Bedells Naturalization Bill.
The Earl of Derby reported from the Committee, the Bill for naturalizing of Bedell's Children, as fit to pass, with a small Alteration; which, being read Twice, was Agreed to, and ordered to be ingrossed.
E. of Arundel's Bill.
The Messengers sent Yesterday to the House of Commons return with this Answer:
That they have delivered to them the Bill concerning the Earl of Arrundell to be restored to the Dukedom of Norff.
Bill to prevent the planting Tobacco in England.
Hodie 1a vice lecta est Billa, "An Act for prohibiting the planting of Tobacco within the Kingdom of England."
Message to H. C. with Bills.
A Message was sent to the House of Commons, by Doctor Bennett and Doctor Lewin;
To deliver to them Two Bills, and desire their Concurrence therein:
A Bill for naturalizing Francis Astley, the Son of the Lord Asteley.
2 A Bill for naturalizing Renee Sabran.
Bill for Arrears of Assessments.
Hodie 2a vice lecta est Billa, "An Act for the levying of the Arrears of the Twelve Months Assessment commencing the 24th of June 1659, and the Six Months Assessment commencing the 25th of December 1659."
ORDERED, That the Consideration of this Bill be (fn. 2) considered of by these Lords following:
Their Lordships, or any Five; to meet on Monday Morning next, at Nine a Clock, in the Prince's Lodgings.
E. of Sterling versus Levingston.
The House taking into Consideration the Cause depending, of the Earl of Sterling and others Plaintiffs, against Levingston and his Wife and others Defendants; complaining of a Fine that was alledged to be procured from the Lady Powell, Wife of Sir Edward Powell Knight, deceased, by Force and Fraud:
Then the House commanded the Judges to deliver their Opinions therein in Point of Law, and in Relation to the Act of Indemnity, and Act of Judicial Proceedings.
The Lord Chief Justice of the King's Bench delivered it, as his Opinion, and all the rest of the Judges, to be, "That they do not find, by any Record or Precedent in their Law Books, of any Five which hath been perfected, that hath been vacated for Fraud or Force, in Parliament or any other Place; and that the Act of Oblivion pardons all Crimes, but the Interest of the Parties stands good and valid as before the Act was made."
And after a long and serious Debate and Consideration of the Business;
This Question was put, "Whether this Fine was obtained by Force?"
And it was Resolved in the Affirmative.
ORDERED, That the further Consideration of this Business shall be (fn. 3) taken up on Monday Morning next.
