Grant and indult (seeing that, as the recent petition of a number of members of the Roman court of the English nation contained, the hospital of Holy Trinity and St. Thomas the Martyr, Rome, for persons of the said nation, has a chapel to which the said members and persons much resort for the hearing of divine offices and otherwise, (fn. 2) and that the said members and persons earnestly desire the consecration of the said chapel and also of a cemetery which is to be therein deputed) that the said chapel and such cemetery, after it has been deputed, may be consecrated by any catholic bishop, and bodies buried in the said chapel and cemetery, saving parochial rights; and that the chaplains of the said hospital may, after hearing the confessions of all poor and persons of the said nation dwelling in the said hospital, and the servants thereof, absolve them from all their sins, crimes and excesses, except in cases reserved to the apostolic see, enjoin upon them a salutary penance, and administer to them the sacrament of Eucharist and other ecclesiastical sacraments. Rehabilitation, at his recent petition, containing that on the voidance of the perpetual vicarage of Termanncaelyn in the diocese of Elphin by the death of Ymarus Ocreachmayl, he, without any title, took possession by his own temerity and, without any dispensation, detained it for two years against 'Execrabilis' together with the perpetual vicarage of Baislig in the said diocese, and, after resigning Baislig, for more than a year, as he still does, taking the fruits from both, those of Termann not exceeding 3 and those of Baislig 4 marks sterling in yearly value. He is to resign Termann, and, as soon as he conveniently can, is to convert to the fabric of its church the fruits etc., taken during the [said] two years of detention. Sedes apostolica. To the bishop of Dunkeld. Mandate, as below. Martin V. (upon its being set forth by the late Thomas, [then] abbot, sometime monk of the Cluniac monastery of Paisley in the diocese of Glasgow, that the late Robert, abbot of Cluny, in accordance with ancient custom, had made provision to him of the said monastery, and that in virtue thereof he had obtained partial possession of the administration and had been blessed) confirmed the said provision and made provision to Thomas; and the present pope (upon its being set forth to him by the said Thomas that pope Martin, at the instance of John Lythqw, a monk of Paisley, a chaplain of the present pope, alleging that he had been despoiled of the said administration by Thomas, and that he had appealed to the apostolic see, committed the appeal cause to the late John, cardinal priest of St. Laurence's in Lucina, who, proceeding per audienciam contradictarum, gave a definitive sentence by which he removed Thomas from the said administration and restored John, papal letters of execution of which sentence (which became a res judicata) John obtained, addressed to certain judges; that the pope subsequently, calling up to himself all the suits and causes in the matter of the said administration between the said Thomas and John and any others, gave a commission to Lewis, sometime cardinal priest of St. Cecilia's, to inform himself about the foregoing, and make a report to the pope, and that inasmuch as the pope learned thereby that neither Thomas nor John had a right in or to the said administration, the pope, with the assent of John's proctor, extinguished all the suits and causes, annulled the said sentence etc., and made provision to Thomas, and then, in order that Thomas and John should remain in concord, granted to John in commendam, motu proprio, the parish church of Dondonald with its annexed chapels and the parish church of Quivox (sancti Kenoci) belonging to the abbatial mensa of Paisley, together with the manor and le manys of Munktoun in the said diocese, for life or until provision should be made to him of the abbatial or other dignity of any monastery, and he should obtain possession thereof, the pope's will being that as soon as the said commenda ceased, the said churches etc. should return to the said mensa, and belong to it as before. Seeing however, as James, king of Scots, and William, earl of Douglas have signified to the pope, the buildings of the said monastery are exposed to ruin and will be exposed to greater ruin unless quickly repaired and restored, that the said commenda is very burdensome (dispendiosa) to the monastery, that the monastery by various disasters is impoverished, that if the said commenda were revoked the abbot would be better able, with its other means, to carry on (intendere) the said repair, the pope, at the petition of the said king, whose progenitors were founders, and of the said earl, orders the above bishop to summon the said John and others concerned, and if he find what has been signified to him by the said king and earl to be the case, to revoke the said commenda, decree that the said churches shall revert to the said mensa and belong thereto, and to annul the pope's letters as far only as regards the said commenda, and order John at once to give up possession of the said churches etc. to abbot Thomas or his proctor, etc. Circa quorumlibet monasteriorum. Grant and indult, at the recent petition of certain faithful of the realm of Scotland (containing that many merchants and other persons of the said realm are wont to go on business to the town of Bruges in the diocese of Tournai and stay there; that they are ignorant of the language of the inhabitants, and are seldom able to find persons there to whom they can confess; and that a chapel was lately deputed for persons of the said realm in the church of the Carmelites' house there, in which chapel masses are celebrated by the chaplain thereof, who knows the language of the said merchants and persons, and who is from time to time taken by some of the said merchants and persons to other places distant not more than two or three days' journey from the said town), that the said chaplain may hear the confessions of the said merchants and persons, absolve them from all sins etc., except in cases reserved to the apostolic see, and enjoin penance, and may also administer to them sacraments and sacramentals. His recent petition contained that formerly he (who was commonly reputed by those who knew him to be of lawful birth, there being few who thought him the son of unmarried parents), believing that a dispensation was not necessary, had himself promoted to all, even holy orders, and ministered therein for many years, obtaining meanwhile the perpetual vicarage of Landyngant and, after resigning it, the rectory of Seynt Athan in the diocese of Llandaff, on the voidance of which latter, by the resignation of the late William Baker to the late John bishop of Llandaff, he was presented by the patron, Thomas Nerber, nobleman, lord of the place of Castelton in the said diocese, to the said bishop, who instituted him to the said rectory, which he now holds, the validity of which presentation and institution some doubt. The pope hereby rehabilitates him, wills that the said presentation and institution shall hold good from the date of these presents, dispenses him that by virtue thereof he may retain the said rectory, value not exceeding 24 marks sterling, and dispenses him ad cautelam to minister in all the said orders and to receive and hold two benefices with or without cure compatible with one another and with the said rectory, and to resign them and it, simply or for exchange, as often as he pleases, and hold instead three other compatible benefices; notwithstanding his defect of birth, if any, etc. Solet apostolice sedis. The pope lately dispensed him to hold for life, besides the said church, any other benefice with cure or otherwise incompatible, even if a parish church. etc., as above, f. 238d, and to resign them, simply or for exchange, as often as he pleased, and hold instead two other incompatible benefices, the letters of dispensation stating that after he had taken his degree of B.C.L., he had studied civil law for twelve years and had meanwhile often lectured publicly therein; after which (upon its being set forth by him to the pope that, although at the time of the said dispensation he was a B.C.L. and had studied for six years before taking the said degree, he had not lectured for twelve years after taking it) the pope granted to him, who alleged that he had taken the said degree by examination, that the said prior letters and their consequences should hold good, as if they had not stated that after taking the said degree he studied civil law for twelve years and lectured therein. At his recent petition (containing that he did not study civil law for six years before taking the said degree, and did not take it by examination, but that he was then a bachelor, as stated above, and took the said degree in the university of Oxford in the way customary in that university) the pope hereby grants to him (who holds the said church of Northerdeyne, the parish church of Islepe in the diocese of Lincoln, a canonry of Lichfield and the prebend of Hondesaer therein, the value of all not exceeding 40l. sterling) that the said letters and their consequences shall hold good, as if it were not stated in the said other letters that before obtaining the said degree he had studied civil law for six years and had taken the said degree by examination, and that he may retain the said two churches, notwithstanding the pope's late ordinance to the contrary [see above, p. 5], etc. (A. and G. de Elten. | A. xxv.
