To the abbots of the monastery of Newbotil and Driburgh, in the diocese of St. Andrews, and the official of St. Andrews. Mandate, as below. The recent petition of David Hay, nobleman, lord of the place of zester in the diocese of St. Andrews, contained that although the right of patronage of the parish church of Bygar in the diocese of Glasgow belongs to him by alternate turns, and although he and his progenitors have been from time immemorial in peaceable possession thereof, nevertheless Robert le (fn. 2) Flemyng, nobleman, lord [of the place of —] in the diocese of Glasgow, (fn. 3) falsely alleging that the said right of patronage belonged to him alone (in solidum spectare), and that the said David hindered him from using it, brought him before Simon Dalgles', precentor of Glasgow, then dwelling in the city of Glasgow, and Martin Wau (? recte Waus), canon of Du[n]blane, by commission of Andrew, bishop of Glasgow; that David appealed from the said commissioners, on account of certain grievances, to the apostolic see, and that in contempt of the said appeal they wrongfully proceeded and promulgated a definitive sentence in favour of Robert and against David, condemning the latter in costs, his appeal from which sentence to the said see the said precentor and canon have reverently deferred to. (fn. 4) The pope therefore hereby orders the above three to summon the said Robert and others concerned, and to confirm or quash (confirmare vel infirmare) the said sentence, without appeal.
