Francis Nicholls of Halstead, co. Leicester, gent v Thomas Groves of Brampton, co. Derby

May - November 1640

Abstract

The cause of Nicholls's case against Groves remains unknown as only the bonds survive. Dr Hart gave the libel on 30 October 1640 and Dr Merrick responded on 20 November. The case was probably lost with the suspension of the court's proceedings in December 1640.

Groves was 'now or late of the town of North[ampton]'

To 'appear in the court in the Painted Chamber within the Pallace of Westminster'.

Thomas Knighton of Hanging Houghton, co. Northampton, gent, was acting for Nicholls.

Signed by Thomas Knighton.

Sealed, subscribed and delivered in the presence of John Watson.

15 September 1640

Bond to 'appear in the Court in the Painted Chamber within the Pallace of Westminster'.

Signed by Thomas Groves.

Sealed and delivered in the presence of John Rainshaw, notary public.

Summary of proceedings

Dr Hart acted as counsel for Nicholls and Dr Merrick for Greaves. Dr Hart gave the libel on 30 October 1640 and Dr Merrick responded on 20 November 1640. Dr Hart had until the first session of the following term to prove the libel.

Neither party appeared in the 1662-4 Visitation of Derbyshire: G. D. Squibb (ed.), The Visitation of Derbyshire, 1662-1664 (Publications of the Harleian Society, new series, 8, 1989).

A Francis Nicolls of Hardwick and Faxton, esq, was mentioned in the 1619 Visitation of Leicester as the son of Francis Nicolls of Hardwick, co. Northampton and Anne, daughter of David Seymour.
