Dec. 28. Burgh.

Ratification of the appointment of Henry le Waleys by J[ohn], archbishop of Canterbury, to the custody of his houses in Lamheth during the repairs which the archbishop proposes to make in his chapel there; and grant to him that he shall keep the said houses until the completion of such repairs in case the archbishopric meanwhile become void.

Grant, for life, to Robert de Ufford of the castle and town of Oreford, in compensation for 50l. of rent which he has surrendered to the king, and which Henry de Alemannia long since by his charter (which the king has inspected) granted to the said Robert, for life, of which 50l. he used to receive 36l. from the mills of Tykehull, 10l. from Ralph de Crumwell, and 4l. from the township of Frithebek.

Writ de intendendo to the tenants of the town and castle of Oreford.

Ratification to the prior and convent of Holy Trinity, Norwich, of a grant to them by Richard de Swerdeston and Isabella his wife of 11 acres of land and ½ acre of pasture in Ameringhale, notwithstanding their having acquired the same contrary to the statute of mortmain.

Letters for John le Bygod, staying in England, nominating brother Roger de Lacok and Alan Foet his attorneys in Ireland for two years.

Pardon to Geoffrey le Carpenter, in Nottingham gaol for the death of Ralph son of Jordan de Brimmesleye, on testimony before the king by John de Vallibus and his fellows, justices in eyre in that county, that he killed him in self-defence.

Mandate to S. bishop of Waterford, the treasurer, and the chamberlains of Ireland to pay to Nicholas, bishop of Kildare, out of king's moneys in their custody 100 marks of the gift of the king.

Mandate to Gregory de Rokesle and Orlandinus de Podio, keepers of the exchange of London, to pay to Alexander de Luka, merchant, 25 marks, granted to him by the king for his labour on the king's money.

Grant to Gregory Olydig, clerk, of permission to use and enjoy, throughout Ireland, the same liberties and customs as the English there.

Exemption, for life, to W[illiam], bishop of Norwich, from doing suit at the hundred of Hatfeld Peverel for his lands in Maudut, late of Gilbert de Maudut, and for his lands in Terling, late of John de Neketon: on condition that he pay a half-mark yearly at the Exchequer, the value of such suit being hardly worth that sum yearly to the king.

Mandate to Gregory de Rokesle and Orlandinus de Podio, keepers of the exchange of London, to pay out of the king's moneys in their custody, to Th[omas Bek], bishop of St. Davids, keeper of the king's wardrobe, 300l. towards the expenses of the king's household.

Protection, during pleasure, for the men and merchants of the town of Popering in Flanders, trading.

Protection with clause rogamus, directed to all bailiffs, for the keepers of London Bridge, or their messengers, collecting alms throughout the realm for the repair of the bridge which has fallen into a ruinous state, to the great danger of the almost innumerable people dwelling thereon.

The like directed to all archbishops, bishops, and ministers of holy mother church.

Confirmation of a sale, for 20 marks, to William Trumwyne, knight, by Ralph de Sandwyco, king's steward, of the custody, during the minority of the heirs, of the lands and heirs of William de Benetleye, tenant in chief, and of the serjeanty late of the said William, with their marriage.

Mandate to Gregory de Rokesle and Orlandinus de Podio, keepers of the Exchange of London, to let Geoffrey de Pycheford have 200 marks to the use of Eleanor, the king's consort, as a prest until Shrove Tuesday, for delivery to James de Venys, merchant, as the queen has commanded him.

Grant, in fee-simple, to Edmund, the king's brother, of the homage of Reginald de Grey, which pertained to the king for the land of Landynegate, and the homage of Richard Talebot, which pertained to the king for the land of Longehope; and release to the said Reginald and Richard of the said homages for the said lands.

Writ de intendendo to the said Reginald and Richard.

Release to him of 700 marks prest lately made to him in West-Wales by the hand of Ralph de Broghton, then the king's receiver there, in compensation for the lands and tenements late of the honor of Monmouth, which had been given by the king to Reginald de Grey and Richard de Talebot before he gave the said honor to his said brother.

Grant to Roger de Clifford of the custody, during the minority of the heirs, of the lands of Moaut and Hawardyn, late of Robert de Moaut, tenant in chief, the said custody having been surrendered to the king by Maurice de Croun.

Pardon, at the instance of Luke de Thany, to John Becard, who was found in the company of Almaric de Monteforti when the latter was coming to the realm, of his abjuration of the realm for divers trespasses.

Appointment of Alexander de Luka, merchant, addressed to Robert de Ufford, justiciary of Ireland, and S. bishop of Waterford, treasurer thereof, to the custody of the Exchange in Ireland, for one year from Easter next, under the form, manner, and conditions which Gregory de Rokesle and Orlandinus de Podio, keepers of the exchange of London, will transmit to the said justiciary and treasurer under seal; the said Alexander to coin and work at Dublin and Waterford the king's money and be master of the mint there for that time.

Acknowledgment of the delivery by Richard Guidichonis, merchant of Lucca, for himself and his fellows, merchants of Lucca, in the presence of R[obert], bishop of Bath and Wells, then chancellor, and Antony Bek, to Thomas de Gonneys, king's clerk, then clerk of the wardrobe, on Monday after St. Valentine the Martyr, 9 Edward I. the following precious stones, to wit, nine square-cut balasses (balesios quadratos), five on one spray (digito), and four on another; four larger balasses, somewhat round, on another spray; and on another spray six rubies (rubetos), and five emeralds, of the value of 112l.; as is shown by bill of the wardrobe.

Grant, in fee simple, to John le Botiller, of the manor of Wymering, co. Southampton, of the value of 40l. yearly of land, and of the manor of Blaneford, co. Dorset, which is extended at 17l. 9s. 11½d., by Ralph de Sandwico, king's steward, the said John having surrendered and quitclaimed to the king the manor of Ringwood for 60l. yearly of land, the deficiency of the amount granted by the present charter to be made up to the said John elsewhere out of the king's lands. Presentation of Master Philip de Guldeford to the church of Morsted in the diocese of Winchester, in the king's gift by reason of the voidance of that see.

Grant to John de Vescy of the custody, during the minority of the heirs, of the lands late of Robert de Muscegros, tenant in chief.

Mandate to Robert de Ufford, justiciary of Ireland, to cause Hubert de Burgh to be delivered from the prison in which he is detained for certain trespasses in Ireland, committed by him during the war, after having taken sufficient mainprise for his personal appearance in the next parliament at Westminster, which will be three weeks after Easter, before the king to hear and do the will of the king in this behalf.

Memorandum, that on Friday after Shrovetide at Rading, R. bishop of Bath and Wells, the chancellor, delivered the seal to John de Kirkeby, who delivered it there into the wardrobe and on the same day the chancellor retired from court.

Mandate to Master Henry de Bray to make livery to William de Valencia, the king's uncle, of the land and castle of Bergeveny, which are of the inheritance of John de Hastinges, a minor in the king's custody, and which were previously committed to him ; the king having ratified and accepted the demise made by the said Henry of the said land and castle to the said William at a rent of four hundred marks a year, payable to the keeper of the king's works at Buelt for the works there and elsewhere.

Grant to Walter, archbishop of York,—whereas, at the king's nomination, he lately granted to Robert de Lavann[ia], king's clerk, a yearly pension, which by reason of his recent creation as archbishop he was bound to grant to one of the king's clerks, to be nominated by the king, until such clerk was provided by him with a competent ecclesiastical benefice ; and whereas the said Robert renounced that pension and his right therein, if he had any, whereupon the king lately requested the archbishop to grant the said pension to Master Walter le Bretun, king's clerk, to be received of the archbishop's chamber, until the said Walter is better provided for—that no prejudice shall arise to the archbishop by this change of grant; and that if the archbishop provide for Walter as he is requested, he shall in no way be burdened with conferring a like pension on Robert.

Grant, at the instance of Patrick de Cadurcis, their lord, to the good men of Kedwelly of murage for three years from the Annunciation.

Commission to Master Henry de Bray and John Wogan to inquire touching all the trespasses committed against the king, the bailiff of Bergeveny and his men, after the feast of St. Martin last past, and to make speedy and sufficient amends therefor according to law and the custom of those parts; and mandate to the said bailiff, the sheriff of Hereford, the bailiffs of Geoffrey de Genevill, of Theobald de Verdun, of Ewyas, and of Edmund, the king's brother, of Monmouth and the Three Castles, to summon a jury to make the inquisition.

Commission of oyer and terminer to R[alph] de Hengham and R[oger] de Northwode touching the persons who broke the houses of Thomas de Normanvill at Wideford, co. Essex.

Commission to Thomas de Meteham and Robert de Baylol to inquire touching deodands in the county of York, as to whose hands they have come, and how and when and in what manner, and whose they were and by what reason and by what accident (casum), and of what value they are, and touching all the circumstances concerning the matter, taking with them the coroners of that county for making the inquisition, which is to be sent to the king in his next parliament after Easter instant.

Commission of oyer and terminer to Walter de Helyun and Roger de Burnhuil touching the persons who broke the park of Walter de Balum at Much Marcle (Magna Markeleye) co. Hereford, hunted therein, and carried away deer and other goods of the said Walter and ill treated his men.

Commission to William de Brayboef and Elias Cotele to deliver the gaol of Ivelcestre of Robert le Aguiller of Wilton who after the last eyre in the county of Somerset was put in exigent for the death of Walkelin de Rosey and hearing a rumour thereof gave himself up to the said gaol.

Mandate to John de Greilly, seneschal of Gascony, to pay to Eleanor, the king's mother, out of the issues of the custom of Bordeaux or elsewhere, 1,242l. 6s. 4d. of black money of Tours, being the balance still due to her according to a computation made on the morrow of the Annunciation, 9 Edward I. of all the assignments made to her in the custom of Bordeaux, and of the arrears thereof in suppletion of her dower, and of all the debts which were due to her for the land of the Agenais, allowance and subtraction having been made of 3,693l. 6s. 8d. of black money of Tours, paid by the said John and Raymond de Mirall[o], constable of Bordeaux, to William de Estden, her proctor, and of 240l. of like money received by him to her use of the issues of the lands of Saintes, the Isle of Oleron, Bourg-sur-Mer, St. Emilion, and L'Entre deux Mers, for the time she held them, that is, after the feast of SS. Whereas the church of St. Jesse au Bois (Sancti Judoci in Nemore) of the Premonstratensian order, in the diocese of Amiens, had a right of cutting wood (quoddam usagium) in the forest of Crécy, in Ponthieu, as appears in letters of Joan, sometime queen of Leon and Castile, countess of Ponthieu and Mostroil, it is agreed between the king and Eleanor his consort, queen of England, lady of Ireland and duchess of Aquitaine, countess of Ponthieu and Moustroil, of the one part, and the abbot and convent of the said church, of the other part, that in exchange for the said usagium they shall have a piece of wood with the soil (cum fundo) containing 160 journaux (jornalia), by the journal of Crécy, situated between Champmartin and the hays of Hellain, near the lands of Sir Henry de Nouvon, knight, as measured and defined by certain metes ; to possess for ever in mortmain, with liberty of selling or uprooting and cultivating the same; saving to the king all justice, high and low, and every kind of shrievalty (vicecomitatus) and of taking of beasts of the wood, with the tax for carting (riagium), unless the said church should sell the said wood and cart it with their owu animals (et propris vecturis quadrigaret), in which ease the said church should be quit of the said riagium. The said church may sell any part of the said wood on condition that all sellers and purchasers, on foot or on horseback, or with waggons, may pass through, go and return through the king and queen's whole lordship, as well through woods as fields under the same liberty and lordship, according to the uses and customs of the said forest.

The said church and its servants may keep the said piece, with the herbage and everything growing therein, from all persons, and may take malefactors found within their wood, and pursue them without, and receive amends thereof, according to the uses and customs of the said forest, without prejudice to any other person, and on condition that the said church cannot acquire anything of shrievalty or high or low justice. And if without the knowledge of the servants of the said church anyone should suffer forfeit in anything therein, and the servants of the king and queen should receive or arrest a malefactor outside the wood of the said church, the latter shall have a moiety of the amends, and the king and queen the other moiety.

The said church may also set up bounds (bonare) to the said wood or piece of wood, so that no impediment is caused to the beasts of the woods or those hunting them, or obstacle to prevent them coming and going therein as elsewhere in the said forest.

If corn or oats or other grain be there, the said church may enclose it, as is usual in that forest, with such enclosure as is not harmful or prejudicial to the beasts, as long as the corn is there. And in the said piece of wood they may enclose four journaux to make a grange (managium), to the use of the said church.

And in return for the said church quit claiming and renouncing iu favour of the king and queen all and singular articles coutained in the letters and privileges of the said Joan, making mention of the above usagium, and promising never to go against the premises, the king and queen grant that the said charters and privileges as to all other articles not making mention of the said usagium, shall remain in their full virtue as before, and will warrant that all and singular the above things be preserved to them in mortmain.

Inspeximus of a record and process held between the king and the bishop and chapter of Llandaff, before Master Henry de Bray, king's clerk, steward of Bergeveny, touching the church of Lanteliowe Purthelok in these words:—Hugh, bailiff of Bergeveny, who sues for the king in the name of John de Hastinges, a minor and the heir of Bergeveny, offers himself against Sir W. de Breus, bishop of Llandaff, and the chapter thereof, touching a plea of darrein presentment of the church of Lantelyou Porthalauk, and the latter not appearing, it was considered that they should be summoned Thursday before the Annunciation to hear the recognisance of the said assise. Court held on the last-mentioned date, 6 Edward I. at Berg[eveny]. The said bishop and chapter came and said that they were not bound to come at the summons of any bailiff or steward of Bergeveny for any writ of the king, nor to answer in that conrt touching the said church of Lanteliold Porthalauk, nor touching any right belonging to the church of Llandaff, because they and their predecessors from time immemorial continuously held it as appurtenant to their cathedral church of Llandaff, and they neither hold nor claim to hold anything of the lord of Bergeveny, wherefore they ought not to answer. And so they withdrew. And the court considered that that assise so arramed against them by the king should be taken in their default, and that further inquiry should be made touching the right of patronage of the said church, because such was the custom in that court.

Inspeximus of letters patent of the king (then the eldest son of Henry III.), dated at London, 30 June, 51 Henry III. surrendering into the hands of Henry III. and quit-claiming from himself and his heirs to the use of Edmund, the king's brother, the honor, castle and manor of Monmouth, given to himself by Henry III. previously and now granted to the said Edmund in tail general by him ; and promising to deliver to his said brother all that has been alienated by him from the honor aforesaid. And because the king has satisfied his brother in another way for the lands so alienated, the latter has acquitted the king of his said promise, saving to the said Edmund and his heirs the homages and services of all tenants of the said lands, according to the grant made to him thereof, and on condition that no prejudice arise to him with respect to any other thing contained in the above letters.
