Mandate to collate and assign to Malachy Mackarraydh, clerk, of the diocese of Ardfert, the parish church of Kyldromahyarrayn alias Kylnauanayn in the said diocese, value 6 marks sterling, so long void that there is no certain knowledge of the way of its voidance and that its collation has lapsed to the apostolic see, although Thomas Osulevayn, priest, has detained possession of it without any title, (fn. 2) the said Thomas being summoned and removed. Mandate to collate and assign to John Manderuiil, (fn. 3) clerk, of the diocese of Lismore (who was lately dispensed on account of illegitimacy, as the son of an unmarried nobleman, of knightly race, and an unmarried woman, to be made a clerk and be promoted to all even holy orders and receive and retain a benefice even with cure, and who in virtue thereof has had himself made a clerk), the perpetual vicarage of Ardmor in the said diocese, value 12 marks sterling, to long void that its collation has lapsed to the apostolic see, although Cornelius Oboan, priest, has detained possession for between twenty and twenty-four years, without any title or right, the said Cornelius being summoned and removed. To Thomas Magwgye [sic], prior of the secular and collegiate church of St. Lasrianus, Damynys, in the diocese of Clogher. Collation and provision to him, who, notwithstanding his illegitimacy, as the son of a priest and an unmarried woman, [both] of a race of princes, (fn. 4) has been made a clerk, of a canonry of Clogher and the sacerdotal prebend, called [the prebend] of Damynys, erected from the parish church of the same, and also the priorship, a principal dignity, of the secular and collegiate church of St. Lasrianus, Damynys, in the diocese of Clogher (which is habitually and not actually collegiate), (fn. 5) void at the apostolic see, and therefore reserved to the pope, by the death there of Bartholomew Ocathasay, the value of which canonry and prebend and priorship does not exceed 14 marks sterling; whether they be void as above, or by the death of Peter Ylannagan extra R.c., or in any other way. The pope hereby dispenses him to receive and retain them for life, notwithstanding the said defect, etc. Vite etc. |

To James Ohaclayn (recte Ohaelayn), a canon of Kildare (Daren.). Mandate, as below. The recent petition of William Ydwygyn, clerk, of the diocese of Killaloe (Laonien.), contained that on the voidance in a certain way of the rectory of Cluonfarthamoluad in the said diocese, Matthew bishop of Killaloe erected it by his ordinary authority into a prebend of the church of Killaloe, and, alleging that he could do so by custom, dispensed the said William (who is illegitimate, being the son of unmarried parents, and who has been made a clerk), to receive and retain the said canonry and prebend, notwithstanding the said defect, and by the same authority made him de facto collation and provision of the said canonry and prebend, void from the time of its said erection; and that by the same authority the said bishop, seeing that the said William could not easily maintain himself from the fruits etc. of the said canonry and prebend, applied to the said prebend for William's life only, with consent of the dean and chapter of Killaloe, certain fruits etc. called [the fruits etc.] of Tachdynayn, belonging to the episcopal mensa; and that under pretext of such collation and provision and application the said William took possession of the said canonry and prebend and applied fruits, and has detained them for between three and four years, taking the fruits thereof, but in good faith. The said collation provision and application being therefore without force, and the pope having learned that the said rectory is still void, as above, and that the rectory of Donathmor in the diocese of Ossory, of lay patronage, has been so long void that its collation has lapsed to the apostolic see, although Robert Hastaeykyn, priest, has detained possession of it for between three and four years, without any title; and the said petition adding that some hesitate as to the force of the said erection, etc., the pope, hereby rehabilitating the said William, orders the above canon to erect the said rectory of Cluonfarthamoluad into a prebend of Killaloe, and to collate and assign to the said William a canonry of Killaloe and such prebend (to be void from the time of the said erection), value with their annexes 5 marks sterling, and moreover to summon the said Robert and unite the said rectory of Donathmor, value 8 marks sterling, and the said fruits etc. called [the fruits etc.] of Tachdynayn, value 3 marks sterling, to the said canonry and prebend for as long only as the said William shall hold the latter, the said Robert being removed. The pope further dispenses him to receive and retain the said canonry and prebend, and to be promoted to all even holy orders, notwithstanding the said defect, etc. Before, however, the said canon proceeds to execute these presents the said William is to resign the said canonry and prebend and applied fruits. To the dean of Dunkeld. Mandate, as below. The recent petition of James Alerdes [sic], clerk, of the diocese of St. Andrews, contained that on the voidance at the apostolic see of the archdeaconry of Moray by the death there of Archibald Knollis, a dispute arose about it between John Garden, (fn. 6) priest, of the said diocese, to whom provision had been made by papal authority, and the late John Kalder, to whom provision had been made by authority of the ordinary; that, the cause having by a certain extra-judicial appeal of the said John Garden devolved to the apostolic see, and the said John Kalder having died there, the late David, bishop of Moray, made de facto collation and provision of the said archdeaconry by his ordinary authority to the said James, who under pretext thereof took possession, and at present detains it, taking the fruits, also de facto, thereby contracting disability; that the pope, at the instance of the said John Garden, committed the appeal cause and that of the principal matter to John, bishop of Nocera, holding the place of a papal auditor; and that the said bishop, after he had proceeded in the said causes to a number of acts, but short of a conclusion, admitted in virtue of a certain special commission from the pope the said James to the said cause, and has proceeded therein to a number of other acts, but short of a conclusion. Seeing that, whilst the said suit has been pending, the said John Garden has this day given up to the pope the said suit, and all his right in or to the said archdeaconry, by Giles Boys, clerk, of the said diocese, his proctor, and seeing that in accordance with the foregoing the collation and provision made to the said James are without force, and that the said archdeaconry is still void, and still reserved to the pope, as above, the pope, rehabilitating the said James, and calling up the said cause to himself, and extinguishing the suit, hereby orders the above dean to collate and assign the said archdeaconry, a non-major dignity, value 24l. sterling, whether void as above, or by the death of Robert Forest, or void in any other way, to the said James. To Dermit and Matthew Obrien and John [son] of Thady (Johanni Thatei) Macnomara [sic], canons of Killaloe (Laonien.). Mandate, as below. The pope has been informed by Maurice Ohanrihan, a canon of the priory of St. Mary, Yniscronayn, O.S.A., in the diocese of Killaloe, that Rory Occonyn, prior of the said monastery, for whose lifetime the perpetual vicarage of Killrat in the said diocese was united by papal authority to the priorship of the said monastery, has alienated the immoveable goods of the said priory, and made a simoniacal bargain with John Omulloyn, priest, of the said diocese, as a result of which the said Rory consented to the dissolution of the said union, and the said John paid him a sum of money. The pope, therefore, hereby orders the above three, if the said Maurice (who alleges that notwithstanding his illegitimacy as the son of the late Thady, priest, prior of the said monastery, professed of the said order, and an unmarried woman, he was. after making his profession of the said order, promoted to all, even holy and priest's orders, and that the said John got provision made to him of the said vicarage by the said authority on its voidance by the said dissolution), will accuse the said Rory before them, to summon him and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said priorship, value with its annexes 10 marks sterling, to the said Maurice. To Matthew Obryen, Denis Odeayg, and Dermit Okuely, canons of Killaloe (Laonien.). Mandate, as below. The pope has been informed by Thady Macorman, perpetual vicar of Drumcleyb in the diocese of Killaloe, that Donald Okaermada, a perpetual portionary in the church of Ynyskathyd, called [the church] of Moynwor [sic], (fn. 7) in the said diocese, made a simoniacal bargain with Thady Mackahan, (fn. 8) priest, of the said diocese, to the effect that if the latter would leave him in peaceful possession of the said portion and give up to him whatever right he had in or to it, he would give him part of its fruits yearly by way of a pension, which he has since done every year. The pope, therefore, hereby orders the above three, if the said Thady Macorman will accuse the said Donald before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said portion, with cure and value 3 marks sterling, to the said Thady Macorman. The pope further dispenses him to receive and retain it for life with the said vicarage, or without them any two other benefices with cure or otherwise incompatible, even if two parish churches, etc. Vite etc. (At the end: P. xxviii.
