1 Aug. R. O.	365. Thos. Strangways to Cromwell. I pray you, be the means to the King to finish this hospital of Jesus Christ at Branforth, which I have begun, and intend to go forward with. If he will bear the charges of finishing it, and endow it with lands, I will clearly release my long suit for 700l., which you and Sir Will. Gascone concluded should have been paid me by my lord Cardinal, whose soul Jesu pardon. I shall also consider myself to be well paid for my costs in bringing up to London and long keeping of my lady Margaret, daughter to the queen of Scots, and for all my service in the King's wars in France, Scotland, and other places. I only desire that some honest man may be appointed to it. I intend to spend the rest of my days therein. 1 Aug. I have sent you a token of such things as I have newly "putyd (?)" in my house for the furtherance of the said hospital of Jesu Christ. Hol., pp. 2. Add. : Of the King's council.
8 Aug. Mon. atican, 75.	366. Campeggio to Salviati. * You will learn by the accompanying letters of the baron [del Burgo] the state of the queen of England's cause. She has sent a new messenger, and writes to his Majesty complaining of the delay of justice, saying she would sooner die than that the cause should be determined anywhere but at Rome. I think his Holiness will have seen the book they have printed, with the decisions of the universities against the authority of the Holy See. I think this should not be allowed, and that it behoves as much his Holiness as the Queen to prevent the authority of the See being thus set aside. No reasons are alleged for these opinions, and some good divine and lawyer should be got to answer them. Brussels, 8 Aug. 1531. Ital.
9 Aug. R. O.	367. Sir Thos. Wharton to Cromwell. Cannot render him thanks for his constant goodness, but hopes Cromwell will always command his service. Requests that he will not be against him in the causes about which William Stapleton will attend upon him, having regard to the King's letter, of which he sends copies, with a copy to the same effect from my lady Anne. Cromwell's letter has been to his hindrance. Is impelled to write by "the necessity of the tithes for my poor house there, as I intend to lie with the former occupation of my predecessors at the castle of Cockermouth." Had the same in occupation last year, with a promise to have leave for more years. Cromwell's advancement of the King's chaplain is much spoken of in the North, and greatly to his honor. York, 9 Aug. 10 Aug. R. O.	368. Brian and Fox to Benet. Since the despatch of your last letters by Thaddeus, we have received yours of 14 July, acknowledging ours of 26 May, and showing the cause of the resolution taken between the French ambassador and you, why the King's letters should not be delivered to the Pope; and referring further to yours of the 22nd June, which never reached us, nor yet your memorial of grievances. As to the saying of the bishop of Bayonne to Edw. Foxe, shown by you to the duke of Albany, it is superfluous to say more than we wrote in our last letters. And though I, Edw. Foxe, fearing the said Bishop had spoken of some affection and not of truth, was content to take the fault upon myself, writing to you that my memory failed, "making myself a liar in that point," I beg, if the Duke return to the subject, to make no such excuse for me, but plainly assert that the Bishop said so, for the Bishop will stand to it. "And the King hath sa[id for] his purgation that he commanded the said Bishop so to say unto me, albeit, in our opinion, it shall be great folly further to trouble any party for that matter," as we wrote in our last. Since our last, we have obtained letters from the French king to the Pope, and also to his ambassadors there, with instructions to demand the three articles enclosed, "with effectual suit for obtaining of the same by degrees," and to have an answer without delay. We have said nothing here of the other articles in the King's letter sent you by Thaddeus, because his pleasure was that you should move them to the Pope as of yourself, without showing that the King wanted them. You must, therefore, use all dexterity to cause the French ambassadors to set forth those three points with all diligence. We send also an answer made by the Queen's counsel at Rome to the information given by Dr. Kerne for the King's defence, and an answer made by Mr. Secretary to the said allegations, which has been much praised by the learned here, and which the King has commanded us to send to you. By the next messenger we shall send you a determination of the canonists here, and a book made by the learned men in justification thereof. They are not yet perfected as we would, but will be finished in eight days. Paris, 10 Aug. "Sir, it may like you to solicit the Pope [to] cause the French king's ambassadors to do sh ... that the Pope will make one determinate [end] and resolution what he will do in these ar[ticles, to] the intent ye may disciphre the Pope, incontine[ntly], and not to suffer him longer to hang in th[is] neutrality," and further to get the Pope to make a promise to the French [king and] our master that he shall not interrupt nor revoke the examination and judgment to be done in England in the King's cause. 12 Aug. R. O. St. P. VII. 316.	369. Benet to Henry VIII. The post arrived here on the 9th from Lyons with letters to Albany announcing the coming of the French ambassador (Dinteville). His coming may possibly further such things as you wrote of in cipher, as we cannot prevail in any. The Pope says he cannot defer the process for an hour after the beginning of October. I asked him if he had made any promise to Grammont not to give sentence against you for 20 years. He denied it, observing that he might have said that if you sent a mandate ad totam causam, it would occasion so many delays that sentence could not be given in ten years or longer. He showed me the Emperor's letter, in reply to his proposition for the cause to be committed to an indifferent place, of which I wrote on the 7th June ultimo. To this the Emperor would not consent, and urged that there should be no longer delay. On the 10th the Pope said to Worcester, Gregory, and me, that he had received a letter from his Ambassador, of the 17th, affirming that the Queen complained of the Pope's delay, and that she cannot have justice from him. He says he is the most disgraciate person living, as both parties complain of him. The Queen's agents wish for a "derogation of the feris" (holidays), insomuch that on the 25th ult. we were cited to show why the commission should not be granted. We send a copy of the citation and commission in our next. I think the Pope will not grant it. In the matter excusatory he will not depart from law and justice for any man living. What his Holiness has done to know whether the matter be relevant or not, you will perceive by our common letter; and by my next you will learn what I have done apart with the Pope, and his answer to your letter in cipher. Does not expect anything but mere justice, and there are now only 50 days to the first audience. 12 Aug. 1531. Draft, in Benet's hand.

13 Aug. R. O.	371. H. Earl Of Northumberland to Cromwell. Thanks him for his manifold kindness. Appeals to him in great perplexity, as his only earthly joy and comfort is in the King's favour. As he wrote from Roston, not only the judges, who were nevertheless very indifferent, but the sheriff and quest impanelled, had such letters from the King and the Master of the Wards, "with such labours in his Highness' name, that fearing the right by them not to be indifferently handled, was non suit," although the right of his inheritance was evident, as the bearer, his attorney, can show.
