Whereas lately, before Henry Spigurnel and his fellows, justices in eyre in the Islands of Gernereye, Gereseye, Serk and Aureneye, the king sued the following persons severally for parts of the lands in Gernereye late of Master William de Sancto Remigio, viz. Thomas de Estfeld and Alice his wife, Denis le Marchaunt and Petronilla his wife, John le Moigne, Ralph le Moigne, which the said William held of Edward I and which ought to have reverted to the king as escheats for a felony for which he abjured the Islands ; and whereas the said persons said that the said William died seized thereof and that they entered the same after his death as his kinsmen and heirs ; and also that Edward I having pardoned the said abjuration and having restored to the said William his lands and goods which had been taken into his hands, but that in the time of the war in the said Islands the pardon was burnt for which reason they vouched to warranty the rolls of the Chancery of Edward I ; but because they did not show any special deed (speciale factum) of pardon before the said justices, the said lands were taken into the king's hands, as appears by the record of the said justices returned to the Chancery ; whereupon the said tenants by their petition before the king and Council have prayed for a remedy ; and whereas by inspection of the rolls of the Chancery of Edward I, it is shown that 14 July, 22 Edward I, he pardoned the abjuration which the said William made before Thomas de Sandewyco, formerly inquisitor in the said Islands of the trespasses of the said William, and commanded Henry de Cobeham, warden of the said Islands, to restore to the said William all the lands with the issues thereof which had been taken into the hands of Edward I :—the king, although the said abjuration was made for felony, and the said pardon makes mention that it was given for trespasses and not for felony, so that it is insufficient, nevertheless, of his grace, and especially as abjuration of the said Islands ought not and is not accustomed to be made except for felony, grants that the said tenants keep their lands in the same manner and under the same conditions as before their caption, and that the said pardon be of the same force as though it had made mention that the abjuration had been made for felony.
