Testification at the request of the prior and convent of St. Martin's, Dover, of the tenor of a record and process before the barons of the Exchequer as follows. Records before the barons of the Exchequer of Trinity Term, 34 Edward I. Kent to wit. The king, by writ dated 10 May in his thirtyfourth year, commanded the treasurer and barons of the Exchequer in these words. On the part of the prior and convent of St. Martin's, Dover, it has been shewn to us that although by charters of former kings, lately carried away by Frenchmen in a conflict with Englishmen at Dover, they have used to have a moiety of the issues of the port of Dover and a third part of the toll arising from the Saturday market at Dover, you nevertheless have begun to disturb them in the receipt thereof and unjustly charge Robert de Burgherssh, warden of the Cinque Ports, in his account of the issues of his bailiwick, with the said moiety and third part as well as with the residue of these which belong to us. And for the relief of the said prior and convent and Robert, we command you that, if by inspection of books or memoranda of the Exchequer or by inquisition it should appear that the prior and convent have used to have the same, you desist from disturbing them and discharge the account of Robert herein. Whereupon, on a search of books and memoranda there has been found in the Red Book a certificate of the port of Dover containing inter alia that of the toll of those crossing the sea at Dover the prior of St. Martin's receives half, and of the toll of the said market he receives a third part. And the prior upon this says that his predecessors have had the same time out of mind but the charters hereof were carried away by the French as he will prove. And on consideration of the matter by the treasurer and barons, it is held that the prior's claim is not sufficiently established in the said book, and William de Carleton and Roger de Hegham, barons, are appointed to take an inquisition herein. Afterwards, on Thursday the feast of St. Peter and St. Paul, an inquisition was taken at Greenwich before William de Carleton, which he delivered here at the octave of St. John the Baptist, whereby it was found that king Henry I. by charter, granted to the prior and convent of St. Martin's, Dover, and their successors, the said moiety and third part, and that from that time the prior and convent have used to receive these, and that, in the beginning of the war lately commenced between the king that now is and the king of France, certain enemies from beyond the seas landed at Dover and plundered the priory, carrying away the said charter with other goods, and that this the jurors of the inquisition know for certain because some of them have sometimes seen the charter. Therefore it is adjudged that the prior and convent shall have the moiety of the issues of the port and the third part of the toll arising from the Saturday market without any hindrance, and Robert de Burghash, constable of Dover Castle and warden of the Cinque Ports, is to permit them to take these.
