ORDERED, That all Committees which are discontinued, be revived; and do sit this Afternoon, in the Places formerly appointed.

Earl of Warwick's Estate.

Sir Charles Harbord reports from the Committee to whom the Bill for enabling Mary Countess Dowager of Warwick to perform the last Will of Charles late Earl of Warwick, deceased, was committed, that the Committee had met, and summoned, and heard, all Persons concerned, who had consented to the Bill; and that, upon Perusal of the Bill, they find no Cause to make any Alteration in it.

Resolved, &c. That the said Bill be ingrossed.

Privilege.

Information being given to this House, That one Thomas Kirkby, menial Servant of Mr. Robert Spencer, a Member of this House, was arrested, and detained in Custody, by one Peter Brailesford a Serjeant, and Clement Barber his Yeoman, belonging to the Poultry Compter, London, and refused to release him, though demanded by Mr. Spencer himself;

Ordered, That Mr. Speaker do issue out his Warrant for the Discharge of Thomas Kirkby, Servant to Mr. Spencer, from his Imprisonment.

Ordered, That the Matter of the Contempt of Weaver the Solicitor, and the said Brailesford and Barber, the Serjeant and Yeoman, in arresting Thomas Kirkby, Servant to Mr. Spencer, and detaining him in Custody, when they had Notice of his being Mr. Spencer's Servant, be referred to the Committee of Privileges; to examine the Matter; and report the same, with their Opinions therein, to the House.

Darwent Navigation.

A Bill for making the River Darwent in the County of Derby navigable, was read the Second time.

Resolved, &c. That this Bill be committed to Sir Francis Compton, Mr. Sacheverell, Colonel Gray, Sir Trevor Williams, Mr. Powle, Sir Coppleston Bampfeild, Sir Anthony Irby, Sir Robert Barnham, Colonel Gilby, Lord Digby, Mr. Stockdale, Sir John Mallett, Sir John Knight, Sir Edward Hungerford, Sir John Cotton, Lord Allington, Mr. Gray, Mr. Williams, Sir Richard Powell, Sir John Coriton, Mr. Marvell, Sir Cha. Privilege- Petition from a person in the Tower.

A Petition of Mr. Thomas Howard, now Prisoner in the Tower, for a Breach of the Privilege of this House, was tendered; acknowledging his being sensible of his Breach of Privilege; and praying his Discharge;

But the Petition being not signed, by reason of his Incapacity to do it by Sickness, the Lord Morpeth, who delivered the Petition, asserted, that he received the Petition of Mr. Howard; and that he did own it, and would have subscribed it, if he had been able; and desired it might be tendered in his Name.

And the Petition being read;

Resolved, &c. That Mr. Howard be discharged from his Imprisonment in the Tower: And that Mr. Speaker do issue his Warrant to the Constable of the Tower, or his Deputy, for his Discharge.

Mr. Speaker to settle Differences.

Ordered, That the Lord Cavendish, Sir Tho. Meres, and Mr. Howard, do attend Mr. Speaker; who is desired to accommodate the Differences between them, if he can; and to report the same to the House.

Assault on de Luzancy, &c.

Information being given to the House, of a very high Insolence and Violence committed upon Mr. de Luzancy, a Convert of the Protestant Religion, by one St. German a Jesuit, and others, his Confederates; and a Narrative in Writing being tendered, and read, giving a particular Account of the whole Matter;

Resolved, &c. That a Committee be appointed to take the said Narrative, now read, into Consideration; and to examine the Matter; and report it, with their Opinions, to the House And also to consider of such Ways and Means as they shall find necessary for securing and encouraging of Converts to the Protestant Religion; and to bring in a Bill to that Purpose: And also to examine, what Priests or Jesuits have been of late Years committed or convicted; and by what Warrants, and by whom procured, they have been released, reprieved, or pardoned; and to report the whole Matter to the House, with their Opinions therein: And it is referred to Lord Cavendish, Sir Edward Deering, Mr. Stockdale, Sir Wm. Coventrey, Sir Cha. Harbord, Sir Tho. Meres, Sir John Hotham, Mr. Crowch, Sir Hen. Lord Chief Justice to issue a Warrant.

Resolved, &c. That the Lord Chief Justice of England be desired forthwith to issue his Warrant for the apprehending St. German the Jesuit, and his Confederates; and for searching for, and apprehending, all Priests and Jesuits whatsoever.

Papists not to sit in Parliament.

An ingrossed Bill to hinder Papists from sitting in either House of Parliament, was read the Third time.

Resolved, Nemine contradicente, That this Bill do pass: And that the Title be, An Act for hindering Popish Recusants to sit in either House of Parliament.

Ordered, That Sir John Trevor do carry up the Bill to the Lords for their Concurrence: And that he do, at the same time, remind their Lordships of the Vote of this House for recalling of his Majesty's Subjects out of the French King's Service; to which their Lordships Concurrence was desired.

Call of the House.

Ordered, That the House be called over this Day Sevennight; and as to such as shall be Defaulters, whose Excuses are not allowed, the like Letters be sent to compel their Attendance, as was sent the last Sessions.

Resolved, &c. That this House will now resolve into a Committee of the whole House, to consider of the Way of raising the Supply, not exceeding the Sum of Three hundred Thousand Pounds.

That the Supply, not exceeding the Sum of Three hundred thousand Pounds, be raised by a Land Tax, and Monthly Assessment.

Resolved, &c. That the said Supply shall be raised by Eighteen Months Assessment; according to the Proportion of Seventeen thousand Two hundred and Four Pounds Seventeen Shillings and Three-pence, by the Month, to be paid by Quarterly Payments.

The said Resolves were again read.

And the First Resolve, being read a Second time at the Clerk's Table, was, upon the Question, agreed.
