Report to the King from Treasurer Danby on the petition of William Brerewood for a grant of the reversion of the place of Register of Seizures after William Culliford, present Register. Petitioner has for some time been employed as Register to the late Commissioners for examining the accounts of the 60,000l. for loyal and indigent officers and therein behaved with much diligence and faithfulness and never received any reward or payment for several necessaries provided for said service. He has also been employed for some years past as a clerk under the Clerk of the House of Commons. He deserves this favour. Ibid, p. 120.

Royal sign manuals to the Archbishop of Canterbury and the Archbishop of York severally. By the [Hearthmoney] Act for an additional revenue to the King it is provided that if the church wardens and overscers of the poor of any parish, together with the minister of the same, shall certify their belief that the house wherein any person doth inhabit is not of greater value than 20s. per an., and that the occupier does not inhabit any lands or tenements of their own of the value of 20s. per an., nor hath chattels to the value of 10l., that upon such certificate to the next Justices of the Peace when same is allowed by them the person in question shall not be returned by the constable or other officer and said house is thereby discharged of liability to pay Hearthmoney. We are informed that either through the ignorance of some persons in the law or by partiality and favour great number of undue certificates are from time to time signed in all places of the kingdom by ministers, vicars, curates, churchwardens and overseers for persons not qualified [entitled to exemption] as above : to the great diminishing of said revenue. You are forthwith to write to the Bishops of the several dioceses to strictly charge all ministers, vicars, curates and churchwardens to use all possible circumspection in the signing of any certificates and that they be well assured that persons certified for be qualified as above : and that they certify for no other. [?] Royal warrant to the Attorney General to prepare a great seal, in form recited in full (with frequent interlineations and amendments) of an indenture between the King of the one part, and George Dashwood, Peter Calvert, Samuel Vincent and Edmund Bostock. Farmers of the Excise and Additional Excise (as by the indenture of lease of 1673, July 15) of the other part, the said Farmers hereby covenanting that they will, during the whole term of their said farm pay into the hands of the Excise Commissioners the additional yearly rent of 20,000l. above the yearly rent of 530,000l., as by said indenture of 1673, July 15 : for the further security of said yearly rent of 530,000l. and 20,000l. they will advance to the King 65,000l. viz., 20,000l. by last day of July. 1674, 20,000l. by the last day of Aug., and 25,000l. by the last day of Sept. : failing the payment of said 65,000l. advance money, they will upon signification of the King's pleasure surrender their lease and pay all arrears of rent due at date of surrender (the King hereby covenanting that, notwithstanding such surrender, they may collect to their own use all Excise or arrears thereof due before such signification of the King's pleasure) : said 65,000l. to be repaid to said Farmers by 32,500l. to be defalked out of their rent for 1676, Lady Day quarter, and 32,500l. out of same for 1676. June 24 quarter, they deducting 6 per cent. for interest thereon meanwhile out of every quarter's rent till the actual repayment thereof : the Auditors of Imprests to cast up the amount of interest and principle to be so defalked upon said Farmers' accounts of their 2 last quarters : and the Lord Treasurer to allow such defalcations : if any of the present duties shall be taken away or diminished by Parliament the Farmers shall have abatement proportionable out of abovesaid 20,000l. per an. as the Lord Treasurer shall direct : such allowance to be made in 28 days after application made as allowances in the like cases are to be made by the indenture of 1673. July 15 : as the Act distributes the penalties between the King and informer and in most cases where a penalty is incurred the duty itself is lost and therefore by abovesaid indenture the King covenanted not to remit any penalties but that same should be levied by the Excise Commissioners and the King's share thereof paid to the Farmers who were therefore appointed Collectors of such King's share of penalties, they on their part covenanting to pay same into the Excise Office for the King's use, defalking the same out of rent payable by them, now the Farmers covenant to pay in all such penalties as above, and the King covenants upon their yearly accounts thereof to allow them out of their rents only the single duty by them lost with moderate charges for getting in said penalties ; whereas by articles between the Farmers and the Treasurers or Receivers of the Excise the former are to pay to the latter their daily receipts (reasonable charges excepted) to the value of the monthly and quarterly rents due from them ; now the Farmers covenant with the King to pay their daily receipts according to the said articles ; and if the rent due to be paid monthly by them be in arrear 40 days after the monthly day then they will lose the interest of 50,000l. of their advance money for that month and so long time after as it shall remain unpaid : and if the rent due to be paid quarterly be so in arrear that a third shall not be paid within 40 days after the quarter day, and the whole within 10 days before the next quarter then they shall lose the interest of the other 87,500l. of their advance money for that quarter and so long after as it shall remain unpaid : the Farmers covenant to permit the Sub-Commissioners of Excise or any other person the Lord Treasurer shall appoint in each county to inspect all their receipts, contracts, compositions and the vouchers returnable from time to time by gangers or any other officers and to take copies thereof : once every six weeks or two months the Farmers will transmit and deliver to the Comptroller of Excise an account of their receipts and all vouchers and accounts touching the revenue and what duty is charged upon persons and of all penalties received : the Farmers will from time to time submit themselves and their accounts touching receipts and payments and all matters relating to their farm to such control as the Lord Treasurer shall appoint, and perform all the Lord Treasurer's orders and directions : the Farmers will not upon any sub-lease or sub-farm of any part of their farm contract for or receive above three months' advance money where payment of the rent is to be made monthly, and not more than six months' advance money where any longer time than one month is given for payment of rent. Nov. 10 Warrant from Treasurer Danby to Edward Arden, Receiver General of the revenues of the Bishopric of Durham, to pay 300l. to Sir James Clavering, high sheriff of co. Durham, due to him for 1 years on the 200l. per an. granted by the King to the sheriffs of said county towards defraying the charges of their shrievalties. Nov. 11 The old Excise Farmers and Col. Birch are to attend in the morning [of this day] and their petition to be considered. The Collector and all parties concerned in the distress of a horse at Hammersmith for tax are to attend then also.

Nov. 11 Money warrant for 9l. 15s. 10d. to Henry Norris, for half a year on his fee and allowance as joiner of the privy lodgings. British Museum Additional MS. 28,076, p. 399.
Privy seal for 1,427l. 14s. 9d. for interest and gratuity to the New Farmers of Excise, for their advance money on their contract as follows, viz., 816l. 2s. 11d. for moneys lent and advanced to the Treasurer of the Navy, and to the Paymaster of the Guards, before the days of contract on which their 150,000l. was to be paid in the months of Oct. and Nov., 1673 : and 544l. 1s. 10d. for two thirds more thereon as reward : and 67l. 10s. 0d. for reward for 4,000l. by them lent and paid into the Exchequer, 1673, June 27. which was repaid to them, with 101l. 5s. 2d. as 6 per cent interest thereon on the 28 Nov. following : making in all 1,427l. 14s. 9d. Further, for 7,636l. 14s. 11d. for 6 per cent. interest, and 5,091l. 3s. 10d. for two thirds more as reward (making in all 12,727l. 19s. 9d.) as interest account upon their advance moneys of 150,000l. and 30,000l. to June 24 last : making a total interest in all of 14,155l. 14s. 6d. The Auditor's accounts of said interest to be entered of record with this privy seal because the dates of the several advances of said money are exactly expressed and contained in the said accounts. Same directing that the 30,000l. advanced in the months of May and June, 1673, by the new Farmers of the Excise shall be accompted as so much advanced in part of the 180,000l. agreed by them in their lease of 1673, July 15, to be advanced upon the rent of their farm, and so to be repaid by way of allowance of rent : and also for interest to be paid thereon as fully, &c., as if the tallies for said 30,000l. had been levied for so much by way of advance : all by reason that no part of the said 30,000l. "was indeed paid in the said month [of May, 1673], the payment thereof being for some days expended [sic for suspended], for that the said lease not being passed, tallies for moneys advanced upon the rent thereby to be reserved, which must necessarily have reference to the said lease, could not be levied ; which impediment was like to have obstructed payment of the whole 30,000l. . but that the said George Dashwood, Peter Calverd, Samuel Vincent and Edmond Bostock being ready and willing to accommodate our occasions, did consent to pay the said 30,000l by way of loan, so as provision might afterwards be made for the allowing and right applying thereof, [and] did accordingly pay the same into our Receipt of Exchequer," viz., 20,000l. on 1673, June 4, and 10,000l. on June 7. Nov. 12 Treasurer Danby's appointment and authorization of Sir Richard Ford, John Gregory and John Bancks, merchants, with the assistance of Roger Twisden or his deputy, to examine what moneys have at any time been paid or imprested from the Office of the Navy or otherwise, to Sir William Warren from 1664, July 21, to 1667-8, Feb. 24, or at any time before or since, and how far such moneys have been complied with and ought to be discharged and cleared, and to prepare a state of the whole matter : very great sums having been imprested to said Warren for naval stores and provisions, which imprests are yet standing out "and as I am informed considerable sums of money are thereupon remaining due to His Majesty :" and to act similarly also as to the moneys imprested to Edward Deering, of London, merchant, on the like occasion. Nov. 13 Constitution by Treasurer Danby of Richard Kent to be Receiver General and Cashier of Excise in place of Sir John James, Robert Huntington and Richard Kingdon, who were by Treasury warrant of 1671-2, Jan. 23 (based upon the privy seal of 1671-2, Jan. 16), appointed to receive the said revenue. Said Kent is to pay his moneys from time to time into the Receipt of the Exchequer and said James, Huntington and Kingdon are to pay to said Kent all such moneys in their hands. Ibid, p. 124.
Warrant from same to the Customs Commissioners to allow to the owners of the ships "Phoenix" and "East India Merchant," in the East India Company's service the twentieth part of the Customs of the first two voyages out and home : being two-decked ships of 400 tuns each, carrying 30 pieces of ordnance and capable if in the King's service of carrying 46 guns, being built under the encouragement of the Act 14 Car. II., but finished and launched after the expiry of the said Act and before the commencement of the second like Act of 22 and 23 Car. II., for encouraging such ship building. Ibid, pp 125-6.
Treasurer Danby to same to employ Jonathan Herrick as tidewaiter in ordinary, London port, on the next vacancy ; and meanwhile to employ him as an extraordinary tide waiter. Ibid, p. 126.
Warrant from same to Sir Joseph Seymour, Auditor of Crown revenues for co. Cumberland, to discharge Sir Wilfrid Lawson from making any accompt for several rents in co. Cumberland, which he purchased of the late usurped powers, being due and payable at Michaelmas, 1660, for which he had an order from Sir Charles Harbord to receive upon security as other persons had, who (most or all of them except himself) have been long since discharged of the said rents by virtue of the King's commission of grace, as might the petitioner if he had applied himself in time : it being certified by Thomas Raban, deputy to said Seymour, that said Lawson had delivered into said Seymour's office a schedule of such of said rents as yet remain in the tenants' hands unreceived to the end process might issue for recovery thereof, and had also delivered up his deed whereby he did purchase such rents. Process is hereby to go out against such tenants as above. Ibid, p. 127.
Same from same to Symon Smyth, Receiver General of Crown Revenues, co. Southampton, as follows. The Trustees for Fee Farms by their order of June 22 last (reciting that a contract was made with them by George, Bishop of Winchester, 1671, June 30, for the purchase of a fee farm rent of 32l. 18s. 6d., reserved by letters patent of 12 July, 35 Hy. VIII., out of the manor of Moundesmere and Stubbington, and other lands in Southampton, granted to the Warden and Fellows of Winchester College, the purchase money thereof at 16 years' purchase amounting to 526l. 16s. 0d., which was accordingly paid into the Exchequer amongst other moneys (2,423l. 2s. 0d. in all) payable by virtue of said contract, as appears by a tally levied there 1671, July 18 : and reciting further that said bishop had since regranted said rent of 32l. 18s. 6d. to said Trustees for the King's use, whereby said rent and all arrears thereon are become due to said Trustees), have ordered that all arrears of said rent since the said contract be forthwith paid by said Warden and Fellows to said Symon Smyth, and that the Lord Treasurer be prayed to warrant him to pay same (between the date of said tally and said re-grant) to said bishop as due to him by virtue of said contract. Said Symon Smyth is hereby required to so pay said (interim) arrears. Ibid, pp. 128-9.

Warrant from Treasurer Danby to the Customs Commissioners and Cashier to make payment or abatement to John, Lord Berkeley et al. the owner of the ship "Massingbird" (being a ship of force of three decks flush built upon encouragement of the Acts of Parliament for building such ships) of 10 per cent. on the Customs in and out of her first two voyages, the order in Council of 1672-3, Feb. 7, having ordered said abatement though said ship was built in the intervals of those Acts : the said ship being of equal advantage to the King's service as those built within the time of said Acts : upon which order of Council the late Treasury Lords ordered such allowance and abatement accordingly by their order of 1672-3, Oct. 13 : but the said owners have yet received no money for her first voyage outwards nor for her second voyage outward and inward. Instructions from Treasurer Danby to the Customs Commissioners, made upon their representation of the 9th inst. As to the case of Mr. Braydon, who inadvisedly housed 29 hogsheads of tobacco before a view thereof (and subsequently prayed a view thereof to be made by the proper officers in order to an allowance for damage, which you, the said Commissioners, cannot grant according to your rules, said tobacco being out of the King's custody) you may make a view and allow for damage, as you are satisfied there is no alteration of the tobacco or other fraud. As to the officers of Southampton port, who irregularly permitted Mr. Stanley, a merchant of that port, to take into his own custody a quantity of tobacco by him imported, intending to take a view in order to an allowance for damage when the whole was landed, I direct that a view be made and damage allowed for. As to the case of Mr. Carew, of Bristol, concerning the seizure of cattle and sheep, and the vessel wherein they were imported, if Carew has acted according to law, and the parties concerned in said ship continue to molest him, he is to be defended at the King's cost. Warrant from Treasurer Danby to the Customs Commissioners to permit James Burkin et al. (for whom certain Italian merchants their correspondents laded several silks, &c., for Cadiz on board the King's frigate the "Advice," then upon a voyage from Turkey to Messina and Leghorn, which said frigate arriving at Malaga and Tangier was there denied prattick and therefore brought said goods to Portsmouth, some thereof being contraband and not vendible in this kingdom) to relade said goods for Cadiz, they paying the Customs due at importation and drawing back half subsidy and additional duty. Same from same to same to pass a debenture to William Goulston, who heretofore shipped by sufferance a parcel of linen bought of one Mr. Farrington, which he exported on account of the Royal Africa Company but without regular certificate at the time by reason of dispute betwen said Goulston and said Farrington, but they being now agreed and oath made in due form it is prayed that a debenture may be passed upon certificate, "but its alleadged that the officers of the Customs cannot regularly pass a debenture because the certificate was not passed within the year, without a speciall warrant although in truth the goods were shipped in due time." Same from same to same to discharge a seizure of a parcel of stuffs called Durnace, imported by Benjamin Cox, it appearing by the invoice, which is in Dutch, that the said commodity is expressed to be "mitt Gares," which does indifferently signify yarn either of silk or thread ; this being Cox's first transaction in that commodity and he being ignorant of the difference between one and to ther. Same from same to discharge a seizure of the "England" frigate, a merchantman of London, Robert Bosse late commander, which was taken off the island of Scilia by a Dutch caper and carried into Naples, where she was condemned as free prize and afterwards re-bought by said Bosse, who was forced to make use of five strangers as he had not English enough to navigate her. whereupon said ship is seized in the river, the said ship having imported oils, which is one of the enumerated commodities. It appears that the late Treasurer Clifford did promise to the present Receivers General of the Eighteen Months' tax a salary and allowance of 1d. in the for their receipt more than is mentioned in the Act of Parliament, being for the labours of their deputies in getting in said assessment, said Receivers being answerable for said deputies, which said salary of 1d. in the was intended to be allowed by the Parliament, but was by some mistake omitted in the Act. Warrant from Treasurer Danby to the Receipt. By the great seal of 1672, Oct. 7, the several orders therein certified by Sir R. In which your report you also inform me that it is affirmed to you by the traders of those parts that the seals whereof this oil is made are not fished or taken in the sea, nor any shipping is or can be employed in the taking thereof, but are killed upon the shore or ice when they go on shore to sleep by the natives or inhabitants of the place at any time when the English cannot reside there, and that the oil thereof made and sold by the natives in barter for English woollen manufactures or other commodities of this kingdom is a commodity of great use in perfecting of manufactures of leather and that the parcel in question being 14 tuns or thereabouts is imported from thence in English shipping navigated according to law and that the real value thereof exceeds not 14l. per tun." You are also to permit the like importation under the like Custom rate of 6s. per tun of all such oil for the future as shall be brought over in English built ships and navigated according to law and sworn to be that sort of oil and no other : all notwithstanding the seeming prohibition in the said Act of 25 Car. At the last coinage at Truro, William Hooker, of London, merchant, bought a parcel of tin value 700l., containing 64 blocks or thereabouts : all which tin was first coined in the tinner's name and the coinage stamp [stamped] thereon and the duty paid, but was seized by Nicholas Saunders on pretence that it was brought out of the proper stannary before being coined, said Saunders well knowing that tin is not seizable if under the stamp, and so hath maliciously made said seizure without any ground. Same from same to Sir Edmund Sawyer, Auditor of Crown revenues for Kent, Oxford and Berks. Sir John Banks petitioned concerning several fee farm rents by him and his assigns purchased of the Trustees for Fee Farms lying in Kent, Oxford and Berks, complaining that you refuse to put them out of charge to the value of 100l. per an. Hereupon the said Trustees have reported (1) that if any rents of assize, parcel of any manor or reputed manor be passed, the same was certified to them by the Auditor amongst the saleable rents or else they had not been sold, and [they] believe they will never be questioned, the purchasers having paid full value for them, and have equity for their purchase money in case they should be questioned ; (2) touching rents paid by parsons and vicars in the name of pensions they conceive them to be comprehended in the words 'dry rents and other rents within the survey of the Exchequer and Duchy of Lancaster,' and were certified by the Auditor and are well sold ; (3) lastly touching rents charged before the Auditor under the title of firma, having stood so in charge above 100 years without any increase or improvement, they conceive there is little hopes to recover the lands or improve or increase the rents and therefore conceive them to be no better than dry rents and so are as well sold as any other in the Auditors' certificates. You are therefore hereby to put the said rents so purchased out of charge in the said counties as they stand charged before you. Ibid, pp 149-50.

Harbord's report hereon to the late Treasurer Clifford, petitioner has an estate in Shaw farm, Berks, at the rent of 23l. 7s. 0d. per an., which will expire 1699, Sept. 29. The said estate is worth to him 275l. 6s. 4d. per an. Therefore a fine of 700l. would be reasonable for a further 31 years' reversionary estate therein. Ibid.

Warrant from Treasurer Danby to the Commissioners of the Navy. Upon a letter from the Commissioners of the Admiralty of Sept. 16 last, recommending to me by the King's command the case of some pursers of the ships who are creditors on their victualling accounts to the value of 11,089l. 10s. 10d., and of the flag officers and captains of the first and second-rate ships who have pensions allowed them during the peace, that some provision may be made for satisfying said charges, I consider it will be most regular to cause all bills for the balances of pursers' victualling accompts already made out and signed by you or hereafter to be so made out and signed, to be paid in the course as they stand registered on the lists which you are appointed to keep for payments in course [and] under the proper head to which same belong. And [so likewise] for the said pensions [to be similarly registered and so paid in course] under the head of salaries and pensions. You are hereby warranted to so pay them out of any money imprested to the Treasurer of the Navy for the establishment of the Navy. Ibid, p. 396.
