Treasury reference to the Prizes Commissioners of the petition of Edward Grove shewing "that as a security for payment of 75l. he received a note from Mr. Antho. Burnaby, Secretary to the Prize Office, payable to his brother James [and drawn] upon the Deputy Receiver [of prizes]" but on application for payment was told by the Deputy Receiver that it had been paid to the said Secretary : and the said James is absconded and the Secretary not to be spoke with. July 24 and August 1. Treasury reference to the Customs Commissioners of the petition of William Gurle, son and administrator to Leonard Gurle late Keeper of St. James's Gardens, shewing that he is in custody for 260l. due to her Majesty for Customs on tobacco, but 2060l. remains due to him from Charles II as administrator to his father : for want of which he has been obliged to mortgage his estate. July 24. Warrant by Treasurer Godolphin to the Surveyor General of Crown Lands for a particular of part of Waltham Forest where Sir Thomas Webster bart. desires to enclose a way for the more easy and safe access to his seat of Copthall where he now inhabits : all in order to a lease to him of the said enclosure for 31 years at 1l. 5s. 0d. per an. rent.
Prefixing : said Surveyor's report on said Webster's petition for same. The present way is as petitioner alleges very bad and dangerous. The way now proposed to be made at his own charge will extend from Epping Road in a straight line to the end of his avenue leading to Copthall, in length on the south west side 146 rods and on the north east side 133 rods and 8 rodd and 13 foot in breadth and contains by admeasurement 7 acres 2 rods 20 perches. What is desired will be no prejudice to the forest as there is no timber on the premises but only bushes and shrubs with which all the neighbouring parts in Epping Walk (where the said premises are situate) do abound. The borderers on the forest do usuall turn in cattle to feed upon the premises and this petitioner's tenants chiefly, but I dont find they have any just claim to such privilege but that her Majesty may lease any part thereof. "And it were to be wished that since this [Epping] Walk for many miles together is altogether neglected both in regard to deer and timber that some enclosures might be made for nursing up young trees or improving the land (which is a tolerably good soil) rather than let it remain useless as it does at present." The petitioner proposes to plant with young trees and there being a way across the same from some villages thereabouts to Epping &c. he engages he will affix 2 clap gates in the common passage now used which will prevent any inconveniences by the intended inclosure. Same by same to the Principal Commissioners for Prizes to appoint Jonathan Thomas (an extraordinary clerk in the Accountant's Office for Prizes) as clerk there loco Edward Richbell, who notwithstanding frequent admonitions continues negligent after the most unaccountable manner and "without erring" not having attended the office one whole day in a week.

Use your utmost care to keep all accounts so and give your assistance in the adjusting those of the late Ambassador : in particular please peruse the enclosed copy [missing] of bills brought to the Treasury by Sir Henry Furnese of which he desires payment viz. one drawn by the late Ambassador for 4450 milreis and the other by the Earl of Peterborough for 7000 pieces of Eight which the said Ambassador requested you to pay. Prefixing : report dated 1706 June 7 from Jos. Tredenham and Arth. Moore, Comptrollers of Army Accounts, on the representation of Col. John Hill ut supra p. 633 praying the adjusting the accounts of his Regiment during the time they were prisoners in France.
Hereon the Comptrollers report that in adjusting the accounts in accordance with the Act of 4-5 Anne c. 12 (which provides inter al. for the pay of the Regiments of Lieut. General Stewart, made prisoners at Castle d'Ovida in Portugal in June 1704, and of Col. John Hill's Regiment made prisoners at Port Allegre in May 1704 and so continued for the space of twelve months or thereabouts) "we have taken the following method. We directed the several Officers to form muster rolls for every two months from the time of the last muster of them in Portugal to the time they were mustered on their return into England." We have strictly examined same with the last muster rolls taken in Portugal and with the receipts for the draughts made into Lieut. Gen. Stewart's Regiment and the muster rolls taken on the landing in England. And we have heard and examined the Officers thereon : and thereupon we have computed the respits as follows from 25 Aug. 1704 to 25 June 1705.

We compute the full pay of the Regiment according to the Portugal Establishment from 25 Aug. 1704 to 24 June 1705 to amount to 12920l., so that after deducting the above respites there will remain 10,540l. 11s. 2d. to clear the Regiment to that time. There were several that were respited in the last muster rolls taken in Portugal and the Officers affirm that these were then in their Companies and remained so till death or desertion and were subsisted accordingly. And the Officers allege that that muster was taken after the Regiment was made prisoners of war and was not taken by view but by report ; which we are inclinable to believe, there being sundry of these private men respited on those rolls which we find afterwards delivered to Lieut. Gen. Stewart or mustered in England. These we have allowed but as to those alleged to have died or deserted (amounting to 119l. 8s. 0d. as follows) we submit the consideration thereof to your Lordship.
