Commission to Reginald de Leye and Richard de Staunford to enquire in the following matter. Henry III. both before and after the disturbance of the realm, and the king afterwards committed the counties of Salop and Stafford to the custody of Hamo le Estraunge and divers other sheriffs, who received the issues thereof and other debts due by summons of the Exchequer from men of those counties, and made tallies to some but not to others. Hamo and the other sheriffs and bailiffs of liberties never answered at the Exchequer for these, nor acquitted the said men there, but kept the money to themselves, whereby divers sums of money are still being exacted from the men of the commonalty of those counties for the time of the said sheriffs by summons of the Exchequer, and the said men are being distrained, as well those who paid such money and have tallies or other acquittances or other sufficient proofs of payment, as others who, by reason of the disturbance of the realm, through plunderings or fires or some misadventure, lost them. The king, pitying the state of such men, has appointed the above commissioners to enquire, by jury of those parts, of no affinity with either side, what and how much the said Hamo, when he was sheriff, and the other sheriffs and their clerks or bailiffs of liberties received, and from whom and on what account. They are therefore to go personally and cause the sheriff to make proclamation in full counties that all the said persons or their heirs who have paid any such debt to the said sheriffs, their bailiffs or the bailiffs of liberties appear before them on appointed days and places, with their tallies or other acquittances, having called before them all who have been sheriffs or bailiffs, or their heirs, or holders of their lands, to be present to answer the plaints of the said persons. But whether they come or not, the inquisitions shall proceed, and the plaints and answers being heard and the full truth enquired into, that which is just shall be done and due fines imposed when the cases can be terminated. But in cases where fines cannot be levied, the inquisitions shall be reserved for the king and council; provided that if any accused sheriff or bailiff vouch to warranty the rolls of the Exchequer, he shall have a day given him before the barons of the Exchequer.
