory. Mandate, at the recent petition of Philip Walch, a monk of the Cistercian monastery of St. Mary Graiguenamanagh (de Valle Salvatoris alias de Towske) in the diocese of Ossory (containing that he once went with a fellow monk to a place within the precincts appointed by the abbot and monks for archery, as a pastime, and that in shooting at the mark his arrow chanced to strike a boy of about four years of age, whom he had not perceived before letting fly the arrow, and who was running across the line of fire, (fn. 13) whereby the boy died; and that subsequently Philip, who is not otherwise guilty of the boy's death, trusting in certain Jubilee year indulgences then granted in Ireland, and the persuasions of a certain proctor of the said indulgences and also of his ordinary, and without having obtained any other absolution or dispensation, believing it to be lawful, has celebrated masses and other divine offices, but not in contempt of the Keys, and taken part therein) to absolve Philip, who is a priest, from the guilt of homicide and the said excesses, enjoining penance, dispense him on account of irregularity, and dispense him to minister in all his orders, even in the ministry of the altar, and receive and retain any compatible administrations and offices of the said order, and rehabilitate him. 17 Kal. July. (15 June.) Petriolo in the diocese of Siena. (f. 145.)	To Malachy Omachan, John Offloynd and John Ohargadan, canons of Elphin. Mandate (the pope having been informed by Fergallus Ogormuly, a canon of the Augustinian priory of St. Mary, Inchmacnerin (Insula Macnerii), in the diocese of Elphin, that Thomas Obenachan, prior of the same, a notorious fornicator, openly keeps with him a concubine (focariam), has committed perjury, and has neglected and still neglects to reside in the monastery, and exercise the cure of souls of the canons and divine offices) if and after Fergallus accuses Thomas before the above three, to summon Thomas and others concerned, and if they find the foregoing to be true, or one of them enough for the purpose, to deprive and remove Thomas, and in that event to collate and assign the priory, which is conventual and has cure, and is elective, value not exceeding 30 marks sterling, to Fergallus. 1459. 17 Kal. Oct. (15 Sept.) Mantua. (f. 147d.)	To the bishop of Sisteron (Sistaricen.). Mandate as below. The recent petition of William abbot of the Augustinian monastery of St. John the Evangelist, Tuam, contained that, after Martin V and Eugenius IV's renewal of the sentences etc. promulgated by their predecessors against simoniacs, and their reservation to themselves and their successors of absolution therefrom, upon a dispute arising between the said William and Donald Onaray, sometime abbot of the said monastery, about the rule and administration thereof, they, with the consent of Donatus archbishop of Tuam, promised by oath to abide by the decision of certain arbitrators; that the said arbitrators adjudged that the right in the said monastery or in its rule and administration belonged to William, and imposed perpetual silence on Donald, and assigned, with William's permission, the greater part of the fruits etc. and a parcel of lands or possessions of the monastery yearly to Donald, which assignment William promised by oath to observe; that William obtained peaceable possession of the rule and administration, and still exercises them, taking therefrom the fruits, though few. The said petition adding that William doubts whether the said agreement was lawful, and fears to have incurred the said sentences etc., the pope hereby orders the above bishop to absolve him from the stain of simony and the said sentences etc., if any incurred, enjoining penance, and to dispense him on account of irregularity, if any, contracted when under the said sentences by celebrating masses and other divine offices, not in contempt of the Keys. 1460. Prid. Id.— (fn. 14) Siena. (f. 310d.)	To the abbot of Holy Trinity, Tuam. Mandate as below. The recent petition of David Breanach, priest, of the diocese of Tuam, contained that lately, on the voidance of the perpetual vicarage of Fuoranmor in the diocese of Annaghdown, of the patronage of laymen, by the resignation of John Macgillavanach to Donatus archbishop of Tuam, the church of Annaghdown being united to that of Tuam, the patrons presented David to the said archbishop, who instituted him, and that in virtue of the presentation and institution he obtained possession and has held it for more than three years, but now doubts whether they hold good, because some assert that the vicarage became void, not by the said resignation, but because the said John, when holding the rectory of the parish church of Ardrathayn in the diocese of Kilmacduagh (Duacen.), which has cure, obtained the vicarage by canonical collation and held it together with the rectory without any papal dispensation against ‘Execrabilis,' and that it was so long void that by the Lateran statutes its collation had lapsed to the apostolic see. The pope therefore orders the above abbot to collate and assign to David, if found fit, the said vicarage, value not exceeding 4 marks sterling, whether it be void as stated, or by the resignation of Maurice Ymulbreanaynd or by the deprivation of Thady Ymukathe, or in any other way.
