William Hopton of Bishop's Frome, co. Hereford, esq v Raphael Heywood of Acton Beauchamp, co. Worcester

November 1638 - January 1639

Abstract

The nature of Hopton's complaint against Heywood is unknown, but Heywood's answer refuted the libel and denied Hopton's gentility. Dr Duck entered the libel on 5 December 1638; but on 28 January 1639 both parties accepted a negotiated settlement.

Summary of proceedings

Dr Duck acted as counsel for Hopton and Dr Lewin for Heywood. Dr Duck gave the libel on Hopton's behalf on 5 December 1638, and Dr Lewin was required to respond on Heywood's behalf in the following weeks. On 28 January 1639 a negotiated settlement was acknowledged by the counsels Dr Duck and Dr Lewin.

Notes

William Hopton of Bishop's Frome, esq, was the eldest son of Sir Richard Hopton of Canon Frome, co. Hereford and Elizabeth, daughter of John Hopton of Hopton, co. Salop. William married Elizabeth, daughter of William Foxall of co. Salop, and their eldest son had been born around 1625.
