Bond to Arnald Guillelmi Aymerici and Raymond Alaund, citizens of Bordeaux, in 116 marks 8s.4d. sterling received from them as a loan at Bordeaux in tale by the hand of Peter Chaceporc, king's clerk and treasurer ; and in 183 marks 5s. sterling for wines bought of them to the king's use in England ; payable at Midsummer or sooner if the treasure comes from England.

The like to the following in the following sums received in tale by the treasurer and for wines, payable at Whitsunday :—

Segin Barbe and Ellis Barbe conjointly in 400 pounds of Bordeaux for a loan made to the said treasurer by tale ; 500 pounds of Bordeaux which they paid to Peter de Burdegala by mandate of the king when he was last seneschal of Gascony ; and 57l. 16s. for wines bought to the king's use.

Bond to Vidal de Galuta, Raymond Willelmi de Portu and Arnald de Ponte and their fellows, all of La Réole, if they faithfully hold to the king what they have promised, to refund any losses they may incur by reason of their said promise.

Grant to John de Basell', who withdrew from the realm of England for certain debts required from him and for having abducted and taken with him from England a married woman (feminam desponsatam), that he may return to England and stay there without impediment of the king's bailiffs, on condition that in the king's court and elsewhere he do and receive reason and justice as law and the custom of the realm require.

Mandate to the earl of Cornwall and Master W. de Kilkenny, archdeacon of Coventry, to provide for John de Suwerk, king's clerk, who is doing service with the king in Gascony, as soon as possible, in an ecclesiastical benefice of the value of 30 marks a year or less.

Bond to Peter Divac, citizen of Bordeaux, in 100 marks received from him as a loan at Bordeaux by the hands of Peter Chaceporc, the treasurer, and in 81l. 2s. of old debt for wines bought of him in England, to be paid at the exchequer at Westminster three weeks after Easter next. And the king has caused a writ of Liberate to be made to him thereof.

Mandate to John de Suwerk to deliver to no living man in the world any money out of the issues of the king's custom of Bordeaux by pretext of any mandate of the king, until he have satisfied Halengrat the Balister, citizen of Bordeaux, of 1,500 pounds of Bordeaux, which the king received from him as a loan by the hands of Peter Chaceporc, the treasurer at Bordeaux, and of 45l. for his losses sustained for 500 pounds of Bordeaux with which he accommodated the king before.

Exemption, for two years from Easter, for Pelerin and Reyner de Luka from all paages on their own merchandise throughout the king's power.

Exemption, for life, of John de Wauton from being put on assizes, juries or recognitions, and from being made sheriff, coroner, escheator, verderer, or other bailiff.

Feb. 4. Bazas.

Mandate to John de Suwerk, as soon as he have satisfied Halengrat the Balister, citizen of Bordeaux, of 1545 pounds of Bordeaux out of the issues of the king's custom of Bordeaux, as the king has commanded him by other letters, or have received from such issues to that amount, then for no other mandate made to him by the king is he to omit to satisfy Ellis Moner,citizen of Bordeaux out of the first issues of the custom of 500 pounds of Bordeaux wherein the king is bound to him for a prest made at Bordeaux by the hands of Peter Chaceporc, the treasurer.

Bond to Lambert de Puteo and Peter Andree de Luka, citizens of Bayonne, in 370 marks, 2s. 4d. which, at the procurement of S. de Monte Forti, earl of Leicester, they lent the king to be paid a month after Easter : and if not paid the king will refund any losses or expenses incurred by them through non-payment.

The like to Andrew de Bilambiz, citizen of Dax, in 100 marks, 29s. 11d.

Appointment, during pleasure, of Thomas the Goldsmith (Aurifabro), citizen of Bayonne, to the keepers of the bailiwick of Labenne (de Arena); with mandate to the good men thereof to be intendant to him as the king's bailiff.

Appointment of Simon de Monte Forti, earl of Leicester, to contract a loan in the king's name with merchants.

Notification that whereas Norman de Arcy has been detained by long illness and weakened by the infirmity of old age, the king, as his chief lord, has committed the keeping of his land to Philip de Arcy, his son and heir, for the life of his father, on condition that he take honest and filial care of him.

Protection without clause for Gilbert le Milker, citizen of London, from Wednesday after St. Peter's Chains, 37 Henry III, so long as he be on the king's service in Gascony.

Feb. 6. Bazas.

Grant to Halengrat the Balister, citizen of Bordeaux, in lieu of a grant by charter to him and his heirs of 20 marks a year out of the rents and issues of Bayonne, surrendered, of 20 marks a year of the king's great custom of Bordeaux, by the hand of the keeper thereof, until the king shall give him land to that yearly value out of the escheats in Gascony to remain to them hereditarily for ever.

And he has letters directed to John de Suwerk and all those who for the time being shall keep that custom, to pay the said sum to him yearly.

Bond to John Culum son of Jocem Culum, citizen of Bordeaux, in 40 marks sterling, received from him in money by tale by the hands of Peter Chaceporc, king's clerk, the treasurer, and in 60 marks for wines bought for the king's use in England; to be paid at Whitsunday or earlier if the king's treasure comes from England.

The like to Raymond Americi, citizen of Bordeaux, in 60 marks received by the said treasurer, and in 55l. 16s. for wine.

Grant, for life, to Hugh de Choupes of 10l. a year at the exchequer of Easter, by the name of a fee, to maintain him on the king's service.

Ratification of a lease for life by Walter de Sancto Johanne to Roger de Leyburn of all his land in Nessenden, co. Kent.

Commission, during pleasure, to Stephen le Engleys, citizen of Bordeaux, of the keeping of the whole land of Medoc and the whole forest of Bordeaux; and appointment of him to collect and receive to the king's use all the rents of the king's feudatories, within and without the city of Bordeaux, with the arrears thereof.

The king has taken into his protection (guidagium) the cows and cabins (cabanam) and their keepers which Arnald de Marchan has under his dominion in the lands of Teurten Superior and Theurten Inferior, until Easter next.

Pardon to Roger de Leyburn of 300 marks which were required of him at the Exchequer for the prest made by the king to Roger de Leiburn, his father, out of the issues of the eyre of the justices for pleas of the forest in the county of Essex by the hands of Robert Passel[ewe].

This has been commanded to the barons of the Exchequer.

Delivery to Raymond Monader, citizen of Bordeaux, and his heirs, of the prévôté of L'Ombrière (Umbraria), Bordeaux, from Michaelmas, 38 Henry III, until he have received therefrom the 170 marks which Simon de Monteforti, earl of Leicester, received from him as a loan, and which the king is to recover from debts owing to the earl in Gascony ; so that in every year during which the said Raymond holds it there shall be deducted for the said debt 120 pounds of Bordeaux. If the king should wish to hold the said prévôté in his hand and deliver it to another before the said Raymond is paid, he may do so without contradiction of Raymond provided that he forthwith pay whatever remains to be paid of the said 170 marks and the king will not disseise him until this be done.

Exemption, for life, of Henry de Rue, son of Gilbert de Rue, from being put on assizes, juries or recognitions.

Licence,until Michaelmas,for Lupus de Tudela and Ameran his son to pass through Gascony,to stay there and to leave it.

Grant to Henry de Paygni of 80 marks a year at the exchequer of Easter,to maintain him on the king's service.

Grant to Richard de Muntbelzard of 60 marks a year there,where before he used to receive 40 marks.

Pardon to J[ohn]Maunsell,provost of Beverley,in consideration of his many great services,to which in time past the king has had too little respect of his debts at the Exchequer,although the king does not know the amount thereof.

Mandate to the barons of the Exchequer to cause him to be acquitted thereof.

Grant to William de Valers,king's yeoman,of 15l.a year at the Exchequer until the king give him an inheritance of land to that value out of the first escheats,for the happy report he brought to Gascouy of the birth by the queen of a fair daughter(filiam speciosam)called Katharine;the escheats as they are granted to him to be deducted from the said 15l.

Pardon to Peter bishop of Hereford,in consideration of his services in Gascony,where he has been put to great expense,and of the embassage which he undertook of his own free will into Spain to the king of Castile, and of his having received nothing from the king to save his own stipend, of 300l.wherein he is bound to the king for divers debts,to wit,of two prests of the aid for marrying the king's first-born daughter,of the debts of Peter Grimbaldi and of the farm of Chiltham.

And it has been commanded to the barons of the Exchequer to cause him to be acquitted of the said 300 marks(sic).

Bond to John Maunsell,provost of Beverley,or his assigns in 20l.of land for a land of Hildesleg,co.Berks,whereof the king deprived him, and which the king of restored to Simon de Monte Forti,earl of Leicester, as is more fully contained in letters patent sealed with the great seal; and for another land in Kent which at the king's command he surrendered, and the king restored to B.archbishop of Canterbury to the use of the monks of Dover.

Request to the abbot of St.Ferme(de Sancto Firmario) to accommodate the king's constable of Roquebrune(Rokebruna)with 200 pounds of Bordeaux of corn,meat and wine as the said constable shall say:and the king will cause the same to be paid at the term signified to him by the abbot.

Grant to Philip Marmyun of 40 marks a year at the Exchequer as a fee until the king provide for him in that amount of land from escheats, or in some competent ward.

Safe-conduct,until Saturday before St.Peter in the Chair and throughout that day,for Gaston de Byarn and those he shall bring with him to La Réole;on condition that they bring no victuals to maintain the town of La Réole against the king.

Royal assent to the election of Henry,dean of Lincoln,to be bishop of Lincoln;and mandate to B.archbishop of Canterbury,to do his part herein.

Grant to all the feudatories of Bordeaux that they may without impediment of the king or his bailiffs cultivate their vineyards,saving any right of the king therein,through trespass,so that of the part which falls to the king he pay the cultivators of the said vineyards for their work.

Grant to the same that they may safely come to Langon and stay there until the Sunday after. Ash Wednesday and in the meantime reduce to writing the amount of their losses,by whom the losses were inflicted and who have received the produce of their rents and vineyards.

Grant to Peter de Nevill of 10l.a year at the Exchequer of Easter in in the name of a fee,until the king provide for him in 10l.of land from escheats or wards.

Grant to Master Gilbert de Millers of 50 marks a year at the Exchequer,until the king provide for him more amply.

Grant to Philip Marmyun,in consideration of his services in Gascony, that of all debts wherein he was held to the king,up to Thursday after St.Scholastica the Virgin,38 Henry III,to wit,of arrears of his account for the time that he was sheriff of Warwick and Leicester,of amercements before justices in eyre for common pleas and for pleas of the forest,and other justices appointed to take special assizes,and other justices for the king's privy pleas(ad privata placita nostra),as well as of his wife's relief for her land of Kylpec,and all other debts except the aid for making the king's firstborn son a knight;he shall render to the king at the exchequer 100s. a year,half at Easter and half at Michaelmas,until the whole be paid.

Appointment of P.bishop of Hereford,to the keeping of the manors of Strattonedale,and Liden by Northlidebiry,co.Salop,for three years from Easter,38 Henry III,so that he render at the Exchequer yearly as much as used to be rendered to the king for the manors.

Mandate to the queen and R.earl of Cornwall to cause him to have seisin thereof.

Grant, for life, to Arnald, lord of Montausier, of 30 marks a year at the exchequer of Easter, by the name of a yearly fee.

Whereas the king has released to his men of the commune of Bordeaux all prise on the tuns of wine which they shall cause to be taken to England, Ireland, Wales or other of the king's land beyond the ancient prise of 2 tuns of wine on every ship and customs of money laid on . . . . . . . or tuns in divers ports, he has granted that whosoever shall carry letters patent sealed with the common seal of the commune of Bordeaux shall be credited without further proof that the wines are those of men of the commune of Bordeaux.

The king to archbishops, bishops, abbots, priors, earls, barons, knights, clerks and others of England. The king is full of joy at the letters which the queen and Richard earl of Cornwall sent to the effect that the said archbishops, &c., are solicitous of his honour and roused to help him and even to come to Gascony against the king of Castile. He cannot thank them as much as they deserve.

For although messengers are going to and fro to make a treaty with that king, the king is anticipating the very contrary, both because the king's enemies in Gascony, after they had made a crafty treaty with the enemies of the said king, coming to King Henry set up the horns of their pride against the king, and also because after the last retirement of the king's enemies and of the king of Castile from King Henry, an immense quantity of money was sent from the side of the king of Castile which he would not have sent if he had intended to make a treaty in good faith. In consequence of this abundance of money and in the hope of succour from him, the enemy grows madder from day to day and opposes the king and his more often and more bitterly than before, and also the king of Castile, summoning his peoples on all sides, is preparing against the king as much as he can, so that this Easter he will be at Bures which is said to be only ten days distant. It would be a shame to the nobles of England, who have always excelled other nations in valour and strenuousness, if through inactivity (ignariam) the land of Gascony, which is the right of the king and of the crown of England, should be disgracefully torn from his hands and lost. Therefore let them gird themselves, and hurry up what help they can, for if they do not come swiftly and in force the king will incur shame and enormous expense. If the power of the Spaniards suddenly anticipate their aid, the king might easily be disinherited of what he holds at present in Gascony, and in consequence of the whole of the remainder of that land, as the barons, burgesses and others now adhering to the king's fealty desire and affect the dominion of the king of Castile rather than of the king. But if their power anticipate that of the king of Castile, there is no fear but that the king will be able to resist his incursions and endeavours.

Those who cannot come in person will kindly (velitis) contribute such and so prompt an aid that the king shall be bound to them and their successors in a worthy acknowledgment. And let it be so that the aid be sent when the queen comes. And that this service and aid shall not prejudice them or their heirs as a precedent the king has thought fit to send letters patent accordingly. Also, in order that the king may do them such favour as he can without breach of justice, he has commanded the queen and earl to cause the Great Charter of England to be proclaimed and held by oath of the several sheriffs in the several counties, on condition however that they (the archbishops and barons, &c.) cause it to be observed by their subjects, and that they give them letters patent accordingly.

Those who come in person should labour for the king's honour by being a fortnight after Easter or at latest three weeks after at Portesmuth ready to go on board. The greater and swifter their preparation, the more formidable it will be, and no information should get through to the notice of the enemy.

MEMBRANE 4.

Safe-conduct, for one year from Easter, for Thibaut, king of Navarre, going from Navarre through Gascony to France, and returning: unless he in any way join the king's enemies, or do anything whereby the king ought not to do this.

Grant, for life, to Bernard, count of Comminges, for his homage and service to the king and Edward the king's son, of 100l. a year at the exchequer of Easter.

The like to Bernard, count of Astarac, of 30 marks a year.

Mandate to the good men of St. Sever, as the king wishes in view of imminent expense that a mayor be appointed there for two years or longer if the war continues, to elect one of themselves who will do faithfully what is to the king's advantage and the preservation of the town, taking at once from him and also before Amauvin de Varreis, appointed seneschal in those parts, when the latter arrives, an oath upon this ; the mayor shall nevertheless do to the abbot of the said town the rights and customs due to him.

As the king purposes through God's assistance that the church of Westminster be dedicated before he take his journey to the Holy Land, to wit, a year after St. Edward's Day, 38 Henry III, on which day by God's grace he will wear his crown, it is commanded to Philip Luvel, the treasurer, and all the barons of the exchequer to cause 3,000 marks a year to be assigned to the use of the said church.

Mandate to the queen and earl to cause this to be done.

The king is sending to Poncius Maystre and Stephen his brother, Roger le Taillour to buy peltry to the king's use, and commands them to let the said Roger select what seems best for the king and to send one of their men with the said Roger to the king, and he will cause him to be paid.

The like is commanded to Bertram de Palacio, and the king will cause him to be paid the money due to him and what will be due for merchandise to be handed over to the said Roger at the present time. By R. Waleraund.

Mandate to Peter Chaceporc, the treasurer, when the treasure comes from England, to pay Guy de Lezignan 300 marks which should have been paid to him at Michaelmas last, and of which he has letters patent, which the said Peter is to take from him when he pays him ; and he is to pay him out of the first money that arrives without further order.

To the queen and R. earl of Cornwall. As they and all the magnates and prelates of England have sworn and promised lately at Westminster that the king would cause the Great Charter of England to be kept in all its articles, the king persisting in the same purpose wills and commands that they cause the same, upon the oath of the several sheriffs to be publicly cried in all counties and to be kept ; provided that the said magnates and prelates cause it in like manner henceforth to be observed by their own subjects.

To the archbishops, etc. Whereas the king lately requested them to be ready and armed to come to his succour in Gascony for the defence of his body and life as well as of the land of Gascony against the king of Castile, who is preparing to attack the king and that land, the king wills and grants that their voluntary coming to him for this time shall not prejudice them or their heirs or successors as a precedent.

Notification that Peter Bertram of Blankeford committed his castle of Blankeford to the king on Friday after the Annunciation, 38 Henry III, until Michaelmas, 39 Henry III, and the king has promised, and also by Robert Waleraund, his steward, has made oath on his soul that he will without cavil cause the castle to be restored to the said Peter, or his messenger bearing his letters patent with these letters, so that whoever may be the constable there on behalf of the king or of his son Edward shall restore it without further mandate. The king also promises that he will cause it to be sworn on the soul of his son Edward when the latter come to Gascony that he will keep this covenant to the said Peter and give him letters thereof. And nevertheless the said Peter shall in the meantime, without impediment of the king or Edward or the king's bailiffs, receive the rents of his lands of Blankeford.

Grant to Gaillard de Urnun that for whatever damage Gaston de Biarn did to him at the time when there was a truce between them, he may, whenever he will and can, take a pledge from the said Gaston.

Grant to Peter Bertram of Blankeford that the king and Edward his son will enter into no peace with the lord of Blankeford or his house (parentela) touching the castle of Blankeford to the damage of the said Peter so long as that castle is in the king's hands by the handing over thereof by the said Peter.

Grant to Robert Waleraund, to whom the king sold the wardship and marriage of the son of Robert de Brywes, which he has not had, of the wardship and marriage of the first girl falling to the king whose inheritance is worth 200l. a year.

Pepetua and Felicitas, 37 Henry III, to Thursday the feast of St. Gregory, 38 Henry III, and all receipts and expenses which he acknowledged before them being allowed, the king remained in debt to him in 1,069 pounds, 12 shillings and 3 pence of Bordeaux; on condition that he acquit the king against everyone touching the said castle.

Grant to William de Calviniaco, lord of Châteauroux, the king's brotherin-law, of 200 marks a year at the Exchequer, for life, or until the king provide for him in land to that value in wards or escheats. And in case of his death before Agatha his wife, the king's sister, she is to have the said sum for her life at the Exchequer.

Afterwards this letter was sealed with the great seal of England.

Licence for William de Talive, merchant of Agen, to bring a curallus which he bought at La Réole through the land and power of Gascony.

Acknowledgement of the king's indebtedness to William de Talina and William Torto, citizens of Agen, in 2,297 marks, 5s. 4d. for cloths received from them. The king acknowledges that he has not been damaged or deceived in the whole or any part thereof, and renounces any exception for not having had or received the said cloths or converted them to his uses and promises to pay as follows, to wit, 500 marks at Agen a fortnight after Midsummer or before if he have the money, a moiety of the residue next Michaelmas and the other moiety at the following Easter, at Bordeaux, every mark to contain 13s. 4d. of sterlings. And if he fail to pay at any term all the losses and expenses suffered thereby, he promises to refund. Further, Peter Chaceporc, the treasurer, John de Grey, Robert Galeran, William de Cantalo, Arnald de Monte Pesato and Peter Bertrandi de Blankafort, knights, have constituted themselves, at the king's request, as principal debtors and payers of the said debt, as well interest as losses and expenses, in case the king fail to pay ; and bind themselves and their heirs and all their goods, moveable and immoveable, present and future, to pay the same, renouncing all aids of fact or law, or defence, or exaction ; and have taken their oath for this on the Holy Gospels. The king remembers having written to them by other letters to provide for Roger de Messenden, king's clerk, who has never ceased to labour in the king's service in Gascony, in a benefice of 20 or 25 marks, but he has not had it yet, and has nothing wherewith to maintain himself in the king's service. The king therefore commands them to confer upon him the first that falls in, though it be a prebendal benefice or dignity, of the value of 20, 25, or under 30 marks, notwithstanding the provisions which the king formerly ordered to be made for Peter Chaceporc and H. de Wingeham, king's clerks, as these have given their assent to this. And if both are not present in England, then one shall do this.

The prior and convent of Carlisle, sending A. and G. their fellow canons, for a licence to elect after the death of S. their bishop, have the king's letters patent directed to earl Richard and Master William de Kilkenny, or either of them present in the realm, to give the royal assent to the election of John, prior of Newburgh to be elected as bishop, and to make restitution of the temporalities. But if they do not elect him, they are to send the person elected to the king.
