1. Be it
remembered that on 19 June in the seventh year of the reign of our lord
King Henry IV since the conquest, it was declared before our said lord the
king in his parliament held at Westminster by the lords temporal, the peers
of his realm, then present at the same parliament, that the same lords, by
order of our said lord the king, had assembled there in the week just past,
in the presence of my lords the prince and his brothers, sons of our said
lord the king, to discuss what type of process should be used, and what
type of judgment should be rendered, against Henry de Percy, formerly earl
of Northumberland, and Thomas Bardolf, formerly lord Bardolf, for certain
crimes they recently committed contrary to their allegiance against our
said lord the king. Whereupon the aforesaid lords, peers of the realm,
having fully deliberated and discussed this and having seen and heard the
tenor of the process submitted to them on behalf of the constable of
England, held and given in the court of chivalry against the said Henry
Percy because and as a result of various articles of treason committed by
the said Henry and others of his faction, contrary to their allegiance,
against our lord the king, in accordance with the law and usage of arms,
the tenor of which follows in these words: |

2. Be it
remembered, that in the sixth year of the reign of our most feared lord the
present king [1405], announcements and proclamations were publicly and
openly made by order of our said lord the king in the month of May,
throughout all the county of York, that no man of whatever status or
condition should assemble or cause to be assembled any people with force
and arms in bands and companies except with the express consent of our
aforesaid lord the king or of my most honoured lord Sir John his son,
constable of England, warden of the East March bordering Scotland and
justice of the peace in northern parts, or of Sir Ralph Lord Neville, earl
of Westmorland and marshal of England, warden of the West March bordering
Scotland, and also justice of the peace in the said parts; notwithstanding
which announcements and proclamations Sir John Fauconberge, Sir Ralph
Hastings, Sir John fitz Randolf, and Sir John Colville de Dale, knights,
assembled and openly caused to be assembled, in the said month of May, at
Topcliffe, Allerton and Cleveland, within the said county of York, a great
number of the lieges of our said lord the king, numbering around seven or
eight thousand men, fighting as a force and with arms, without the order or
authority of our said lord the king or of my lord his son the constable, or
of my said lord marshal, but clearly contrary to their wish; and
furthermore robbing as well as wounding and killing many lieges of our lord
the king, in high rebellion against and disobedience of our lord the king,
their liege lord. |

3. Also, my said
lords John Fauconberge, Ralph Hastings, John fitz Randolf, and John
Colville de Dale

encouraged, swayed and persuaded the said lords assembled with force and
arms, as was said above, to rebel contrary to their allegiance, and ensured
that they maintained their treacherous purpose and intent; and they alleged
dishonestly and declared and announced seditiously to the said lieges that
the aim of and reason for their insurrection was to amend and redress
certain fictitious troubles and failings which they pretended were present
in the kingdom, and to remove, chastise and destroy certain alleged
malefactors surrounding the person of our lord the king and on his council,
without informing our said lord the king of the said troubles and faults
invented by them or of the names of the said fictitious malefactors which
and whom they required him to redress, in accordance with the laws and
usage of the kingdom.

4. Also,
subsequently, in the same month of May, our said lords John, Ralph, John,
and John, with the said lords assembled by them, persisting in their
aforesaid treacherous purpose and intent, openly and treacherously occupied
a field with force and arms in battle array near Topcliffe, with pennons
unfurled, until the most noble prince Sir John, the king's son, the
aforesaid constable, with the earl of Westmorland, Lord FitzHugh and other
faithful lieges of our said lord the king forced them to leave the field
and put them to flight, and captured them during their flight. |

5. Also, later
in the said month of May, notwithstanding the aforesaid announcements and
proclamations, Richard Lescrope, formerly archbishop of York, Thomas
Mowbray earl Marshal and earl of Nottingham, Sir William Plumpton, Sir
Robert Lamplew, and Sir Robert Persay, knights, assembled and caused to be
assembled within the said county of York, in various places, a great number
of the lieges of our lord the king with force and arms to wage war, without
the order or authority of our said lord the king or of my said lords the
constable and marshal, but blatantly contrary to their will; and the same
people and lieges of our said lord the king thus assembled by them they
encouraged, persuaded and advised seditiously and treacherously, and
openly, through announcements and proclamations, to rebel contrary to their
allegiance, alleging, announcing and declaring to the said lieges and
others, falsely, maliciously and fraudulently, that their aim, and the
reason for their said assembly in such array with force and arms, was to
correct, repair and redress certain troubles and faults falsely alleged by
them to exist in the realm, and to punish, chastise and destroy certain
malefactors falsely alleged by them to be on the council of our lord the
king, and whom our lord the king believed and considered to be good and
loyal to him and his kingdom; thus usurping and encroaching treacherously
upon his royal power. Also, subsequently, the said Richard Lescrope and
Thomas Mowbray and their other aforesaid accomplices,

continuing and persisting in their aforesaid treacherous purpose and
intent, were with the said lieges, who numbered around eight or nine
thousand fighting men, on the twenty-ninth day of the said month of May,
armed and arrayed for the waging of war and ready for battle at Shipton on
the moor very near the city of York, with pennons unfurled freely against
my said lords the aforesaid constable, marshal and justice of the peace,
and other faithful lieges of our said lord the king who were in their
company on the same day, arrayed for battle on the said moor; and in such
array the said Richard and Thomas and their other accomplices were captured
on the same day on the said moor.

6. Also, in the
aforesaid month of May, Henry Percy, called earl of Northumberland,
imprisoned or caused to be imprisoned Robert Waterton, esquire of our lord
the king, who had been sent on the king's behalf as a messenger to Henry
Percy; and he held him and caused him to be held for a long time in prison,
contrary to his wish, in the castles of Warkworth, Alnwick, Berwick and
elsewhere, and he would not free him on the order or request of our lord
the king or for any other reason until John Waterton, brother of the said
Robert, was given as a hostage in his place. Also, in the same month of
May, the said Henry Percy was conspiring, plotting, and conniving with the
aforesaid Richard Lescrope and Thomas Mowbray, and also with my lords John
Fauconberge, Ralph Hastings and their other aforesaid accomplices, in their
treasons and rebellions mentioned above. |
7. Item, puis

thereafter, in the following month of June, the said Henry Percy ordained
and decreed by his letters patent under the seal of his arms that Henry
Boynton, knight, William de Lasingby, esquire, and John de Burton, clerk,
should commune, treat and come to an agreement with Robert [III], king of
Scotland, who died recently, and also with certain ambassadors of France,
concerning certain alliances to be made between the said Henry and the
Scots, as well as the French, to bring about the ruin of our lord the king
his liege lord in relation to his power and his kingdom of England, as can
be ascertained more fully from the tenor of the letters given below: |

to all people that we, Henry Percy, earl of Northumberland, have decreed
and declared, and do decree and declare, that Henry Boynton, knight,
William de Lasingby, esquire, and John de Burton, clerk, our general and
special attorneys and deputies, shall commune, treat and come to an
agreement with Sir John Chaverbreliak, Master John Andrew, and Reyner
Haydeul, commissaries of France, concerning all the details of the alliance
and treaty which shall be put before them and shown to them by our said
attorneys, and thereupon to give sureties and obligations on our behalf,
obliging us by these present documents, sealed with the seal of our arms,
to accomplish and bring about any kind of agreements which may be made with
the said commissaries of France by the said Henry de Boynton, William, and
John, our attorneys, or by two of them, in our name, just as if they had
been made or agreed by us in person; in testimony of which we have appended
our aforesaid seal to these present documents. Written at Berwick upon
Tweed, 11 June, in the year of grace 1405. |

conseil, of alle maner of matiers alliance, and tretees, the whilk

his conseil, and therto make surtees and obligaciouns on our byhalf,
oblyssyng us, by thys presentez, enseled wyth the seal of oure armes, to
fulfille all maner accordez that schalle be made wyth the seide kyng and
his conseil be the forsaide seigneur Henry de Boynton', William, and Johan,
our attournees, or be twa of them in oure name, as fer forthe as hyt were
doun and accorded be oure self in our owne propre persone. In witnessyng of

our arms, to conclude any kind of agreement that may be made with the said
king and his council by the aforesaid lord Henry de Boynton, William, and
John, our attorneys, or by two of them in our name, as if it had been done
and agreed by ourselves in person. In testimony of which we have appended

9. Most high
and most exalted prince, I commend myself to your lordship, whom, may it
please you to know, I have notified, through my people, Sir John
Chaverbreliak, Master John Andrew, and John Ardinguille called Reyner
(ambassadors of the most high and most exalted prince, the king of France,
your lord and brother) who are in Scotland, as to my intention and wish,
which I have sent in writing to the king your said lord and brother; which
is that with the help of God, with your help and that of my many allies, I
have the intention and firm purpose of upholding the rightful claim of my
sovereign lord King Richard, if he is alive, and, if he is dead, of
avenging his death, and also of supporting the rightful claim that my most
feared lady the queen of England, your niece, rightfully has to the kingdom
of England; and because of this I am waging war on Henry of Lancaster, at
present regent of England; and in the hope that you shall aid and support
this quarrel, and others lodged against the said Henry, I pray and request
of you that you aid and support me in this, and also aid me with regard to
the most exalted and most excellent prince the king of France, your said
lord and brother, so that the matters which I have written to him about,
and of which the said ambassadors have plainly informed you, shall reach a
swift and effective conclusion; for in truth, in as far as I can help you
from here to sustain these quarrels against the said Henry, I shall do so
willingly to the best of my ability. And may it please you to believe the
said ambassadors concerning that which they shall say on my behalf. May the
Holy Spirit protect you, most high and exalted prince. Written at Berwick,

10. Item, en

vient en la ville de Berwyk, et par force prist les chiefs de mesme la
ville del maire et burgeys d'icelle, et les delivera, ou

10. Also, in
the same month of June, the said Henry Percy, with many of his accomplices,
came to the town of Berwick, and forcefully captured the chief men of the
same town, namely the mayor and burgesses of the same, and delivered them
or caused them to be delivered treacherously to the Scots, enemies of our
lord the king, his liege lord, and of his kingdom of England; and those
same Scots, with the encouragement and support and at the suggestion of the
said Henry Percy and his accomplices, robbed and pillaged the said town and
the inhabitants of the same, and later burnt the same town. |

king who were amongst the accomplices of the said Henry Percy, on the order
and command and with the support, encouragement and counsel of the said
Henry Percy, held certain castles by force and arms against our lord the
king their liege lord within his kingdom of England in the county of
Northumberland, refusing for a long time to deliver up to him the said
castles, but rather defending them treacherously by force and arms and
waging war; some of which castles were recently regained by force of war,
and some captured forcibly by arms, and many of the rebels in the same were
pardoned by our lord the king, but some were condemned to death in

13. And,
considering various further pieces of information and clear evidence shown
and given to the said lords, the peers of the realm, regarding this matter,
certain matters contained in the said articles seemed clear to the same
lords and peers of the realm; namely, that the said Henry Percy ordained
and ordered, through his letters patent under the seal of his arms, Henry
de Boynton, knight, William Lasingby, esquire, and John Burton, clerk, to
commune, treat and come to an agreement with Robert, king of Scotland, who
recently died, and also with certain ambassadors of France, to bring about
the ruin of our lord the king, his liege lord, with regard to his power and
his kingdom of England. Furthermore, that after this the said Henry Percy
lingered and remained for a long time in Scotland, advising, persuading and
encouraging the Scots as far as he was able to inflict damage and wage war
on our said lord the king, his liege lord, and his kingdom of England. In
addition, inasmuch as the said Henry Percy is now openly in league and
association with the rebels of our said lord the king in Wales, these
matters are treasons committed by the said Henry Percy and the said Thomas
Bardolf, who is his associate, supporter and counsellor, and contrary to
their allegiance towards the person of our said lord the king. Whereupon,
on the said 19 June, the said lords, the peers of the realm, with the
advice and assent of our said lord the king, ordained in the said
parliament that it should be publicly proclaimed throughout the kingdom of
England that the said Henry Percy and Thomas Bardolf should appear in
person, and bring themselves in person before our said lord the king,
before the quinzaine of St John the Baptist next [8 July], to answer for
the aforesaid treasons, and to submit to justice before our lord the king
and the said lords, the peers of the realm, in this matter. And in the
event that the said Henry Percy and Thomas Bardolf should appear and
present themselves before our said lord the king in the aforesaid manner
before the aforesaid quinzaine, then the said Henry Percy and Thomas
Bardolf should be placed under protection and safeguard until they are able
to give their reply before our said lord the king and the aforesaid lords,
the peers of the realm. And in case the said Henry Percy and Thomas Bardolf
do not appear or present themselves before our lord the king in the
aforesaid manner before the said quinzaine, then the said Henry Percy and
Thomas Bardolf shall be convicted and attainted of the aforesaid treasons
by the decision of their peers in this present parliament. |

14. Also, on
the same 19 June, after this ordinance and decision had been thus made, our
said lord the king asked the said lords temporal, the peers of the realm,
for their opinions regarding the deeds of Richard Lescrope, former
archbishop of York, and Thomas Mowbray, formerly earl marshal, who
recently, with a great multitude of people, had been armed and arrayed to
wage war in the field within the kingdom of England, with pennons unfurled,
contrary to their allegiance, against my lords Sir John of Lancaster, son
of our said lord the king, constable of England, and Sir Ralph Neville,
earl of Westmorland, marshal of England, and other faithful lieges of our
said lord the king, to destroy him and his kingdom. To which request the
said lords temporal replied that, in accordance with the information given
them on the part of the said constable, it seemed to the same lords, the
peers of the realm, to be a case of treason. Nevertheless, the said lords
said

that they would pronounce on this matter, following full deliberation,
after their return to this present parliament, so that no error could be
found in their procedure in time to come. On which occasion, the same lords
prayed of our said lord the king that he might order all the lords
temporal, the peers of the realm, to be present for the aforesaid purpose,
and that none of them should be absent when this was done.

15. Whereupon,
on Tuesday 30 November in the eighth year of the reign of our lord the king
[1406], the commons of the kingdom attending this present parliament prayed
of our said lord the king that they might be informed as to what had been
done in connection with the rebellions recently carried out, both at
Shrewsbury as well as elsewhere in the kingdom. Whereupon, with the advice
of our said lord the king and all the lords temporal then present in the
same parliament, proclamations were made on the same Tuesday, at the house
of the chamber of parliament and in the palace of Westminster, that the
said Henry Percy and Thomas Bardolf should appear in person and present
themselves before the king in the same parliament on the following
Wednesday, in accordance with the proclamations made on this in various
counties of England by virtue of certain writs of our said lord the king;
on pain of being, and being considered, convicted of certain treasons
alleged against them in this present parliament. On which Wednesday the
said Henry and Thomas did not come before our said lord the king in this
present parliament in accordance with the proclamations thus made on the
said Tuesday. Nevertheless, our said lord the king, on the same Wednesday,
at the request made to him on the said Tuesday last in full parliament by
the said lords temporal, caused to be brought before him in the same
parliament all the writs which had been returned to his chancery touching
the proclamation that the said Henry Percy and Thomas Bardolf ought to have
appeared in person and presented themselves before our said lord the king
in person before the said quinzaine of St John, in accordance with the
aforesaid consideration. And when these writs, with their returns, had been
read in full parliament on the same Wednesday, the said lords temporal,
with the assent of our said lord the king - considering that in some
counties of the realm of England the said first proclamation had been made
far enough in advance of the said quinzaine, by virtue of certain writs
which had been returned in his chancery, but that in other counties of the
said kingdom it had been made after the said quinzaine, and not before the
same quinzaine, so that the remaining writs had not been returned to the
said chancery - it was decided by the same lords, with the assent of the
king, by their authority in parliament, that the proclamation should be
repeated in the city of London only, namely that the said Henry Percy and
Thomas Bardolf should appear in person and present themselves before our
said lord the king in this present parliament on Friday next [3 December],
to answer there to our said lord the king for the aforesaid treasons and to
submit to justice in this matter, on pain of them being, and being
considered, convicted of the aforesaid treasons, if they did not appear in
the aforesaid manner. Concerning which new ordinance a writ was issued to
the sheriffs of London instructing them to make the proclamation in
accordance with the purport of the aforesaid new ordinance; and these
sheriffs returned to the said chancery that they had made the proclamation
in accordance with the tenor of the aforesaid writ. On which Friday, our
said lord the king causedto be brought to the said parliament the said writ
thus returned to his chancery; and when the same writ, with its return, had
been read in full parliament, he caused the process on the aforesaid
matters and anything pertaining to this matter to be delayed and adjourned
until the following Saturday. On which Saturday [4 December], the said last
writ of proclamation, with its return, was read again before our said lord
the king and the said lords temporal in full parliament. Whereupon, on the
same Saturday, in the said parliament, the said Henry Percy and Thomas
Bardolf,

solemnly summoned, did not come or appear in accordance with the aforesaid
ordinances and proclamations. Thus the said lords temporal present in the
same parliament, with the advice and assent of our said lord the king, by
their authority in parliament have decided that the said Henry Percy,
formerly earl of Northumberland, and Thomas, formerly Lord Bardolf, for
certain treasons committed by them against our same lord the king contrary
to their allegiance - namely in as much as they, the said Henry Percy and
Thomas Bardolf, caused the Scots, enemies of the king, to enter the town of
our lord the king at Berwick, and to burn the same town; and inasmuch as
the said Henry Percy, with the advice of the said Thomas Bardolf, ordained
and decreed by his letter patent under the seal of his arms certain of his
ambassadors to commune, treat and come to an agreement with the said
Robert, formerly king of Scotland, and also with certain ambassadors of
France, to bring about the ruin of our said lord the king as far as they
were able, and the ruin of his kingdom of England; and also, in as much as
the said Henry Percy and Thomas Bardolf openly supported and were in league
and association with the Scots, enemies of the king, and then with the
rebels against our said lord the king in Wales: and for various other
treasons committed against the person of our said lord the king by the said
Henry Percy and Thomas Bardolf, contrary to their allegiance - should be
convicted of the same treasons as traitors to our said lord the king; and
that if they are caught they shall be hanged, drawn and beheaded at the
will of our said lord the king. And that our said

lord the king shall have the forfeiture of all the castles, lordships,
manors, lands, tenements, rents, services, fees and advowsons, and any
other possessions with which the said Henry Percy and Thomas Bardolf, or
either of them, had been or was enfeoffed or seised in fee simple, whether
in demesne or in reversion, on 6 May in the sixth year of the reign of our
said lord the king [1405], or since; and of all the castles, lordships,
manors, lands, tenements, rents, services, fees, advowsons, and any other
possessions with which others had been enfeoffed or seised jointly with
them, or either one of them, or others only, whether in demesne or in
reversion, to the use of the said Henry Percy and Thomas Bardolf, or either
of them, on the said 6 May or since. And that our said lord the king shall
also have the forfeiture of all the goods and chattels which belonged to
the said Henry Percy and Thomas Bardolf, or either one of them, on the said
6 May or since. Nevertheless, the said lords temporal, with the advice and
assent of our said lord the king, declare with regard to the said judgment
that their intention is not that any of the castles, lordships, manors,
lands, tenements, rents, services, fees, advowsons, or other possessions of
which the said Henry Percy and Thomas Bardolf were seised, or either of
them was seised, jointly with others, or solely by themselves, by the
enfeoffment of others, to the use of another person, should be in any way
forfeit to our said lord the king in this case, or included in the said
forfeiture or in the judgment on the same.
