Treasurer Danby to the Earl of Bath, Lord Warden of the Stannaries. By your letter of the 20th ult., enclosing copies of your letter to the [tin] convocators and their answers [to you] I perceive your great care and their averseness to what has been reasonably proposed for His Majesty's service. It is fit to put them in mind how for their sakes only the King has been contented for eight years past to leave that valuable part of his revenue almost wholly neglected ; and that he should scarce yet have required it, but that he found reason to believe that a longer indulgence might hazard the prerogative right herein which His Majesty's ancestors had always carefully preserved : and yet [His Majesty] resolved to do it so favourably as not to interrupt their trade by imposing a pre-emption or confining them strictly to the few requirable coinages but caused this Convocation to be summoned and left it to them to propose some expedient by increase of duty to buy off the right of pre-emption or by a moderate farm prevent the inconveniences of it. But how little they have contributed to promote His Majesty's gracious intentions I am sorry to see for 'tis too apparent that after a year spent in trifling they have proposed a price so far beyond the price current as that they themselves cannot expect they should be thereby otherwise understood than only as wholly regardless of any accommodation. This return of His Majesty's goodness might reasonably provoke him to exact and put in execution all his prerogative rights and powers in that matter. But considering it might bring inconveniences to the trading and adventuring tinner the King is pleased as yet to suspend the same and once more to attempt their settlement by again proposing to take an increase of duty in lieu of pre-emption, or to take all their tin for 10 or 21 years at 4l. per cwt., which is more than the best mercat price. But if after intimation hereof they shall not think the matter deserves a more solemn and temperate consideration I think you would do best to adjourn the convocation to such time as I may return you the King's further pleasure. Oct. 5 Same from same to the Receipt to take in and cancel the tallies and countertallies on the Excise for 59,000l. to the Treasurer of the Navy, as by the warrant of Aug. 19 last, and to strike fresh tallies, bearing the same date, on the Excise Farmers, and expressing the same to be in full of or as completing the sum of 65,000l. which was agreed by the said Farmers to be advanced by them by way of additional advance : all by reason that the same not being so particularly expressed in the said warrant of Aug. 19 last the tallies are not so regularly struck as they ought to be. Oct. 6 Money warrant for 1,000l. to Sir Robert Vyner for one year to Sept. 29 last, on his patent of 1671, Sept. 25, granting him 1,000l. per an. for 12 years : to be by tallies in the Customs. Money Book (Customs). p. 175.
Warrant from Treasurer Danby to the Receipt. Under an order for 1,500l. drawn in the name of Jeremiah Bonnell, gent., which with interest thereon amounted at the day of payment to 1,847l. 6s. 0d., a letter of direction was written Sept. 19 last, ordering it to be paid by tallies on the 5s. per ton on French shipping. A tally is levied for that sum accordingly. It falls out that there is 700l. due from Sir William Bucknall and Major Robt. Huntingdon on their farm of that duty ended 1671, Oct. 10, and as Bucknall is now sole farmer of said duty he cannot pay that sum on said tally. To remedy this you are to cancel said tally and strike two fresh ones, one for 700l. on the late Farmers, and one for 1,147l. 6s. 0d. on the present Farmer. Money warrant for 9,863l. 4s. 4d. to Sir Robert Vyner and partners as below : the King having by the patent of July 23 last, ordered two years' interest to the goldsmiths detailed : and it appearing by a certificate of the Auditor of the Receipt of Sept. 18 last that 9,863l. 4s. 4d. is due to Sir Robert Vyner and partners : which is 1,982l. 11s. 2d. less than two years' interest of their principal of 98,714l. 19s. 10d. for which interest is payable in the Exchequer. The like warrant for 9,738l. 5s. 5d. to Isaac Meynell and partners for interest as above : it appearing from a like certificate from the Auditor of the Receipt, dated Sept. 17 last that the said sum is due to said Meynell and his partners, which is 2,387l. 13s. 9d. less than two years' interest of their principal sum of 101,049l. 15s. 11d. for which interest is payable at the Exchequer. Warrant from Treasurer Danby to the Customs Commissioners to discharge the seizure of the ship "Concord," of London, owned by Mark Mortimer and others upon payment of natives' Customs only ; same being set out upon encouragement of the declaration of 1672, May 10, and might by virtue thereof have sailed to any of the King's Plantations though manned with all foreigners ; and being obstructed by contrary winds arrived not in the Thames after the time limited by the proclamation of Mar. 11 last, although she came within the soundings the last day of said indulgence, and wanted but two men of her proportion of English as by the Navigation Act. Oct. 7 Sir George Charnock affirms that there were articles between him and Mr. Thomas Charnock, his nephew, agreed upon to be signed and sealed upon his surrender of his office of sergeant at arms to His Majesty with intention that the same should pass to said Thomas Charnock to enable him to act as his deputy upon which it was agreed that security should be given by the said Thomas Charnock for performance of the said articles : which articles have not been yet executed. Mr. Ambrose Norton, Surveyor of the Mews, says that Mr. Doughty has received as imprest 1,134l. 6s. 0d. in Mr. Norton's name, so that unless he brings the workmen's bills and acquittances for discharge of the work process will come out against Mr. Norton, although he never touched one penny of the money, and Mr. Doughty refuseth to bring in said bills and acquittances. Norton therefore prays that Doughty be ordered so to bring them in or that he [Norton] may be heard therein. Caveat Book, p. 10.
Oct. 8 Warrant, dormant, from Treasurer Danby to the Excise Commissioners from time to time to pay to the Treasurer or Receiver General of the Queen Consort 10,972l. 19s. 3 1/24d. from June 24 last, without abatement or defalcation whatsoever, and before any other person or persons whatsoever, with the same exactness and punctuality that the constant charge of the Excise Office is quarterly paid : the King having by letters patent of 1672, Dec. 20, granted said sum to the Queen to complete her jointure to 40,000l. per an. : upon which letters patent Treasurer Clifford issued his dormant warrant of 1672-3, Jan. 25, to the Farmers of the Excise of London, Middlesex and Surrey : the present warrant being necessary as the present Farmers of Excise are now to pay in their farm rent to the said Excise Commissioners. Warrant from Treasurer Danby to the Customs Commissioners to permit some presents which were sending to the royal family of Portugal and now left at Dover, and 10 packets of goods belonging to Dr. Fabre, first Physician to the Queen of Portugal, which are now on the ship "Mary," and a long case containing a copy of the Prince of Portugal's picture and a box containing a great old looking glass to be brought to the Custom House of London, where the said picture may be delivered to the Lord Ambassador of Portugal, and said Doctor's goods may be opened and taken away for the use of said Doctor and his family during their stay here : provided they are not prohibited goods. Treasurer Danby's subscription of a docquet, dated 1673, Dec., of a warrant to the Exchequer to pay to Sir William Godolphin 30l. a week from 1672, May 20, to 1674, Sept. 29, as Ambassador in Ordinary to Spain : being in addition to his ordinary allowance of 10l. a day allowed him by the privy seal of 1671. Same from same to same to pay the late charge in the destruction of tobacco in the West, viz., in Gloucestershire and the adjacent counties : and to recompense as they think fit Edward Oughtred and John Parsons, employed June 24 last to Sept. 29 last in the [Customs] Secretary's office, for which they had no pay by reason of Mr. Blayney's leaving the place. Report from same to the King on the petition of Col. Fra. Willoughby's wife (as by the order of reference of Aug. 19 last). Petitioner's allegations concerning the arrears, deserts and sufferings of said Col. are very true, and timely relief to his family would be a just and charitable act, viz., by some issue towards payment of his debts : to be made upon the 80,000l to be paid to your Majesty by Visct. Ranelagh at the expiration of his contract : "and I suppose your Majesty's certain revenue of Ireland will bear a pension of 300l. per an." if your Majesty is disposed to grant it to said Col. and his wife. Warrant from same to the Customs Commissioners to discharge a seizure of the ship "Guift," Peter Bosse master, on payment of natives' duties only, as petitioned for by Thomas Roberts : it appearing by the oath of Isaac Davy, the master's mate thereof, that said ship sailed for Jamaica before the publication of the peace with a crew of four English, one Scot and one Swede (the Scot being at the time supposed to be English), but arrived not [back] within the time limited by the proclamation of Mar. 11 last. Oct. 13 Money warrant for 565l. to Thomas Henshaw, Envoy Extraordinary in the Court of Denmark, viz. 440l. on his ordinary of 5l. a day as by the privy seal of 1672-3, Jan. 27 : that is from 18 April last (the date of his last payment) to July 15 last, the date of his return into the King's presence, and 125l. for a bill of extraordinaries duly certified. Same for 11l. 4s. 11d. to John Portman : it appearing by a certificate of the Auditor of the Receipt of the 14th inst. that 751l. 13s. 2d. is due to said Portman for interest of several principal sums by him lent and advanced at 6 per cent. for one year beginning 1673, June 25, and 11l. 4s. 11d. more by making the interest principal at the end of every six months : thus making in the whole 762l. 18s. 1d. ; which is hereby to be paid out of the Excise : the present warrant being drawn upon the letters patent of July 23 last for two years interest to the goldsmiths. Oct. 15 Privy seal to permit John Ogilby to import, Customs free, 12,000 reams of royal paper : thus making with the privy seal of June 18 last 22,000 reams of paper to be imported by him, Customs free, within three years next ensuing : said Ogilby having originally petitioned for said 22,000 reams, but being only granted 10,000 reams, the other 12,000 reams being respited till the year following but it being since represented by said Ogilby that in regard the merchant who constantly served him with paper is dead and the many other privy seals of this kind supplying the rest he must be obliged to send over a particular factor to contract for his paper which will not answer the advantage the King intended for him unless he can treat for the whole 22,000 reams. Report to the King from Treasurer Danby on the petition of the Countess of Portland as by the order of reference of Sept. 14 last. The patent in question mentions a patent of Sept. 23, 19 Car. I., to James, Duke of Richmond and Lennox, for the shipping and lading all sorts of woollen cloths, &c., for 31 years at 100l. [per an.] rent, to be void for non-payment thereof at the days appointed : "and that your Majesty on the 20th day of May in the 13th year of your Majesty's reign, upon the humble request of Lodowick, Lord Aubigny, did grant the same unto the said Lord Aubigny and Benjamin Weston" for the same term and rent and to be void for non-payment ut supra. In this second grant your Majesty forgave and discharged all arrears of rent due upon the first grant. "This honourable petitioner humbly beseeches your Majesty to shew her the same grace and favour which your Majesty did to her brother the Lord Lodowic : that she may have a new grant for the same term of 31 years (18 years being unexpired of the petitioner's term in being) and that your Majesty will graciously please therein to remit all arrears of rent due upon the last patent, being 1,300l., with the pardon of all errors and miscarriages that may have been committed in the execution of the said patent : which being a single act of your Majesty's bounty and goodness I humbly submit to your Majesty's great wisdom." Treasury Danby to the Earl of Bath at Bideford. I am very sorry to see by your several letters to me, and those to you from the [tinners'] Convocation that the gentlemen there convened who are persons of quality should not be drawn to a sense of the King's and their country's interest. The King is well informed where the obstructions lie. It is not really the poor tinner's advantage which is intended by the demand of this unreasonable price but that there may be no [tin] farm at all, that thereby some persons may have the opportunity by supplying the tinners with money before the coinage to be (upon the matter) farmers themselves in despite of the King and pay nothing for it. This is visible : and the King, the whole country and the trade of this important commodity is abused by the interest of a few persons : and I do admire the gentlemen of the Convocation should not see it. But I have reason to believe they are deluded by being told that within 12 months' tin hath been sold for 4l. 2s. 0d. the hundredweight. This may be for some small parcel. But I am well assured the price current was not so. Yet because this is pretended it shall not lie as an objection for I will advise the King to give them more than they themselves even pretend they can make, although it will make my trouble the greater in the management of it. You may therefore divide the 10s. between the King and them and make the price 4l. 5s. 0d. the hundred stannary weight. By this generous proffer the Stannaries will be inexcusable if they continue refractory and force the King to look more narrowly into things than hitherto he has done. For they cannot suppose the King will let this important branch of the revenue lie dead any longer. By the next meeting of the Convocation I hope the Stannaries will have considered that they have put very hard terms upon His Majesty and after the result of that meeting if they do not agree I am commanded by the King that it is his pleasure this Convocation be dissolved. If they agree you may continue the Convocation. But before you return [to London] it is the King's pleasure that you give order that the Coinages are not [to be] more frequent nor otherwise than by their charter they ought to be. And to the end the King be not defrauded of his Coinage duty (which I perceive is all the profit some persons are willing he should have) by a practice now in use of casting tin into small bars and exporting it without the Coinage mark upon it, pretending it was coined in the block (which is not to be disproved, although not true, by which means the King will not only be deprived of his pre-emption but likewise of his Coinage duty, I am commanded by the King to direct the Customs officers to seize all tin whatsoever that has not the Coinage mark whether in blocks, bars, or any other form as forfeited by law. You may give public notice hereof by proclamation or otherwise. I am informed this practice is grown so general that some of those who use it pretend they thought it was allowed by law. After you have received the resolution of the Convocation on the above proposal you may return [to London] at your pleasure. Ibid, pp. 110-1.

North, Attorney General, to enter a nolle prosequi to the information in the Exchequer against Edward Brooke, master of the ship "Elizabeth and Francis," from St. Valery to Hull which stopped in Margate Road, and there declared eight or ten quarters of wheat which he desired to land for his own use (he and his father Robert Brooke, being inhabitants of said place) and landed same on verbal permission of the officers ; but his boat in which same was landed was seized by Anthony Aven, deputy searcher there, who exhibited said information against both Edward and Robert Brooke.
