April 1 Sir Ro. Howard to Sir Ro. Long. Mr. Henry Bruncard complains that his brother, Viscount Brouncker, has received, or struck tallies for, three quarters [on the farm of the Issues of Jurors] without satisfying him according to their agreement reserved in said Viscount's patent. You are to adjust the matter between them according to their agreements, and not permit Viscount Brouncker to strike any more tallies in relation to that particular of the issues of Jurors without satisfaction made to Mr. Brouncker for what is past; and so from time to time in future. April 1 Treasury subscription of a docquet, dated 1671–2, Mar., of a warrant ascertaining [or fixing] the first quarterly payment of the yearly rent of 53,000l. due from John Forth et al. on the grant made to them by His Majesty of the inland Excise and ale and beer licences in Ireland amongst divers other branches of the revenue of that kingdom: there being a doubt made by the officers of the Exchequer, Ireland, as to when the first quarterly payment of said rent ought to commence, by reason whereof said Farmers cannot have their legal discharge. The Treasury Lords to Giles Litcot, Comptroller General of Customs, to give to Auditor Beale an account of the moneys received by Richard Mountney (Receiver General of Customs) from the several receivers in the port of London and of the remittances in bills from the several collectors of the outports and of sums drawn on said Collectors by said Receiver General for the half year to Lady Day last: all in order to the half-yearly stating of said Mountney's accounts. The Treasury Lords to the Trustees for sale of Fee Farms to proceed with the contract with Sir Robert Tompkins for the rent of 115l. per an. issuing out of the manor of Gisburn, co. Yorks, accepting from him as in part payment thereof a surrender by him of an annuity of 102l. 13s. 4d. issuing out of His Majesty's fee farms and other rents in co. York. Ibid, p. 310.
Same to the Auditor of the Receipt for an account of how much money has been paid into the Receipt from the sale of His Majesty's rents and how much in the whole there is charged upon it, what thereof has been paid, and the value of the orders which are registered and remain yet unpaid, "to the end when we are informed from His Majesty's Auditor of the rates of the whole value of His Majesty's saleable rents wee may be able to judge whether any will remain for the satisfaction of" Lord St. John and his partners for their advance on the late intended farm of the Customs: that is after the register [of orders on said fee farms] is discharged and satisfied. April 3 The Treasury Lords to the Customs Commissioners to permit Bernard Rust, master of the Scotch vessel called the "Christian," of Carriden (seized by one of His Majesty's ships under pretence of belonging to the enemy, but it appearing to be otherwise and that she belongs to His Majesty's subjects) to take out her lading and put same on board lighters without paying Custom: it being only in order to his receiving satisfaction for damage done by the embezzlement of his goods: taking care that none of said lading be landed. Ibid, p. 312.
Same to same concerning prizes. By our warrant of Mar. 19 last we directed that the Customs officers of the outports should deliver over to the Sub-Commissioners of Prizes all such prize ships as were come to their hands but to take care of the Customs where bulk was broken and goods landed by said Sub-Commissioners. In order to secure said duties you are to grant bills at sight for landing said prize goods and to appoint some Customs officer to attend at the landing to take the account and contents by marks, numbers, or otherwise and to see same safely put into warehouse, a Custom officer to keep one key thereof and the storekeeper for prizes another key: so that they may not be delivered till a perfect entry be made and the duties discharged: also that when prize ships are sold the Custom for same be paid ad valorem. Treasury warrant to Lord Willoughby, of Parham, to take a review of the state of the account of the arrears due to the soldiers of the regiment late under the command of Sir Tobias Bridge whose names were in the first muster rolls and remaining in the service in the said regiment, the King having ordered, 1670, Dec. 22, that all such arrears and half the arrears of the officers thereof should be paid out of the 4½ per cent.; but the Treasury Lords being informed that contrary to the said directions of the King several soldiers of said regiment have been brought home which were not in the old muster roll and their arrears stated, and that several other mistakes have happened in the stating of said arrears. April 3 Treasury warrant to the Customs Commissioners to permit John Ogilby to import. Customs free, the unimported remainder of the 20,000 reams of royal paper or other paper to the value thereof, as by the privy seal of 1670, June 13. Warrants Early XLIII p. 316.
The Treasury Lords to the Trustees for sale of Fee Farms for an account of the value of the rents to be reserved from sale in order to meet the payment of perpetuities and other constant payments [charged on the Crown revenues in the respective counties] and for Hampton Court, the Isle of Wight, several castles in the Cinque Ports, and other pensions and payments: all with a view to the desire of Lord St. John and his partners to purchase fee farms as security for their advance on the late intended Farm of the Customs. [ ? ] Same to Sir Robt. Holmes concerning his complaint against one of the Customs officers of the Isle of Wight concerning wines on board a galliot. We conceive the man only did his duty, but out of esteem for you we will move the King that the 11 tuns of wine which you say are for yourself and those other commanders of the fleet may be exempted from duty. April 3 Same to the King's Remembrancer. The Agents for Hearthmoney have occasion to inspect the rolls and records in your office. As these are things that ought to be carefully kept and not delivered out of your custody you are to appoint some fit person to attend on notice to produce and show same to said Agents and to suffer them to take copies. April 3 Money warrant for 100l. to Henry Partridge and Thomas Drayton for reward for discovering one Tho. Hunt to be the owner of a small pocket pistol and to be one of the persons who made the late barbarous attempt upon the person of the Duke of Ormonde. (Privy seal dated March 30.) April 8 The Treasury Lords to the Customs Commissioners to direct the Customs officers not to demand any duty upon the landing of provisions for the squadron of French ships designed by the King of France to join His Majesty's fleet in the present expedition against the Dutch: the French King having sent several provisions as below to be landed at Chatham, of which there is some part already arrived in three ships, the one laden with wine and two with salt fish: in regard same is intended to be shipped off again and the French Ambassador has engaged under his hand that if any part thereof shall not be shipped off Custom shall be paid for same, and also the duty of 5s. per tun. Treasury warrant to the Surveyor General of Crown Lands for a particular and ratal of a parcel of land called Hamp Moone, in the manor of Ryme, Duchy of Cornwall, co. Dorset, with a view to a lease thereof to Robert Randall, who prays to add a third life to the lease granted five years since to John Ward for his son's life in reversion of one Humphrey Holman, since deceased, and John Jolliffe. April 10 Royal warrant to Sir Rob Long, Treasurer and Receiver General of the rents and revenues formerly in jointure to the Queen Mother, to pay 1,000l. out of said revenues to Sir Ste. Fox "for such our secret service as wee shall direct." King's Warrant Book III. p. 104.
Treasury warrant to the Surveyor General of Crown Lands for a constat of certain parcels of ground formerly part of the Tilt Yard and Walsingham Garden, whereon Sir Robert Holmes has lately built and enclosed a yard with a brick wall abutting and certain other parcels of ground leading from a new building of 61 foot in length and 15 foot in breadth and one other parcel of 18 foot next the park wall and but 12 foot in breadth, upon which last parcel he has erected a dwelling house: all in order to a lease thereof to said Holmes. The Treasury Lords to the Navy Commissioners to direct the Treasurer of the Navy to furnish the Victuallers with 1,500l. weekly or 2.000l. if the necessity of that service demand it; until said Victuallers have received 10,000l. thereon: all to enable the Victuallers to carry on the service of the present extraordinary petty warrant victualling. April 13 Royal sign manual to the Attorney General to prepare a bill for the Great Seal for the demise to Daniel Collingwood of all that island commonly called Holy Island, in the county of Northumberland and bishopric of Durham, and of all the tithes of corn and grain, hay, flax, hemp, lambswool and fish, and all other tithes, great and small, in said island, as also of all waters, fishings, pools, liberties and privileges of fishing and all other rights, jurisdictions and privileges to the said island belonging in as large and ample manner as the said island and premises were granted unto us by Christopher Lister, Esq.: all for 31 years from Lady Day last, at the yearly rent of 1l. 6s. 8d.: but with an exception to the King of the whole use and benefit of the port, haven and castle, and power of enlarging and fortifying same, but with a grant, nevertheless, of the keeping of said castle for the King's use: and with a further exception of all lands deserted by the sea accruing or adjoining to said island. Treasury warrant discharging Richard Marriot from executing the place of Receiver of the King's revenue of the honor of Windsor, he not having given such attendance on that service as was fit, and appointing in his place William Roberts, gent., on the recommendation of Prince Rupert. The Treasury Lords to Sir George Fletcher et al. Commissioners for the subsidy in co. Cumberland. We hear from the receivers of the Subsidy in your county of a great miscarriage of one Mr. Ferdinando Hudleston in encouraging some assessors in the lordship of Millom in their undue actings, "and although we do not in the least doubt the truth of the information, being very well satisfied in the person from whom it comes, yet we do for some reasons judge it convenient for us to have some further evidence. We do therefore desire that you do examine the matter speedily and certify us how you find it. We have thought fit to give you particularly this trouble because by a copy of a warrant issued by you for fining the assessors, which the Receiver has transmitted to us, we find you have already had cognizance of the matter." We take notice of your affection to His Majesty's service. Ibid, pp. 328–9
April 13 Royal sign manual for 300l. to William Carter for his service in prosecuting offenders against the laws prohibiting transport of wool; Sir Edward Turner, Kt, Chief Baron of the Exchequer, having reported that owing to said Carter's care much more money has been brought into the Receipt within four years past than in former years and there being now many more informations of that kind defending the conviction whereof will require a present supply of money. April 15 Treasury warrant to the Commissioners of the Navy to order the Treasurer of the Navy to imprest the following sums to the following persons appointed by His Majesty for the more effectual carrying on the present press [gang work] in the several counties of England as Agents particularly to attend and solicit the Lords Lieutenants, Deputy Lieutenants, Justices of Peace and chief Magistrates of the most considerable inland towns in the speedy execution of that service, viz.: Col. Whitley, 30l.; Major Wood, 30l.; Mr. Broxholme, 20l.; William Christian, 30l.; George Williamson, 20l.; Mr. Mansell, 30l.; Mr. Littleton, 20l.; Mr. Maurice Hunt, 25l.; Mr. Cranfeild, 20l.; Mr. Browne, 30l.; Mr. Ridley, 30l.; Mr. Jones, 45l.; Mr. Watts, 20l.; Mr. Morrison, 30l.; Mr. —, 30l.: same being for defraying their present charge and expenses therein. April 29 The Treasury Lords to Sir Robert Holt in Warwickshire. The Receiver of Hearthmoney, co. Warwick, has sent us a warrant of yours requiring Henry Hargrave, one of his deputies, to restore a distress by him taken upon one Foster, a smith, for the duty of his forge. We are informed you have done the like for several others, not only after you were acquainted with the judgment of the King's Bench in the case, but after the judge of your circuit had at the assizes publicly made same known: and also that you told said Hargrave that you will still so proceed upon any appeal made to you, and that if the goods were replevyed and a suit commenced the King will be cast if tried in the assizes in Warwickshire. This seems so strange to us that a person of your ability and on whom we did very much rely in all the concerns of His Majesty's service that we thought fit to acquaint you with it. We desire to know from yourself before we make any further complaint [to the Privy Council] what we may for the future expect from you. You have given us fair warning not to venture so clear a case for the King at a trial in your county or any other else but at the Barr and the conveniency you have done your neighbours is that by your proceedings we shall be forced upon supers to issue process out of the Exchequer against them, which will be ten times more charge. If you or any of your neighbours are not satisfied with the result of the action in the King's Bench we shall take it well if they try the title again. The case is considerable to His Majesty in point of revenue, and the law and the reason of it very clear on his side, and if the mistake of some that are His Majesty's sworn justices shall endeavour to take it away we are not to suffer it, and must beg you to consider if by these undue proceedings, and after all these fair offers, the country be put into any disorder. from whom the King is to expect an account, and at whose door it will lie. April 29 The Treasury Lords to the Customs Commissioners. We are informed by the Sub-Commissioners of Prizes for London port that there is a quantity of corn on board the "Old Abraham," a prize brought into said port, which must be sold to prevent perishing. You are not to insist upon a greater duty than by the Book of Rates, notwithstanding the duty imposed by the late Act for tillage, which was only intended in cases where the corn was brought in by way of merchandise. Same to the Chancellor of Durham. We have considered the condition of His Majesty's present tenants in the Bishopric of Durham as lately represented to us in relation to their several tenures. As it is important they should have all due encouragement and indulgence therein you are to let them know that it is His Majesty's pleasure that paying their rents as formerly they shall hold and be continued in their respective possessions and may go on to perfect any bargains begun by them. Take care for the present to grant no new term in any of the premises for more than one year, and where the old tenant will not hold any longer at the former rent you are to admit others.
