Presentation of Wibert de Kancia to the church of Adberbury, in the king's gift by reason of the voidance of the bishopric of Winchester; directed to the bishop of Lincoln.

The like of William de Sancto Gorono to the church of Stoke, in the king's gift for the same reason; directed to the archbishop of Canterbury.

This letter was duplicated.

Nov. 23. Breteuil.

Promise to Michael de Fenes, king's clerk to provide for him in the next ecclesiastical benefice in England of the value of 50 or 60 marks in the king's gift that falls void; with mandate to Hugh le Bigod, justiciary of England, to cause him to be presented to such benefice by letters under the seal of England. Nov. 22. St. Riquier (Sanctum Richer'.)

Whereas the abbot of Seri aux Prés (de Seriaco), who is vindicating his right to 8½ marks yearly of rent in Wiston and Mordon which he had of the gift of William de Chieu cannot prosecute his right in person, the king to save him labour and expense has admitted Thurstan, his fellow-canon, and Adam de Abbatis Villa, clerk, whom he has appointed before him as his attorneys to sue the abbot's right in the premises in the courts of England. Whereas the abbess of St. Sulpice of Brittany, who is vindicating her right in the advowsons of the chapels of St. Mary and All Saints, Ho, and Halestowe co. Kent, cannot prosecute her right in person, the king has admitted brother Matthew the chaplain of Hecham, and John le Aloer, clerk, whom she has appointed before him as her attorneys, to gain or lose for her in his court.

Simple protection duplicated, for three years, from Christmas for Raymond Massum, canon of Bruges, and brother of Master Rostand, sometime king's clerk.

Gumbald Mercati has a like letter, not duplicated, for the same term.

Wednesday after St. Andrew. St. Germains des Prés.

Grant that of the money which Louis, king of France, ought to give to the king by the peace made between them, there shall remain in his hands to the value of 15,000 marks, until the king has done so much touching the quarrels (quereles) which are between the king and Simon de Muntfort, earl of Leicester, and Eleanor his wife, the king's sister, and between the king and their heirs, if the countess should die, that they and their heirs may consider themselves satisfied of their right, according to reason by the testimony of letters by certain messengers of the bishops of Lincoln and London. for the time being, or of one of them, if either church should be void or one of the bishops be out of the country. And this done, the aforesaid money shall be delivered to the king or at his order at the Temple, Paris, within two months after the king of France has received the certain evidence of the aforesaid bishops or one of them, as aforesaid; that is to say, if the term be passed of making payment, as is contained in the said peace. And the aforesaid quarrels shall be determined at the latest within two years following after the feast of St. Nicholas next. French.

Grant to the abbot of Cluny that his priors, to wit Dalmatius, prior of Lenton, and Roger, prior of Montacute, whom he has appointed before the king in Paris may make attorneys to sue in his name in the king's court; until the quinzaine of Whitsunday.

Grant to the abbot of Fécamp that Gabriel de Torvill, his fellowmonk, whom he has appointed for this before the king at Paris, may make attorneys to gain or lose for him in the king's court; for three years from St. Nicholas.

Protection with clause until the quinzaine of Easter next for John de Baillol.

Request to all persons to protect Deteutus Willelmi, one of the king's household, citizen and merchant of Florence, going to divers parts diligently attendant on purchases and business of the king and queen.

Pardon, at the instance of John Mansel, king's clerk, treasurer of York, to Lawrence de Bruges and William his brother, of their trespasses for which they fled to a church and abjured the realm, and of that abjuration.

Appointment of Roger de Thurk[elby] to take an assize of Mort dancestor which Humphrey le Daneys and Joan his wife have arramed against Walter son of Sewal touching a carucate of land in Tollesbury, co. Essex.

Protection with clause for Luke de Abingeton, so long as he shall be with the king in France.

Protection, for ten years, for Raymond Gumbaud and Robert his brother and Mary their mother.

Commission to Philip Basset and Roger de Thurk[elby] to enquire touching a complaint made on behalf of William and Augustin, sons of John son of William de Dunwico and Augustine son of Andrew of the same town that as they went from the house of the said John to their own inns in the High Street, Richard Brun, Ralph (sic) Brun, John Brun, Philip Brun and their accomplices assaulted them with arms and drawn swords, and when they, to avoid death, fled to the church of All Saints of that town, Richard, Edmund (sic), John and Philip followed them with the said arms and swords, and assaulted and wounded them, so that they killed the said Edmund, Brun and John Brun in self defence. The sheriff of Suffolk is to provide jurors, and is not to permit the possessions of the said William, Augustin and Augustin to be touched by himself or any other until the truth of this matter is made manifest. Licence for Richard de Clare, earl of Gloucester and Hertford, to enclose his town of Suwald co. Suffolk with a wall and crenellate it if he will, and keep it so enclosed to him and his heirs for ever. By K. the earl of Albemarle, J. Mansel and R. Walerand.

Safe conduct, for three weeks from the octaves of Easter, for Reynold de Pontibus and Margaret his wife and those of theirs whom they bring with them, in coming through the king's power to Bordeaux to sue their right before Edward, the king's son, or his seneschal of Gascony, on the day in the quinzaine of Easter which the king has appointed for them.

This letter was given to Bertram Kardilak in the presence of Sir R. Walerand Bertram de Bevil and Gaillard de Solio.

Grant to John de Brehusa that he may plead and sue his right in the king's name touching the manor of Dodinton before the king in his court against the prior of Wenlak, so that he shall keep without any contradiction whatever he gets in the king's name from the said prior in the king's court in respect of the manor. The king has taken into his special protection the proctors and household servants of O. cardinal deacon of St. Mary in Via Lata, who is constantly attendant on the promotion of the king's affairs in the court of Rome, and their goods; granting to the cardinal that the proctors and executors of his nephews may freely sue the graces granted to them by the apostolic see in the realm. Licence for R. earl of Gloucester and Hertford, to close his town of Tonebrugg with a wall, and crenellate it, if he will. By K. present W. earl of Albemarle, J. Mansel, P. de Sabaudia and R. Walerand.

The abbot of St. Edmunds has letters directed to his tenants to make him an aid for the discharge of his debts to divers merchants.

Notification that so long as the king shall hold the castle of Castelnau (de Castro Novo) on the Dordogne in the diocese of Périgueux, he is bound and promises to pay to Emery de Castro Novo and his heir 50 pounds of Tours yearly at the said castle. He is bound also to restore the said castle, whole or demolished, at the will of the king of France, when required by him to do so, and then the king shall not be bound to pay the said money. But the king cannot put the said castle out of his hand except in this way, and it shall be at the option of the king of France that it be restored, whole or demolished, when he wills.

Appointment of Roger de Turk[elby] to enquire whether Ellis son of Peytevin, Jew of Lincoln, outlawed for the death of Hugh son of Cecily lately killed by the Jews at Lincoln, wherewith he was charged and for which he withdrew, was outlawed and withdrew for that death because he was guilty thereof or for other cause or a felony done against the peace; and mandate to the sheriff of Lincoln such and so many &c.

Dec. 22. Paris.

Whereas by the late peace and composition between Louis, king of France and the king, Louis has given the king all the right which he had in the cities and dioceses of Perigueux, Limoges and Cahors, as in his letters patent to the king is more fully contained, the king has committed to Bertram de Kardilhac the castles, cities, boroughs, towns, and all other things pertaining to him in the said cities and dioceses, to keep during pleasure, commanding the prelates, chapters of churches, barons, knights, vassals and commonalities of the same to be intendant to him as the king's seneschal.

Grant to him of 1000 pounds of Tours yearly so long as he have the keeping. This letter was handed to Raymond de Sancto Bricio, knight, and fellow of the said Bertram.

Grant to him of 200 pounds of Tours yearly, because he has withdrawn from the homage and fealty of the king of France, with the licence of the latter obtained at the instance of the king, and has come to the king's homage and service.

This letter was handed to the prior of Le Mas to be handed to the said Bertram when there should be need.

Appointment of Gilbert de Preston to enquire whether Roger Gambun of Northeston killed John le Hoppere of Somerton by misadventure or by felony : and the sheriff of Oxford has been commanded to provide jurors.

Whereas the King lately granted to the burgesses and merchants of the town of Ypres safe conduct as well by land as by the ports of the sea in coming to England with their things and merchandize to trade so that they make thereof the due and right customs; on condition however that they shall not on account of that safe conduct avow any other burgess or merchant of other towns beyond seas, to come to the king's land with his goods; and also granted to them that they shall not be impeded in any way by any forfeiture in the king's land on account of any war past or to come, or of any contention which may arise between the men or merchants of other towns beyond the seas and the men and merchants of the king's land, or be distrained for any debt whereof they are not pledges or chief debtors; so nevertheless that if any of the said burgesses and merchants shall forfeit anything to the king or any of the men and merchants of his land, or if any contention arise between them, he shall stand his trial before the king or his justices or bailiffs in those parts wherein the trespass was.

The king ratifies this and grants of his further grace that for the trespass or forfeiture of their servants, they shall not lose their goods found in the hands of such servants or deposited anywhere in the realm by their servants, which they can sufficiently prove to be their own. Also if any of them die within the king's land and power, whether testate or intestate, the king will not cause his goods to be confiscated and prevent his heirs from having them wholly, so nevertheless that sufficient knowledge or proof of the said heirs is had. And no one is to molest them against these liberties. Witnesses :—Richard, bishop of Lincoln, Richard de Clare, earl of Gloucester and Hereford, Peter de Sabaudia, William de Fortibus, earl of Albemarle, John Mansel, treasurer of York, Robert Walerand, Giles de Argentein, Imbert Pugeys and others. Charter confirming a grant by William de Sancta Ermina to Master Henry Lovel, the queen's cook, of certain lands late of Robert le Sauvage which Richard son and heir of the said Robert quit claimed to the king for arrears of debts wherein his father was held to the king at his death, and the king by charter granted to the said William. Witnesses :—R. bishop of Lincoln, Richard de Clare, earl of Gloucester and Hertford, William de Fortibus, earl of Albemarle, Peter de Sabandia, John Mansel, treasurer of York, Robert Walerand, Giles de Argentein, Imbert Pugeis and others.

Charter granting to Robert Walerand and his heirs free warren in his demesne lands of his manor of Kylpek, co. Hereford, and of the manor of Derham, co. Gloucester, provided that such lands be not within the metes of the forest; granting also a weekly market at Kylpek on Fridays, and two fairs there every year, to wit, on the eve, day and morrow of St. John before the Latin Gate, and on the eve, day and morrow of the apostles Simon and Jude. Witnesses :—R. bishop of Lincoln, Richard de Clare, earl of Gloucester and Hertford, Peter de Sabaudia, William de Fortibus, earl of Albemarle, John Mansel, treasurer of York, John de Burgo, Giles de Argenteym, Imbert Pugeys, Richard de Grey, Peter de Nevile, and others.

Charter granting, at the instance of the king's chaplain Henry de Sarr', to John de la Lynde, and his heirs free warren in all his demesne lands of his manor of Bronysfeld, co. Somerset, provided that they are not within the metes of the forest, and a yearly fair there on the eve, day and morrow of All Saints. Witnesses :— Richard, bishop of Lincoln, Robert, bishop of Carlisle, the above Richard de Clare, Peter de Sabaudia, William de Fortibus, John Mansel, John de Burgo, Giles, Imbert, Richard de Grey, William de Grey, Peter de Nevile and others.

To the prelates, chapters of churches, barons, knights, vassals and commonalties of the towns and all others of the cities and dioceses of Périgueux, Limoges and Cahors. Whereas it is provided in the peace between the king of France and the king that they and their successors shall do their fealties and other rights which they do to the king of France, henceforth to the king, and the king, relying upon their goodness hopes that they will, at his prayer, do this willingly, and begs them to fulfil the mandates of the king of France when presented by the bearer, and to be assured that they will find justice in the king, the tide of peace and the conservation of their rights and liberties. And that these things may be more easily fulfilled, the king has appointed Bertrand de Kardylak, their neighbour, and having knowledge of their estates and the conditions of their lands, as his seneschal, during pleasure as they will see in other letters, to whom they will answer touching their faculties and other rights of the king in the king's place and name as to the king himself; and the fealties which they so do, and their rights which they so render, the king will regard as done and rendered to himeslf. And if perchance any shall not regard himself as bound to do these things by the letters of the king of France and his predecessors, let them reflect that the more liberal they are to the king in this behalf, the more strongly and sweetly (dulcius) they will bind the king to them, although the king of France ought to compensate the king for those, if there are any, who wish to insist upon their privileges; but those whose predecessors laudably served the king's predecessors, it would be much more to his taste [to have] than others, even though equal to them or even more powerful.

This letters was handed to Raymond de Sancto Bricio, knight and fellow of the said Bertrand.

Appointment of Henry de Bathonia to enquire whether Richard le Curteys charged with the death of William Ballard, for which he withdrew from the realm, withdrew because he is guilty thereof or for some other cause or felony : and mandate to the sheriff of Middlesex to provide jurors.

Simple protection, for two years, for Robert, bishop of Carlisle.

Grant to the said bishop, who has gone to the court of Rome to further the business of his church there, that he by his letters patent may give full power to Geoffrey de Mores his steward, and Gilbert de Weston chaplain, to make attorneys for two years to gain or lose for him in all pleas before any of the king's justices and barons of the Exchequer, and in counties and hundreds or other courts; and that he shall be quit for that time of all summonses of justices in eyre for pleas of the forest as well as for other pleas.

Charter granting, at the instance of John Mansel, treasurer of York, to Robert de Glastonia and his heirs free warren in all his demesne lands of his manor of Wykestowe, co. Gloucester. Witnesses :— Richard, bishop of Lincoln, Robert, bishop of Carlisle, Richard de Clare, earl of Gloucester and Hertford, Peter de Sabaudia, William de Fortibus, earl of Albemarle, Robert Walerand, Giles de Argenteym, Imbert Pugeys, Richard de Grey, William de Grey, Peter de Nevile and others.

MEMBRANE 4.

Grant to Master Anglus Romanus, canon of Cambray, of 40 marks a year at the Exchequer until the king provide for him in an ecclesiastical benefice to the value of 80 marks of rent; he having been engaged for the expedition of the king's business in the court of Rome by the archbishop of Tarentaise, Master Rostand sometime king's clerk, and Master John Clarel, the king's envoys there, and the king having accepted the engagement.

This letter was made in England and sealed, and afterwards rewritten and sealed at Paris with the new seal by the archbishop of Tarentaise, R. earl of Gloucester, P. de Sabaudia, and J. Mansel, and it was handed to W. Bonqueor to be taken to the said Anglus at the court of Rome, and the first letter was condemned.

Ratification of the reception by the king's command by the said archbishop and Rostand of Master Umbert de Coquinato, papal chaplain, as a king's clerk, and of their assignment to him of a yearly fee of 20 marks at the Exchequer.

This letter was made in England and sealed for 10 marks, and it was written and sealed with the new seal at Paris and increased by another 10 marks by the archbishop of Tarentaise, R. earl of Gloucester, P. de Sabandia and J. Mansel and handed to W. Bonqueor to be taken to the said Umbert at the court of Rome.

The master and brethren of the Knights of the Temple in the Holy Land have letters patent to their tenants in England to give them a competent aid for the discharge of their debts and the relief of their oppressions by hostile incursions of the Saracens and Tartars.

Dec. 28. St. Denis.

Acknowledgement that the king is bound to Ellis de Aucerre in 5 marks for a horse lost in the king's service when the king was last in Gascony, as appears upon testimony by Robert Walerand, with promise to pay at the exchequer of Easter.

Grant to Roger de Lentin, in extension of a grant made to him, by the counsel of the nobles of the council, of 60 marks a year at the Exchequer, during pleasure, that he shall take the said sum until the king provide for him in wards or escheats to that yearly value.

Request to the constable of the castle of Limeuil (Limolio) which Louis, king of the French, has demised to the king to hold according to the terms of the peace between them, to deliver the castle to Bertrand de Kardilak to whom the king has committed the keeping of the lands and castles in those parts.

In like manner it is commanded to the constable of the castle of Castelnau upon Dordogne.

Appointment of Roger de Turk[elby] to enquire whether Thomas son of Hamo de Briseleg, when he had found certain cattle to the loss of Henry de Briseleg his brother and as the custom is, had driven them to impound for the said loss, Richard Trilloc and Philip his brother, meeting them, to rescue the said cattle, assaulted them and the said Thomas in self defence killed the said Richard. The sheriff of Norfolk is to provide jurors.
