June 8. Newcastle-upon-Tyne.

Inspeximus of the record and process of a plea between Edward II. and the prior of Worcester. Pleas before the king at York, Wygan, Nottingham, Derby and Tottebury, of Michaelmas Term, 17 Edward II. The king, by writ, commanded the prior and convent of Worcester to grant to Alice Conane, for service to queen Isabella, such sustenance in their house as Peter de Avyler, deceased, had had at his request, or to signify to him wherefore they had not obeyed his request for this many times repeated, and the prior and convent answered that owing to the badness of the times they were too poor to do this. This reason being insufficient, the king commands the prior to grant the sustenance or else to be before him on the morrow of All Souls to shew cause wherefore he disobeyed so many commands; witness the king at Skipton in Cravene, 1 October, 17 Edward II. At which day, comes the prior in person and answers that he and his predecessors time out of mind have held in frank almoin, so that the priory was never charged with any sustenance until the king nine years ago charged it with that of Peter de Avyler. And the prior is asked to shew his royal charters herein, and he says that he has not these ready at present. And no one comes for the said Alice to inform the king in the premises. Therefore, day is given until a fortnight after Hilary, at which day come Adam Fyncham, who follows for the king, and the prior, by his attorney: and Adam says that, immediately before the reception of the said Peter, the prior received Nicholas Renty in his house for sustenance, and before him one John le Barber had been admitted, at the king's command. And the prior acknowledged this: he says also that Edgar, sometime king of England, progenitor of the king that now is, by charter granted to the prior and monks certain immunities in these words, All things that they had possessed from their chucrh, with the church itself, whether ecclesiastical or secular, movable or immovable, I give and seal to the monks, the servants of God, from this day for ever, to possess from henceforth in right of our royal munificence so firmly that it shall not be right or lawful for any prince or bishop hereafter to withdraw or invade any as long as the Christian faith shall endure, and I give half a hundred, which is called in English 'Cudbrigelawe hundred,' to which lie 50 hides of land in Creppeston given by Offa, king of Mercia to the household (familie) in Worcester free of all royal exaction, to the servants of God with the same liberty. Further, to complete the hundred I grant that they shall of my gift hold the lands of their church, which were hitherto subject to royal exaction from this day for ever quit thereof, to wit, those beyond the river Avene, named by these words, Unere Bredon, with Pendok, Todyngton with Mitton, Seggesbarwe and in the hill of Wutista, Northw[ich] and Wenland, Deykglegford and Dorene and Jokumbe, and on the bank of the river Sture Sepeston, and there by it Blakwell, and on the west part of the Severn, Grymel with Whytleye and Ouythtwyk, Thallawe with its appurtenances, and Herfordton by Avene, I give these to God and to the holy mother of God, Mary, to the use of his servants, the monks, quit of all secular charges and exactions except the making of bridge and citadel (arcis) and going forth against an enemy. This charter, which the king that now is has inspected and confirmed the prior produces in court and it testifies this. And he says that his priory is within the hundred and is quit of sustenances. And the said Adam says that the prior at another time in answering before the king alleged that he held the priory in frank almoin quit of secular service and in the charter of king Edgar which he now produces it is not contained that the prior or the monks hold their lands in frank almoin, wherefore he prays judgement for the king. Whereupon day is given to the prior to the octave of the Purification. At which day come the said Adam, and the prior likewise, and day is given to him until three weeks of Easter; at which day the prior in discharge of the sustenance says that the king that now is at another time at York desiring to amend the estate of the church, granted for him and his heirs that some answers to petitions exhibited before him by the bishops should be observed inviolably, in which petitions it is contained, also it is prayed that the king and magnates of the realm will not unduly charge religious houses or ecclesiastical persons for corrodies, pensions, etc., to their impoverishment, and the answer is that they shall not, as by letters patent, dated 24 November, 10 Edward II., appears, whereupon it is asked of the said Adam if he has any information herein for the king other than he said before, and he says that he has not at present; and judgement is given for the prior, saving the right of the king to imparl therein if he will. By C.
