To Thomas Morton, rector of Wydierisdal in the diocese of Norwich. Indult, as below. The recent petition of the said Thomas contained that it is very burdensome for him, whenever he is asked by the faithful to celebrate masses or say prayers for the souls of the departed, whether in his own church or in the churches of others. to have to hasten to the ordinary of the place for licence to celebrate and pray, in accordance with a certain mode introduced therein. At the said petition, therefore, of the said Thomas, who on account of the slenderness of the fruits, etc., of his said church cannot easily maintain himself, the pope hereby grants him indult that for as long as he lives he may on three days of the week, whenever requested, celebrate masses and other divine offices in his own church and in the churches of others, and otherwise pray for the souls of the faithful departed, and receive the salary, alms or oblations which may be offered to him without prejudice to any others, without requiring licence of the diocesan or any other, and convert the same to his own uses. To the bishop of Norwich, and John bishop of Beirut (Beriten.) and William bishop of Sidon, [both] residing in the city of London. Mandate, as below. The recent petition of Thomas Johnson, layman, of the diocese of London, contained that he and Margaret Wales, mulier, of [the diocese of] Norwich, contracted marriage per verba legitime de presenti, and that she afterwards de facto contracted marriage per similia verba with William Nicholasson, layman, of the same diocese [of Norwich], and solemnized it before the church, wherefore he requested William Pyknam, auditor-general of causes of the court of Thomas, cardinal priest of St. Ciriac's in Termis, papal legate in those parts, to order the said William to be cited before him in the cause which the said Thomas intended to bring concerning the nullity of the said de facto marriage; and that inasmuch as the said auditor refused to do so, and to administer justice to the said Thomas, the latter has appealed to the apostolic see, and has petitioned the pope to commit the cause of the appeal and that of the nullity of the said later marriage, etc., to some prelates in those parts, etc. The pope, therefore, hereby orders the above three bishops to summon the said William and Margaret, etc., hear both sides, and decide what is canonical, without appeal, causing their decision to be observed by ecclesiastical censure. The pope now dispenses him. who has resigned the said church of Yerburch, and has successively obtained the above archdeaconry, which is a dignity, and the parish church of St. Michael in Cornhill, in the diocese of London, and at present holds them in virtue of the said dispensation, to receive and retain for life any third benefice with cure or otherwise incompatible, even if a parish church, etc., and to resign it, etc., provided that of such three incompatible benefices not more than two be parish churches or perpetual vicarages. To the confessor-general and the convent of the monastery of SS. Saviour and Mary the Virgin and Bridget, Syon, of the order of St. Augustine, in the diocese of London. (fn. 4) Their recent petition contained that it is the custom in the realm of England for the altars of all churches to be placed towards the east, so that when celebrating mass the priest faces east, whilst the people hearing such mass stand behind the celebrating priest, and that they desire to build many altars in the church of the said monastery (which in many of its necessary buildings has been repaired at great cost, and which is not yet finished), according to the convenience of the place, even facing otherwise than to the east, but that on account of the said custom they doubt whether they can do so without scandal of the people, unless they have licence of the apostolic see. (fn. 5) At the said petition, therefore, the pope hereby grants them an indult to have any altars built in the said church according to the convenience of the place and the devotion of them and other faithful, even otherwise than facing the east, (fn. 6) notwithstanding the said custom, etc. Exposcit vestre deuotionis sinceritas. The pope lately (after dispensing him to receive and retain for life with the parish church of Tyntynhul (fn. 13) in the diocese of Bath and Wells one other benefice, etc., as above, f. 28r.), dispensed him (who had obtained by collation of the ordinary the deanery of Chichester, a major dignity, and was holding it with the said church in virtue of the said dispensation) to receive and retain for life with the said deanery and church, or with other two benefices held in virtue of the said dispensation, any other third benefice with cure or otherwise incompatible, even if a parish church, etc., and to resign it, etc. At his recent petition, containing that at the date of the said later letters he was holding, not the said parish church of Tyntynhull, but that of Burgtham alias Brugtham in the diocese of Carlisle, wherefore he fears that they may be held to be surreptitious, the pope hereby grants that they shall hold good from the date of these presents, as if they had mentioned Burgtham alias Brugtham instead of Tyntynhull.
