To the bishops of London, Lincoln and Norwich. Mandate, as below. The recent petition of William Nicholasson de Villalemire [sic], layman, of the diocese of Norwich, contained that although he and Margaret Nic[h]olasson alias Wales, his wife, of the said diocese, contracted marriage per verba legitime de presenti, and solemnized it before the church, consummated it and cohabited for some time, nevertheless Thomas Johnson, layman, of the diocese of London, falsely alleging that the said Margaret had previously (fn. 4) contracted marriage with him per similia verba, and that she had put him away, obtained letters of the pope to the bishops of Norwich, Beirut (Beriten.) and Sidon [dated 16 April, 1481, in Reg. Lat. DCCCXVIII, f. 86r. below, p. 788], and that under pretext thereof the present bishop of Beirut, without citing the said William, at least lawfully, but in his absence not through contumacy, wrongfully proceeded in the cause and promulgated an unjust definitive sentence by which he declared the said marriage contracted between the said William and Margaret to have been null, and adjudged the said Thomas to Margaret as her husband, from which sentence the said William, as soon as it came to his knowledge, appealed to the apostolic see, and afterwards petitioned the pope to commit the cause of the said appeal, etc. and that of the principal matter, to some upright men of those parts. The pope, therefore, hereby orders the above three bishops to summon the said Thomas and Margaret, hear both sides, and, taking cognizance of the principal matter also, decide what is canonical, without appeal, causing their decision to be observed by ecclesiastical censure. To Robert Cornhil alias Cornel, a canon of the priory of Bylsyngton, O.S.A., in the diocese of Canterbury. Dispensation, as below. The pope lately, upon his setting forth that he could not be promoted to all, even holy orders, without a papal dispensation on account of a spot in his left eye which deprived him of sight in that eye, ordered the archbishop of Canterbury, if the deformity were not too apparent, to dispense him to be promoted to all, even holy orders and minister therein, but not in the ministry of the altar, and receive and retain any office, even claustral, in any priory or monastery of the said order, and to resign it, etc. At his recent petition, containing that Thomas archbishop of Canterbury so dispensed him, and adding that he hopes to be elected a prior or appointed to some other ecclesiastical dignity, and therefore desires to minister in the said orders, even in the ministry of the altar, the pope hereby dispenses him, who has made his profession of the said order, to minister in all the orders which he has received, even in the ministry of the altar. His recent petition contained that after he had obtained by canonical collation the parish church of Banchotorpe [sic] he was wounded by certain adversaries in his right hand, and that it is so much weakened, and its fingers so much contracted and bent, that he cannot touch his thumb with his first finger. The pope, therefore, dispenses him, who is of noble birth, and is in or about his twenty-second year, at his own petition and that of Edward king of England, to have himself promoted forthwith (ex nunc) to all, even holy and priest's orders, by any catholic bishop of his choice in communion with the apostolic see, and to minister therein, but not in the ministry of the altar. To William Shirwod, succentor of the church of London. Mandate, as below. The recent petition of John Degre, priest, of the diocese of Ely, contained that lately, when already a priest, he put off the priestly habit and went to the parts subject to the temporal dominion of the present duke of Burgundy and, dwelling there in a lay habit for about three years in divers castles and fortresses, fought on the said duke's side and in his pay, and once took part in a fight in which many men were slain, but without killing or wounding any one, and that for more than four years he neglected to say and recite the divine office or canonical hours, (fn. 6) thereby contracting irregularity. The said John being penitent, and being desirous of serving in the orders which he has received, even in the ministry of the altar, and alleging that he holds no benefice, the pope, in order that the said John may not be compelled to beg, to the shame of the priestly dignity, etc., hereby orders the above William, if the facts be as stated, to absolve him from the said excesses, enjoining a salutary penance, dispense him on account of irregularity contracted and dispense him to minister in his said orders, even in the ministry of the altar, and rehabilitato him. To John bishop of Beirut (Beriten.), dwelling (fn. 7) in the city of London, and the abbot of Crowlond in the diocese of Lincoln. Mandate, as below. The recent petition of John Lokton, [layman], of London, executor of the will of the late John Derby, also a layman of London, contained that although the latter appointed the said John Lokton and Thomas Derlynton’ and John Wynnesbury, also layman, of London, as his executors, and although the said John Lokton, with consent of his said co-executors, paid divers legacies bequeathed in the said will, nevertheless the said co-executors, although often requested by him, refused to distribute to the legatees and others the goods of the said testator in their possession, in accordance with the said will, and converted them to their own uses, and, falsely alleging that he had alienated the goods of the said testator, without their will, and had dilapidated them, defamed him, and publicly boasted that they would cause him to be grievously punished and publicly proclaimed excommunicate as a dilapidator of the said goods by Thomas cardinal priest of St. Ciriac's in Termis, … legatus natus. … (fn. 8) and William Pykenham, auditor-general of causes of the court of the said legation, (fn. 9) wherefore he has appealed to the apostolic see. The pope, therefore, at the said petition for the commission of the said appeal, etc., and of the causes which the said John Lokton intends to bring against the said Thomas Derlyngton’ and John Wynnesbury in the matter of the execution of the said will, and the said diffamations and boastings, to some upright men in those parts, hereby orders the above two to summon the said Thomas Derlyngton’ and John Wynnesbury, and others concerned, hear both sides and, taking cognizance of the said causes also, decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. Decree and ordinance, as below. The recent petition of James bishop of Dunkeld contained that although with licence of Pius II four houses have been built in the realm of Scotland with the alms etc. of the faithful for the use and habitation of friars of the order [of friars] minors, called [the friars] of the Observance, to the great comfort of the inhabitants of the said realm, nevertheless, seeing that on account of the good works of the said friars and their exemplary life the devotion of the faithful in the said realm alike to the said frairs and to the observance of divine worship has very much grown, the desire of the said inhabitants would be greatly satisfied, and their devotion would be daily much increased, if some other houses were built for the use and habitation of the said friars. At the said petition, therefore, the pope hereby decrees and ordains that the vicar of the friars minors called [the friars] of the Observance of the province of Scotland. may, if the means be forthcoming, build two houses, or three houses, only, in the said realm, for the use and habitation of the, said friars, with a church, altars, a low bell-tower, bell, cemetery, cloister, dormitory, refectory, etc., without prejudice to anyone, or cause them to be built, or accept them if built by others, and that the said friars may inhabit them for ever, (fn. 12) saving the right of the parish churches within whose bounds the said houses shall be situate, and saving the right of any others. The pope furthermore grants to the said houses, when built, and to the friars who shall inhabit them, the enjoyment of all the privileges etc. granted and to be granted, etc., to other houses and friars of the said order and Observance, even to those beyond the Alps.
