To the archdeacon of Huete in the church of Cuenca (Conchen.), and the chancellor and the official of Moray. Mandate to collate and assign to John Calder, priest, of the diocese of Moray, the archdeaconry of Moray, a non-major non-elective dignity with cure, value not exceeding 35l. sterling, collation and provision of which, on its becoming void at the apostolic see, and therefore ipso facto reserved to the pope, by the death there of Robert Foresti, was made to him by David, bishop of Moray, by his ordinary authority, under pretext of which he obtained possession, and has detained it for some months but less than a year, without, however, taking any of its fruits. To the bishop of Dunkeld. Mandate, as below. The recent petition of Robert Turnbul, a canon of the monastery of Jeddworth, O.S.A., in the diocese of Glasgow, contained that on the voidance of the said monastery by the resignation of Andrew Bolton to the late Andrew, bishop of Glasgow, extra R.c., the convent elected as abbot the said Robert, in priest's orders and of lawful age, who consented to the election and got it confirmed by the said bishop Andrew, and in virtue of the said election and confirmation obtained possession. The said petition adding that he doubts whether the said election and confirmation hold good, and the pope having learned that John Vodman, a canon of St. Andrews, O.S.A., to whom Paul II ordered provision to be made of the said monastery [see Cal. Papal Lett. XII, p. xxxv.], has extra R.c. ceded all right in or to the said monastery, and that it is still void as above, he hereby orders the above bishop, if he find the said cession to have been lawful, to admit it by papal authority, if not already admitted, and, if he find the said Robert fit, to make provision of him to the said monastery, the fruits etc. of whose abbatial mensa do not exceed a yearly value of 50l. sterling. The pope further grants that he may be blessed by the above or by any other catholic bishop in communion with the apostolic see, who, or the above bishop, is to receive and send Robert's oath of fealty, as usual, according to the form enclosed, by Robert's letters patent sealed with Robert's seal (fn. 2); without prejudice to the bishop of Glasgow, to whom the said monastery is by ordinary right subject. To the abbot of St. Mary's, Monasterevan (de Rossevalle [sic]), in the diocese of Kildare (Daren.), and Constantine Mackaeghayn and Maurice Ocholghan, canons of Kildare. Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Balenakylle alias Baleantempull in the diocese of Kildare, of the patronage of clerks, has been so long void by the death of Fintanus Ohernayn extra R.c. that its collation has lapsed to the apostolic see, although Odo Ebechayn (recte Obechayn), priest, under pretext of a presentation by a certain clerk who falsely alleged that he had the right to present, has without any institution or canonical title detained possession for about a year, but less than two years. And the recent petition of Malachy Ykaemayn, priest, of the said diocese, contained that although he was lately dispensed, under pretext of certain letters expedited by the pope's penitentiary, in which commission was given to the bishop of Kildare to dispense him on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, nevertheless, inasmuch as Richard, bishop of Kildare, when the said letters were directed to him, had not expedited the letters of his provision to the said church of Kildare, he fears that the said dispensation (under pretext of which he had himself promoted to all, even holy and priest's orders, and ministered therein) [does not hold good, and that he] (fn. 3) has incurred disability and suspension. The pope therefore, abolishing all disability which the said Malachy may have contracted by reason of the foregoing, and dispensing him on account of irregularity, hereby orders the above three to summon the said Odo and others concerned, and to collate and assign the said vicarage, with cure and value not exceeding 5 marks sterling, whether it be void as above, or by the death of Dermit Ycholghan, or be void in any other way, to Malachy, removing the said Odo and any other unlawful detainer. The pope further dispenses him to minister in the orders which he has received, and to receive and retain the said vicarage, notwithstanding the said defect of birth, etc. Sedes apostolica pia mater. To the abbots of Peter and Paul the Apostles, Clare (de Forgyo alias de Clar), and St. Mary's, Inysgad, and the prior of the secular and collegiate church of Inyskahy, in the diocese of Killaloe (Laonien.). Mandate, as below. On the voidance of a canonry of Killaloe and the prebend of Cloyndagad therein by the death of Donatus Macaray at the apostolic see, Paul II ordered provision of them to be made to Matthew Obreyn, clerk, of the said diocese [see Cal. Papal Lett., XII, p. xxxvii]. And the recent petition of Rory Okaelly, priest, of the same diocese, contained that under pretext of the said pope's letters (in which it was falsely expressed that the fruits etc. of the said canonry and prebend did not exceed 10 marks sterling, whereas they are worth much more, although not more than 20l. sterling), and of the collation and provision which were made to him in consequence thereof, the said Matthew obtained possession of the said canonry and prebend and has detained them for more than eight years but less than ten. The said letters being therefore surreptitious and invalid, and the said collation and provision without force, the pope hereby orders the above three to summon the said Matthew and others concerned, and if they find the foregoing to be true, to declare the said letters and collation and provision null etc., and in that event to collate and assign the said canonry and prebend to the said Rory, removing [the said Matthew and] any [other] unlawful detainer. To David Prindagras, a canon of Tuam. Mandate, the pope having been informed by Milerus de Burgo, clerk, of the diocese of Tuam, that Thomas Ohaega, abbot of St. John the Evangelist's, O.S.A., Tuam, has dilapidated and alienated the moveable goods of the said monastery, if the said Milerus, who is by both parents of noble birth, will accuse the said Thomas before the above canon, to summon Thomas, and if he find the foregoing to be true, to deprive and remove him, and in that event to cause Milerus to be received as a canon of the said monastery and receive his regular profession, and thereupon to make provision to him of the said monastery, value not exceeding 20 marks sterling. The pope hereby grants that he may be blessed by any catholic bishop in communion with the apostolic see, who is to receive his oath of fealty according to the form enclosed, which form the above canon is to send to the pope by his letters patent, sealed with his seal (fn. 4) (cf. above, f. 88r.); without prejudice to the archbishop of Tuam, to whom the monastery is by ordinary right subject. Mandate to collate and assign to Eugenius Macholayn, clerk, of the diocese of Clonmacnoise (who was lately dispensed by papal [sic] authority on account of illegitimacy, as the son of a bishop and an unmarried woman, to be promoted to minor orders and hold a benefice without cure), the deanery of Clonmacnoise, a major elective dignity with cure, value not exceeding 12 marks sterling, so long void by the death extra R. c. of Odo Omolloyn, that its collation has lapsed to the apostolic see; whether it be so void, or be void by the death of Toroleius Ymoleacylyn or Odo Ymoleon, or by their resignation or that of Cucagrus Yegullen, priest, of the diocese of Clonmacnoise or that of Meath, or in any other way. The pope hereby dispenses him to be promoted to all, even holy orders, and receive and retain the said deanery, notwithstanding the said defect of birth, etc. Dignum etc. (At the end. Jo. xxv. To the abbots of Kilbeggan and de Flumini dei, (fn. 5) and the prior of St. Mary's, Durmach, in the diocese of Meath (Minden., recte Miden.). Mandate, the pope having been informed by Eugenius Omulueych, priest, of the diocese of Meath, that Patrick Olueych, perpetual vicar of the parish church of Loymak [sic] in the said diocese, has committed and been convicted of perjury and is a notorious fornicator, if Eugenius will accuse Patrick before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 24 marks sterling, to Eugenius.
