Faculty to him, to whom the pope has this day made provision of the said church, to be consecrated by any catholic bishop, assisted by two or three like bishops; and faculty for such bishop to administer such consecration, after having first received from William his oath of fealty according to the form enclosed. The pope decrees that if, without having received the said oath, the said bishop presume to administer the said consecration, and William presume to receive it, the said bishop shall eo ipso be suspended from the exercise of the pontifical office, and both he and William from the administration of both the spirituals and temporals of their churches. Moreover, the pope wills that William shall send as soon as possible by his letters patent sealed with his seal, by his own envoy the form of oath taken by him (fn. 2); without prejudice to the archbishop of Armagh, (fn. 3) to whom the said church is by metropolitical right subject; with the form of oath appended in brief. Mandate (the pope having been informed by Malachy Omulryayn, a monk of the Cistercian monastery of St. Mary Abington (Wootynia (fn. 5) ) in the diocese of Emly, that Ricardus alias Risterdus (recte Riscerdus) Synw[r], abbot of the said monastery, is a notorious fornicator and has dilapidated etc. and uselessly consumed the goods of the monastery, and neglected the canonical hours and divine offices; and that on account of the inordinate favours which he enjoys in those parts Malachy has no hope of obtaining justice) if Malachy accuses Ricardus alias Risterdus before the above dean, to summon him and others concerned, and if he find the foregoing to be true, to deprive and remove him, and in that event to make provision of the monastery, value not exceeding 50 marks sterling, to Malachy, who is a priest; whether it become void by such deprivation, or be void by the death of William Synwr or John Lafard, or in any other way. The pope hereby grants that he may be blessed by any catholic bishop, who shall receive his oath of fealty according to the form enclosed, and send it as soon as possible by Malachy's (or the bishop's) letters patent sealed with Malachy's (or the bishop's) seal. diocese of Siena.
(f. 259.)		 To the dean and the precentor of Kilmacduagh (Duacen.), and Luke de Vivianis, a canon of Ferentino. Mandate as below. The recent petition of Geoffrey Odonnchw, priest, of the diocese of Kilmacduagh (Duracen., rectius Duacen.), contained that after he had been dispensed, on account of illegitimacy as the son of a priest and an unmarried woman (i) by authority of the ordinary to be made a clerk and hold a benefice without cure, (ii) by papal authority, through the sub-collector in Ireland, who alleged that he had a special faculty for the purpose, to be promoted to all even holy orders and hold, even in his twenty-second year, a benefice even with cure, he, in virtue of the said dispensation, got provision made to him, by authority of the ordinary, of the [perpetual] vicarage of Ardrathyn in the diocese of Kilmacduagh (Duacen.), a sum of money having first, as the result of a simoniacal agreement, been paid to the collators of the vicarage, he not being yet of lawful age, as aforesaid, and had himself promoted to all the said holy orders (fn. 8); that afterwards, on the voidance of the rectory in rural fee of Iflandeacd without cure within the bounds of the parish of Cillcordy (or Cillcerdy, recte Cillceedy) in the diocese of Killaloe (Laonien.), he, without first getting any other dispensation on account of the said defect, got provision made to him thereof by papal authority, and got himself dispensed by the same papal authority to retain it for life together with the said vicarage, in virtue of which provision he is still in possession of them. The pope therefore orders the above three to absolve him from simony and from excommunication, enjoining penance, dispense him on account of irregularity contracted, and rehabilitate him. Mandate, recapitulating the preceding, (fn. 9) to collate and assign to the above Geoffrey, after he has duly resigned, the above vicarage and rectory, which is without cure and of the patronage of laymen, value not exceeding 8 and 6 marks sterling respectively, provided that the patrons consent. To the abbot of Clare (de Forgeo alias de Clar) and the prior of the secular and collegiate church of Inyskaharg (recte Inyska[t]haig), in the diocese of Killaloe (Laonien.), and the official of Kilmacduagh (Duacen.). Mandate, at the recent petition of Donald Oheogouayn, priest, of the diocese of Killaloe (containing that on the successive voidance of a certain perpetual portion in the above secular and collegiate church of Inyskaharg by the resignation of David Ykeith, priest, to the prior and chapter of the said church, and of the sacristship of the same church, which is elective, by the death of Cornelius Oheogouayn, priest, or Philip Yket, priest, the prior and chapter made collation and provision by their ordinary authority of the said portion and sacristship to the said Donald, who was also canonically elected to the latter, in virtue of which collation and provision, and their approbation by the ordinary of the place, he obtained and is still in possession of them, but now doubts whether the said collation and provision and approbation hold good) to collate and assign to Donald the said sacristship, an elective office without cure (simplex officium electivum), and portion, which is by custom with cure, value not exceeding 3s. and 20s. of the money current in those parts, which benefices can both, by the statutes and customs of the said church, be canonically held together by a weekly celebrant (ebdomadarius) thereof; whether they be void as above, or by the resignation of the said Cornelius, Philip or David, or in any other way.   • 1. On the back of the volume is the usual modern description in Latin: ‘1460. An. iii. (corrected by erasure to ‘ii.’) Pius ii.’ On a flyleaf is Mgr. Wenzel's ‘An. 2. to. xi.,’ but not the usual contemporary description, which occurs, however, on the bottom edge of the volume, viz.: ‘Primus de provisionibus et de exhibitis anno secundo domini nostri domini Pii pape ii.' There are i.—ccxc ff. of text.
  • 2. Volumus quod formam huiusmodi a te tunc prestiti iuramenti nobis de verbo ad verbum per tuas patentes litteras tuo sigillo signatas per proprium nuncium qua[n]tocius destinare procures.
  • 3. Bracharen (i.e. Barcelona), rectius Armachan., one of the rare serious errors in the Registers.
  • 4. i.e. without the usual letter to the king.
  • 5. Apparently corrected from ‘Wootyna’ by making the ‘a’ into ‘ia’; the result being obscure.

Volumus autem quod idem antistes, qui dicto Malachie munus prefatum [i.e. benedictionis] impendet, ab eo nostro et Romane ecclesie nomine fidelitatis debite solitum recipiat iuramentum, justa formam quam sub bulla nostra mittimus interclusam, ac formam iuramenti quam ipse Malachias prestabit nobis de verbo ad verbum per tuas (recte suas) patentes litteras tuo (recte suo) sigillo signatas quantocius destinare procures (recte procuret). This oath receiving clause often leads the scribes astray. On this occasion the scribe perhaps forgets that he is addressing the dean, not the bishop who is to bless, nor the future abbot.

  • 8. ipse dispensacionis huiusmodi obtentu de [perpetua] vicaria parrochialis ecclesie de Ardrathyn Duacensis diocesis tunc certo modo vacante, certa pecunie quantitates (recte quantitate) eisdem (recte eiusdem) vicarie collectoribus (recte collatoribus), pactione simoniaca previa, cum adhuc in etate legitima ut prefertur non existeret, sibi dicta ordinaria auctoritate provideri obtinuit, seque ad omnes huiusmodi ordines rite promoveri fecit. A small cross in the margin draws attention to the unsatisfactory state of the text, but no corrections are made there. In the following concurrent mandate the text of the corresponding passage is without these errors, although it omits the words ‘ut prefertur’ and has the variant ‘provideri ac se ad sacerdocium rite promoveri obtinuit.’
