Patents of the Forty-fifth Year of the reign of King Henry son of King John.

Grant to Hugh le Despenser of 50 marks a year at the Exchequer, until the king provide for him to that yearly value of land of wards or escheats.

Notification that the king has received into his protection and keeping throughout his power the burgesses of Limoges (Castelli Lem') as well as other burgesses of the king's land; and the king wills that throughout his land they have safe coming and going by their usages and customs, saving the liberty of the said burgesses.

This letter was first sealed beyond seas by the same words, but its date only was renewed.

Vacated because they did not have it.

Signification to the bishop of Salisbury of the royal assent to the election of John de Saunde, monk of Schireburn, to be abbot of that place.

Henry, prior of Battle, Walter de Sutton, and Richard de Brytwalton, coming to the king with letters patent of their chapter, have licence to elect.

Notification to Louis, king of France, of the appointment of Master Simon de Vercellis, and Nicholas de la Leye, clerk, as the king's proctors in the king's cause against Reynold de Pontibus and Margaret his wife, touching the affair of Brugerac, and in all questions and disputes affecting the king in the parts of Limoges, Perigueux and Cahors.

Appointment of them

Notification to the said Louis of the appointment of Nicholas de la Leye, king's clerk, to sue and have again the king's court of Gascony upon the question or petition which Reynold de Pontibus and Margaret de Thoran, his wife, are making to the king touching the castle and land of Brigerac.

In the same form and words issued another letter under the name of Master S. de Vercellis.

Afterwards there was joined with them William le Latymer in the said form and they had four pairs of letters.

Appointment of William prior of Le Mas and Amauvin de Varisco, knight, as the king's proctors to make an extent or appraisement of the land of the Agenais; and to enquire on the king's behalf whether the land which the count of Poitiers holds in the diocese of Cahors by reason of his wife was given by any of the king's predecessors with the land of Agen in marriage or in dowry with the mother of Raymond, sometime count of Toulouse, or whether that land was ever given or demised in the name of a pledge by any king of England.

Exemption for three years from All Saints last, at the instance of Bartholomew de Roucestre, Friar Preacher, of Roger le Vineter and Avice his wife, sister of the said Bartholomew, from all tallage affecting them in the city of Rochester or elsewhere.

Grant to Ralph de Bakepuz of the wardship of the lands late of Reynold de Bernivall in Botiston during the minority of the heirs.

Appointment of Henry de Bracton as special defender and protector of the king's house of Witham of the Carthusian Order, and of the prior and brethren dwelling there. If anything be forfeited by them which cannot be amended by him, he is to signify it to the king without delay.

Mandate to the sheriff of Somerset to assist him when he wishes it.

Renewal under the present seal of the letters of pardon to Walter de Scandelby for his flight and of his consequent outlawry for the death of Michael de Raythyrby, as they are so worn by old age, that the seal appended thereto has been broken on all sides.

Mandate to William de Bakepuz, escheator in Ireland, to cause Miles, archdeacon of Clonmacnois (Clonensem) to have full seisin of the bishopric of Elphin, his election as bishop thereof having been confirmed by A. archbishop of Armagh, and the king having taken his fealty.

Notification that by the king's special precept Walter de Lindeseya, one of the heirs of William de Lancastre, has delivered into the wardrobe to Aubrey de Fiscampis and Peter de Wintonia, clerks of the wardrobe, on Sunday after the feast of St. John before the Latin Gate, 44 Henry III, by the hands of Robert de Sicclinghale, treasurer of the New Temple, London, 200 marks of the forty-second and fortythird years; and the said Walter by the king's precept has paid 100 marks to them by the hand of Adam de Hoton at Westminster on the morrow of All Souls 45 Henry III, of the preceding year, of 100 marks a year which by the king's letters patent he should have paid to William de Valencia the king's brother, at the New Temple, London, of the portion contingent upon him of the debts which William de Lancastre owed to the king and the king granted to his brother.

Mandate to the barons of the Exchequer to acquit the said Walter of the said 300 marks.

Pardon to Richard de Wurmele for the death of John Ters of Waltham, as it appears by inquisition made by John de Wivill that he struck Robert his nephew with a stick in a ship in which the said John Ters was with them, and the said John fleeing terrified in the ship that he should not be struck by Richard, fell on the side (bordura) of the ship and died of a wound which he received in the head in falling.

Prohibition against any person attempting anything against the privileges of Giles de Erdinton, king's clerk, dean of Wulverehampton, or of the king's chapel of Wulvernehampton or of the canons or servitors there; contrary to a privilege touching royal chapels granted by a rescript of Pope Innocent which the king has given to the said Giles to copy so that all may give credence to the king's privileges; and the text of which rescript is enrolled here word for word. Simple protection, until Easter, for Peter son of Peter de Monte Forti, staying beyond seas.

Protection with clause for Edward the king's son, gone bevond seas, so long as he be there.

Grant by the counsel of the magnates of the council to James de Alditheleye of the wardship of the lands late of Isabel Basset, tenant in chief, in England, Wales, and Ireland, saving the marriage of the heirs and the advowsons of churches; and during this wardship the yearly fee of 60 marks of the said James which he receives at the Exchequer shall cease; and the surplus in the value of the said lands by a reasonable extent which the king will have made, the said James shall deliver during the said wardship to the abbess and nuns of Fontevrault for the 80l and 50s. a year which they receive at the Exchequer of the king's appointed alms.

Ratification of a lease for eighteen years from Martinmas, 45 Henry III, by Philip Marmiun to Peter de Monteforti and Richard de Stroda of his whole land in Torindon.

Grant, at the instance of Alan Durward (Hostiarius), to Luke de Gisorciis, for four years from Martinmas, that he shall not be distrained for the debt of another unless he be the surety or principal debtor.

The like, at the like instance, to Hutingus Castebal of Arderne.

The like, at the instance of the king of Scotland, to Ralph de Ravenesher, for ten years from the feast of St. Clement, 45 Henry III.

Grant, at the instance of A. king of Scotland, to Richard de Insula, of quittance for five years from Martinmas, from suits of the king's counties, hundreds, trethings and wapentakes; and from common summons before the justices in eyre for common pleas in the counties wherein he has lands; and from being put on assizes, juries or recognitions or from being made sheriff, coroner, escheator forester, verderer or other bailiff of the king against his will.

The like, at the like instance, to William de Merkeshale.

Whereas John Columbi, sometime mayor of Bordeaux, and the jurats of that city charged Gaillard de Solio, lately returning from England to his own parts, with a crime, and caused him and his favourers to be arrested for security and caution; and the king, for the preservation of his honour, and the peace of that city, wishing to be certified touching this matter, commanded the mayor and commune of Bordeaux that, if the said Gaillard found to them before the seneschal of Gascony three or four reasonable sureties, to go bail for him and his said favourers to be before the king of England at the Assumption, 43 Henry III, to do and receive justice touching the said crime, they should deliver them; and also commanded the said mayor with seven or eight of the city to be with the king on the same day, so that when the truth was found, the said Gaillard if guilty, or the others if any of them by chance had invented this against him maliciously, should be subject to due vengeance : and whereas the mayor and commune of Bordeaux would not permit the said Gaillard and his favourers to be bailed, but detained them as before contrary to the king's mandate, whereby they could not appear before the king on the appointed day, and the mayor and his accomplices disdained to appear on that day, as the king had commanded them, whereupon the king caused Arnold Kaylau, then mayor of Bordeaux, and John Columbi, mayor of the preceding year, with seven or eight of their fellow-citizens and the said Gaillard with his favourers to be cited to be before the king in Paris on the morrow of St. Katharine the Virgin, 44 Henry III, to proceed in the said business, at which day the said Gaillard, with his favourers appearing, ready to do what of right they ought to do, but the said mayors and other citizens of the adverse party did not come. Afterwards the king appointed for the said Gaillard de Solio and his accomplices the quinzaine of the Purification, to be before him and Edward his son in England, citing moreover, at the complaint of the said Gaillard de Solio of the breaking of the peace lately made by the king between him and his party and the said Gaillard Columbi and his party, Gaillard Columbi, William Reymundi Columbi, Amanieu Columbi, John Columbi, Peter Gundomer and others to appears on that day and put forth against them what they should see fit to put forth for the king's honour and the good of the city, on which day Gaillard de Solio appeared, ready to do what he ought, but the adverse party contumaciously made default : the king, wishing to put an end to this affair, for the preservation of the peace of the said city, commanded them on the faith and oath in which they are bound to him, to be before him at St. Peter's Chains next, in England, in hostage (in hostag') for the reformation of the said business, so that by the counsel of prudent men the king might do what was just therein, and what was for the benefit of those parts. At which date the party of Gaillard de Solio appeared, as he ought, but the adverse party, in contempt of their oath, for the fourth time made default. Wherefore the king pronounces the party of Gaillard Columbi guilty of inventing the said crime against Gaillard de Solio to the dishonour of the king and Edward his son, and acquits the said Gaillard de Solio and his party of the same so far as concerns the king and his son.

Promise that Margaret the king's daughter queen of Scotland, after giving birth to her child shall return to Scotland after her purification, that is, after forty days, and that if she die, her offspring shall be delivered to her husband, or in case of his death, to certain magnates of Scotland specified. Commission to Henry de Tracy to view and test wines in all boroughs, cities and towns of the county of Devon, where wines are for sale; and commanding him that taking with him the sheriff, he withdraw whatever wines he finds to be putrid or corrupt, and cause the tuns to be emptied, to avoid danger to the country. Acknowledgment of the payment by Simon, abbot of Langele, and the other executors of the will of Roger de Thurkilby, lately deceased, into the wardrobe to Aubrey de Fiscampis and Peter de Wintonia, king's clerks and keepers of the wardrobe, in the forty fourth year, of 200 marks which they promised to the king of the goods of the deceased for having the king's aid to obtain the debts of the deceased without delay.

Power to the abbot and convent of St. Edmunds which by pleas and manifold persecutions is in debt, to tallage for this time their burgesses and other free tenants in the town of St. Edmunds for the discharge of its debts; provided that the tallage be reasonable and without grievance of the said burgesses and free tenants according to the custom of the realm, as other citizens and burgesses of the king are used to be tallaged. Presentation of John de Wyham to the prebend which Master Geoffrey de Sancta Agatha, deceased, had in the church of Aucland, in the king's gift by reason of the voidance of the bishopric of Durham; directed to G. archbishop of York.

Mandate to William de Dene, justiciary of Ireland, and Master William de Bakepuz, escheator in Ireland, to restore the temporalities of the abbey of the Mount of the Apostles Peter and Paul, Lugwith, void by the translation of Donatus, late abbot of that church to be abbot of Clonhors, to John, subprior of the house of St. Mary, Lugwith, elected by the prior and convent to be abbot of the said Mount of the Apostles, to whose election the king has given his assent although the prior and convent, through inexperience did not first ask for the king's licence to elect. They are first to receive the fealty of the said elect as well as letters patent of the prior and convent that this grace shall not be drawn into a precedent.

Grant, at the instance of Alard de Seningham, to Baldwin, constable of Ostrewik, and his heirs that if the manor of Shopelaund, in which he claims right, shall fall into the king's hands, the king will not give or alien it to anyone, but will keep it until he knows, by lawful inquisition, to whom it should descend by hereditary right.

Pardon, at the instance of the king's daughter Margaret, queen of Scotland, to Eleanor daughter of William le Fevre of Waynflet of her flight and outlawry for the death of Thomas son of Joceus le Charpenter of Beninton.

Pardon to James Isenberd of his flight and outlawry, as it appears by inquisition made by Robert Walerand that, whereas William de Scamelisby and Roger Wasthors, servants of the preceptor and brethren of the house of the Temple, Cumbe, broke a chest of the preceptor and carried away the treasure found therein, and came to the house of the said James in Sindiston to eat and he admitted them for this, and certain of his enemies maliciously accused him of participation in this crime, and the said brethren upon this threatened him grievously, the said James fled through fear of that threatening, and, not because he was guilty.

Commitment to the prioress and nuns of Acornebyry of the king's demesnes of Acornebyry with the wood called Alstaneswud for twenty years from Michaelmas, 44 Henry III, they rendering 8l. a year as the Exchequer.

Grant to Benedict de Rochemadur and Pelerin Peset that they may have for this time a shipload of wine which is in the port of Sampwic' quit of all prise except the ancient prise.

Simple protection, for five years, for Robert de Aunewik, chaplain, warden of the hospital of St. Mary Magdalene, Bamburg, and the brethren of that hospital.

Grant to William de Talyva, merchant of Agen, that he may have his own wines which he brings to England for five years from Christmas next, quit of all prise except the ancient prise.

Licence, after inquisition made by Thomas Gresle, justice of the forest on this side Trent, for William de Say to enclose his wood of Hanger which is within the forest of Pambere with a hedge and ditch and make a park of it.

Licence for Roger de Mortuo Mari to sport (ripariandi) for this time along the rivers of the Thames, Kenet and other the king's rivers in the counties of Berks and Southampton, if the king do not come in person to those parts.

To Fulk de Orreby justice of Chester. Whereas in the truce between the king and Llewelin son of Griffin it is contained that there should be six dictators for the part of Edward the king's son in the county of Chester, and six dictators for the part of Llewelin to treat of interruptions of the truce, and the king has sent to Llewelin for his dictators to be at Wepre a week after Hilary; he commands the said Fulk to send thither six dictators for the part of his lord and to be there himself.

Grant to Master Henry Luvel, the queen's cook, that so long as he shall be in the service of the king and queen, he shall be quit of tallages, as well as of suits belonging to the king's court of la Berton of Gloucester by reason of the lands late of Robert le Sawage, sometime sheriff of divers counties, in Twigewrth.

The prior and convent of St. Swithun's, Winchester, have licence to elect; by Ralph Russel, Walter de Oxonia, and Nicholas de Merewell, their fellow monks, coming to the king with letters patent of their chapter.

Licence, after inquisition ad quod damnum made by Thomas Gresle, justice of the forest on this side Trent, for Robert Walerand to assart and bring into cultivation a moiety of his wood of Coytemor, which is within the metes of the hay of Hereford, and without the regard, and to enclose it so that the king's deer can get in and out.

Collation to Hugh de la Penne, king's clerk, of the prebend of Alvytheleg which H. bishop of London had in the church of Bruges and which is void by his resignation; with mandate to the constable of the castle of Bruges to give him full seisin thereof, assigning him a stall in the choir and a place in the chapter.

Grant for life to the king's knight Alan Burnel, by reason of the guardianship of the bishopric of Winchester being in the king's hands, of the stewardship of the priory of St. Swithun's, Winchester.

Mandate to Nicholas de Haudlo, guardian of the said bishopric, to give him seisin thereof, saving the right of anyone.

Richard de Turr' has a like letter of the office of the laundry of the said priory.

Henry de la Wade has the like of the office of the chamberlainship of the said priory.

Re-presentation of John de Wytham, king's chaplain, to the church of Elindon, in the diocese of Salisbury, with a request to G. bishop of Salisbury to defer no longer to admit him.

Protection with clause, for one year from Easter, for M. bishop of Rochester, going to the court of Rome on the affairs of his church.

Grant for life to Walter Faunt, minister of the king's kitchen, of the office of the scullery of the priory of St. Swithun, Winchester, in the king's gift by reason of the voidance of the bishopric of Winchester; with all things, liberties, customs and other appurtenances of the office.

Grant to William de Galeweye, king's sumpter-man, and his heirs of that cottage and those 4½ acres of land in the manor of Geytington, which Simon Bulloc held of the king and which are the king's escheat, because Simon abjured the realm for felony, as appears by inquisition made by William de Wendling, escheator on this side Trent; to hold as Simon did doing all the customs and services which he used to do.
