1430. 3 Non. Aug. SS. Apostoli, Rome. (f. 3.)	To the official of Raphoe. Mandate as below. The recent petition of David Omaelmuchoregi, priest, of the diocese of Derry, contained that although formerly he, who lately received papal dispensation, as the son of a priest and a married woman, to be promoted to all, even holy orders and hold a benefice even with cure, obtained, void by the death of Denis Ogormaili, by collation made to him by papal authority [see Cal. Lett. VII, p. 104] the perpetual vicarage of Magbili in the said diocese, of the patronage of laymen, after he had held it for some time Henry Maccolgan, clerk, of the same diocese, falsely suggesting to the pope that it had become and was void by the death of Magonius sive Magnellus Omaelrathi, and that David had unduly detained it for more than four years, the pope ordered the official of Derry to summon David and others concerned, and if he found that it was void by the death of the said Magonius or in any other way, to collate and assign it to the said Henry; and that Donatus Okearballan, then official of Derry, falsely reporting that it was void by the death of the said Magonius, and that David was detaining it as above, unjustly despoiled David thereof, and intruded the said Henry, who is still in undue possession, wherefore the said David has appealed to the apostolic see. At the said petition, which added that some assert that neither David nor Henry has a right, the pope orders the above official to summon the said Henry and others concerned and, having restored David, to hear and decide the cause, and if he find that neither David nor Henry has a right, to collate and assign the said vicarage, value not exceeding 16 marks, to David, whether it be void by the death of the said Denis or in any other way. 6 Kal. Nov. SS. Apostoli, Rome. (f. 30.)	To the archbishops of Canterbury and York, and the bishop of Adria. Mandate as below. The petition of John Godin, grocer, layman, citizen of London, contained that formerly —after he had contracted marriage per verba legitime de presenti with Isabel Olney, of London, and after the late Philip Buteler, layman (after the marriage so contracted had been intimated to him and inhibition had been lawfully made to him and her) had de facto contracted with her a marriage or rather concubinage legitime … per similia verba, and had consummated it, committing adultery—he—seeking to obtain a declaration that the said marriage contracted between Philip and Isabel had been and was null, and that his own said marriage with her had been and was lawful, to have Isabel adjudged to him as his lawful wife and compelled to solemnize the marriage contracted with him, and to have perpetual silence imposed on Philip in the matter of the marriage contracted by him with Isabel—brought the said Philip and Isabel before the official of the court of Canterbury (the official of London having abdicated his jurisdiction in the matter), who delivered after Philip's death a definitive sentence by which he adjudged the marriage between Philip and Isabel to have been contracted de facto and clandestinely solemnized and null, and the marriage contracted between John and Isabel to have been and to be lawful, adjudged Isabel to John as his lawful wife, and adjudged her to be compelled to solemnize the marriage contracted with him, from which sentence she appealed to the apostolic see; that the pope, at the instance of John, who asserted that the said appeal had been and was abandoned, committed the cause of the alleged abandonment to Master John Walling, papal chaplain and auditor, who declared that the said appeal had been and was abandoned; that on its being set forth to the pope on behalf of Isabel that she had been neglected in the prosecution of the appeal from the sentence of the said official, the pope gave commission to Master Peter Nardi, papal chaplain and auditor, to restore Isabel in regard to the said abandonment (adversus desercionem hujusmodi reponeret) and to proceed in the principal matter, who, having so restored Isabel, gave a definitive sentence by which he pronounced the said official's proceedings to have been good, confirmed his said sentence, and pronounced Isabel's appeal to have been bad; and that her appeal from Master Peter's sentence was committed by the pope to Master Alphonsus Segura, papal chaplain and auditor, who by a definitive sentence confirmed that of Master Peter, and declared Isabel's appeal therefrom to have been bad. The said petition of John Godin adding that he fears lest Isabel will not obey the said sentences and the proceedings to be taken under these presents, the pope orders the above three to execute the aforesaid, compelling Isabel to solemnize the marriage contracted with her by John, and to cohabit with him as his wife, proceeding by ecclesiastical censure, and invoking, if necessary, the aid of the secular arm, etc. Exhibita nobis. Mandate—after he has executed the letters by which the pope has this day ordered him to cause Eugenius Ocondualaythd, rector of Cechecdampnada (rectius Techecdampnada) in the diocese of Clogher, to be received as a canon of the Augustinian monastery of SS. Peter and Paul, Cluaneoys, in the said diocese, which is at present without an abbot, being void and therefore reserved by the death at the apostolic see of abbot Nicholas, and to receive his profession—to make provision to Eugenius, who is in minor orders only, of the said monastery, value not exceeding 24 marks, whether it be void as above, or by the death of Patrick Olorcan, or in any other way. Eugenius (who lately received papal dispensation, as the son of a married man and an unmarried woman, related in the third and fourth degrees of kindred, to be promoted to all, even holy orders, and hold a benefice even with cure) is hereby dispensed to hold the said monastery, and has faculty, after he has been promoted to the priesthood, to be blessed by any catholic bishop, who shall send his oath of faculty to the pope as usual; without prejudice to the bishop of Clogher, to whom the monastery is by ordinary right subject.
