ship was staved near said island and no person coming to land alive
they went off in their fishing boats and discovered several blocks of
tin and with great hazard got up 150 of them and put same into a
warehouse at Portland under the custody of Mr. Seward and Mr.
Bower "they alleging that it is her Majesty's tin" : therefore
praying one third part [thereof] for their trouble which they say is
customary" and that the tin may not be shipped off till there be

Walter Brough, father and executor of Lieut. James Brough late of
Lord Charlemont's Regiment, shewing that upon his last petition
the Paymaster was ordered to see justice done to petitioner before
any more money be paid to the Agent ; since which time the Agent
has been discharged and Capt. Robert Gardner has been appointed
to succeed him, who opposes petitioner's stopping any of the money
of the Regiment "notwithstanding the clearings that were paid by
her Majesty to the 14th May 1702 are still in the Lord Charlemont's
or his Major's hands ; that Capt. Francklin, (still in the said Regiment)
has in his hands of petitioner's son's pay the value of his
clothes and 68l. 3s. 4d. which he had of petitioner and as he believes
the Agent has 27l. 15s. 0d. more which Lord Charlemont is answerable
for ; that Capt. Gardner has long delayed your petitioner with
assurances that the late Agent was coming over to settle his accounts
with the Regiment which is now to be cleared off" and acknowledges
that he has more money in his hands than will satisfy
petitioner's demands : therefore prays that 100l. may be stopped
till both or either of the said Agents fairly account with petitioner.

of Walter Jefferys shewing that in Sept. 1704 he was empowered by
Exchequer commission to collect the temporalities of the bishopric
of St. Davids during the vacancy of the see : that notwithstanding
the rental given him by the Auditor amounts to 571l. 4s. 9d. he hath
not been able to collect more than 40l. 11s. 10d., the tenants alleging
that by his commission he had no power to make a distress for nonpayment,
the see being supplied in March following : that Mr. Lucy,
the former collector, has since his last account (which was 2 Feb.
1701-2) received several sums of which he refuses to give petitioner
an account : therefore praying further directions about the collecting

garden and the slip of ground that goes round the meadow there)
being in all 140 acres : as in place of his 1600l. per an. contract of

Same by same to the Postmasters General to make allowances as
follow to Edmund Dummer on his contract for the West India
pacquet boats viz. (1) in his account for the year ended Jan. 25 last
400l. 7s. 10d. "to equal the rate for the port of letters to and from
the West Indies to the rate of letters passing between England and
Portugal" (2) the like rate for the future for all letters taken by the
enemy or sunk, as also the freight of passengers similarly taken or
lost (3) to make no deduction for deficiency between Jan. 25 last
and Oct. 25 next. (4) thenceforward to deduct the deficiency of
8000l. for the postage of letters and freight of passengers out of said
Dummer's quarterly payments until the whole deficiency for the
first two years of his contract be made up.
Appending : report by said Postmasters General on said Dummer's
memorial. Mr. Dummer is obliged by his contract with this Office
for providing 5 vessels for correspondence between England and the
West India Islands to reduce the yearly sum of 12,500l. (agreed to
be paid [to] him by 4 equal quarterly payments for maintaining the
said vessels) to the certain annual charge of 4500l. : and upon an
account to be made up at the end of the first year if the income by
letters and passengers did not amount to 8000l. then the deficiency
was to be deducted from the last quarter's payment of the first year,
if sufficient ; otherwise, out of the first quarter's payment of the
succeeding year.

On our report on his first memorial upon the prospect of a deficiency
likely to happen the first year of the sum of 8000l. Your Lordship
directed us (by your warrant of Oct. [sic for Dec.] 11 last supra p. 497)
to pay him the full sum payable to him on the said contract on the
25th Jan. last without making any abatement or deduction for the
deficiency which shall appear at that time and that the said deduction
instead of being made out of the payment due at that time should
be made out of the half year's payment due and ending the 25th July
instant, notwithstanding anything in the contract to the contrary
[which said warrant had the effect of respiting until the 25th
inst. the deduction of the first year's deficiency of 8000l.].
What has been received for the port of letters and freight of
management in the first year of the contract ending Jan. 25 last
amounts to 4449l. 1s. 0d. whereby it appears there hath been a deficiency
of 3550l. 19s. 0d. which Dummer by his contract is to answer to her
Majesty.
By the contract the port of letters to and from the West Indies
was to be advanced to the same rate as is received for letters passing
between England and Portugal. But 2 mails happening to be sent
to the West Indies and one to be received from thence before the
warrant was signed by the Queen allowing us to advance [raise] and
demand the said port we were not empowered to receive more
than the former rates. The loss to Mr. Dummer thereby in the 2
mails outward amounted to 69l. 1s. 3¼d. and by letters received by
our Deputy at Plymouth for the West Indies to 14l. 7s. 6¾d. and by
the mail homeward bound to 316l. 19s. 0d. or in all 400l. 7s. 10d.
We think it reasonable to allow him this sum towards the deficiency
of 8000l. for the first year and then the [said] deficiency will be
3150l. 11s. 2d.
The reason of this great deficiency in the first year has been his
not being able to [put] his boats into that readiness and order as it
is hoped they will be for the future ; by which means there have
sometimes gone 3 mails in one boat at a time, "which has been the
occasion of fewer letters being sent than otherwise would have been
and likewise of our receiving here fewer mails from the West Indies."
As to his demand of allowance for port of letters and freight of
passengers in pacquet boats cast away or taken by the enemy we
think it reasonable he be allowed same and we should have had no
objection to such a clause being inserted in the contract.
In regard to the great expense he has been at in building so many
new vessels for this service and that 2 of his boats have been lately
lost "the supplying of which has been chargeable to him" we do
not object to prolonging to Jan. 25 next the deduction of the
deficiency for the first year which stands respited as above to the
25 inst., provided that an account be at that time made up of the
first 2 years of his contract and that the deficiency of 8000l. for the
first year and 8000l. for the second year be deducted together from
the payment due to be made to him on the said 25 Jan. next and in
case the same should not be sufficient, then out of the succeeding
quarters till the whole deficiency be made up.
At the time the agreement was concluded with Mr. Dummer for
the West India correspondence there were 2 boats then at sea which
had been fitted out at the Queen's charge, the said service being
then upon [the Queen's] account and not upon contract. But to
avoid any confusion in making up the whole account to the
commencement of Dummer's contract we agreed that he should be
allowed the benefit of the letters and passengers returning home by
the said vessels, he taking upon him all the charges of wages, victuals,
wear and tear and hazard of the sea or enemy from the 25th Jan.
1704-5 the commencement of his contract. We have accordingly
given him credit for the same. Money Book XVIII, pp. 266-9.
Letter of direction for 345l. 13s. 0d. to the Earl of Ranelagh, late
Paymaster of the Forces : out of malt surplus anno 1702 : to satisfy
divers respits on the Earl of Essex's Regiment of Dragoons between
1701-2 March 16 and 1702 Oct. 24 which respits were removed by
royal warrant of 1704 May 8. Disposition Book XVIII, p. 158.

petition of Richard Fownes Esq. for leave to surrender to William
Long the stewardship of divers manors in co. Somerset, which office

18s. 10½d. to the clothiers who supplied the clothing and accoutrements
for the detachment of 400 men which was made in Nov. 1705
from the Forces in Ireland and shipped for Newfoundland but after
they had been 3 months on board and put to sea they were forced
back again and then countermanded, and on their return so much
of the clothing was lost by the death of the men who had the same
and by other misfortunes as came to the value of 476l. 18s. 10½d.

been misrepresented as one who refused to go to the West Indies
he was struck off the list of half pay : all in accordance with the

Holmes who has served near 40 years and went from Ireland to
Portugal as a Lieut, in Lord Mountjoy's Regiment where he continued
till by age and heat of the country he became almost blind and

Capt. John Murray who were Londonderry officers and served with
very good characters during the whole war of Ireland but were
formerly struck off the establishment of half pay but on examination

Treasurer cannot give order therein until you propose what rate
you think most equal. Take care to adjust the matter of the 100,000
pieces of Eight lent by her Majesty to the King of Spain in the
manner agreed upon, to wit by deducting it out of her Majesty's
subsidy to the King of Portugal for this present year. You and the
Consul at Lisbon are to be very watchful and vigilant in all such
things at the Court of Portugal until the arrival of Mr. Methuen

bills drawn by Lord Galway from Madrid July 4 last on Baron
Souasso at the Hague will be in some danger of a protest for want of

to supply Baron Suasso (who has no effects of Lord Galway in his
hands) with money to answer same. What you pay on this account

of William Tirrey on behalf of himself and the rest of the owners of
the ship Prince of Orange which was hired by the said Commissioners
11 April 1702 but the account thereof could not be passed for 2
years by reason the land officers had not signed the same and
petitioners have lost their course of payment, and 2000l. and upwards
due for that service is placed to be paid one of the last of the second
[book or] establishment [of the Transport debt] : therefore praying
that same may be placed on the first [book or] Establishment.
