Roll 16 (SC 9/16)

Roll 16 consists of a single membrane measuring 865x200 mm. It is written in a neat official hand. Its condition is generally good, though it has two small holes, one near the top and the other near the bottom and a long tear near the top. A modern cover is attached to the top. There is no number on the membrane. There a single word ('parliament') at the foot of the dorse in a contemporary hands and other identifications, contemporary or nearly so and more recent, ascribe the membrane to parliament in the 35 th year at the top of the dorse.

There is writing only on its face. The language is Latin throughout. The heading describes its contents as business adjourned from the Exchequer to the Carlisle parliament held at the octaves of Hilary in the thirty-fifth year of the reign of king Edward. Most of the entries relate to the adjournment of individuals who had allegedly failed to perform military service at Carlisle in the summer of 1306 but who claimed to have done so to parliament to produce their warrants for having done so. There is also one note relating to the replevin of the land and release from prison of a former sheriff (from whose custody a Scottish prisoner since recaptured had escaped) for appearance at parliament and a note of mandates issued to the two escheators for the seizure of the lands and chattels of named individuals who had left the army in Scotland to go overseas made returnable into parliament; and a mandate to produce before parliament at the octave of Hilary for judgment men who had been accused of conspiracy before the justices of trailbaston in Nottinghamshire. This membrane does not seem to have been known to the makers of the Vetus Codex and was not used by them. It was first printed by the editors of RP at i, 216.

Rogerus la Ware, qui attachiatus fuit ad respondendum domino regi quare, cum rex nuper ei mandasset in fide etc. quod fuisset personaliter ad regem apud Karliol' in quindena Sancti Johannis Baptiste proximo preterita cum toto servicio suo quod regi debuit in excercitu Scocie anno .xxxiiij. to , vel ante diem predictum finem fecisset cum rege pro eodem servicio, nec venit apud Karliol' ad faciendum servicium suum etc., nec finem fecit etc., venit et cognovit se recepisse mandatum regis etc. et se tenere de domino rege per servicium militare. Roger la Ware, who was attached to answer to the lord king as to why, whereas the king had recently ordered him on the fealty etc. to come in person to the king at Carlisle at the quinzaine of St John the Baptist last with all his service which he owed the king for the expedition to Scotland in the thirty-fourth year, or to make fine with the king for the same service before the aforesaid day, he neither appeared at Carlisle to perform his service etc., nor made fine etc., appeared and acknowledged that he had received the king's command etc., and that he held of the lord king by knight service. And he says that he had performed his service to the lord king on the aforesaid expedition. And he asks for a day to produce his warrant etc. Whereupon he is adjourned to the aforesaid parliament etc.
Warr'. [Proceedings against Theobald de Verdun the elder for failure to answer a summons to perform military service at Carlisle in the summer of 1306 or to make a fine for not doing so in advance.]
Theobaldus de Verdoun senior, qui attachiatus fuit ad respondendum etc., ut supra, venit et dicit quod fecit domino regi servicium suum quod < regi etc. > Et inde vocat ad warrantum recordum constabularii et marescalli excercitus regis. Et datus est ei dies de habendo warrantum suum ad parliamentum predictum. Warwickshire. Theobald de Verdun the elder, who was attached to answer etc., as above, appears and says that he performed his service to the lord king which he owed the king etc. And on this matter he vouches to warranty the record of the constable and marshal of the king's army. And he is adjourned to produce his warrant at the aforesaid parliament.

John of Bassingbourn, formerly the sheriff of Essex and Hertfordshire, whose lands and tenements were taken into the king's hand and whose body was committed to prison because Hugh Olyfard, a Scot, who was handed over to the said sheriff to be kept in prison etc., escaped from the custody of the same sheriff, and because the same sheriff has restored the body of the said Scot to prison, his lands and tenements are replevied, and the body of the same sheriff was released from prison on mainprise to appear at the aforesaid parliament to receive what etc.

Because Pain Tybetot, Ralph Basset, Henry de Boun, John la Ware, Thomas de Verdun, Piers de Gaveston, Giles de Argentein, Humphrey de Bohun, Philip de Coleville, John de Chaundos, Robert of Kendal, William de Beauchamp, Roger de Mortimer, Walter de Beauchamp, John of Hadlow, Gilbert de Clare, Walter of Barningham, Henry of Leybourne and Adam of Swillington, recently on the king's service in Scotland, left there to go overseas etc., Walter of Gloucester, the king's escheator south of the Trent, is ordered on pain of grave forfeiture etc., and notwithstanding any other command of the king previously given to any sheriff etc., to take all the lands and tenements, goods and chattels of the aforesaid men in his bailiwick into the hand of the king, and safely etc., until he receive other etc., so that he can answer to the king for the issues of the lands etc. and also for the goods and chattels etc. And he is to have the aforesaid lands and tenements etc. assessed, and the goods and chattels valued etc. and to produce that assessment and valuation at the aforesaid parliament, under his seal and the seals of those etc. Witness the treasurer, 15 November.

Consimile breve mandatum est Ricardo Oysel, escaetori regis ultra Trentam. North of the Trent. A similar writ is sent to Richard Oysel, the king's escheator north of the Trent.
Noting'. [Royal mandate to the sheriff of Nottinghamshire to produce at the Carlisle parliament of 1307 Ralph of Cropwell and others indicted before the trailbaston justices.]
Preceptum est vicecomiti quod scire faciat Radulpho de Crophull', Johanni le Flemyng', et aliis, quorum nomina continentur < in brevi > inde directo vicecomiti Not', qui coram dilectis et fidelibus regis Petro de Malo Lacu et sociis suis justiciariis regis ad diversas transgressiones etc. occasionati fuerunt de diversis confederacionibus et conspiracionibus, quod sint ad parliamentum regis apud Karl' in octabis Sancti Hillarii proximo futuris ad audiendum judicium suum etc. Et quod < habeat > ibi breve predictum coram thesaurario etc. Teste < thesaurario > .v. to die Decembris etc. Et recordum quod inde liberabatur ad scaccarium per justiciarios predictos laberatur [sic: read ' liberatur'] J. de Kyrkeby alteri rememoratori cum quodam scripto super confederacionibus predictis ad deferendum ad parliamentum predictum. The sheriff is ordered to instruct Ralph of Cropwell, John Fleming, and the others whose names are contained in the writ addressed to the sheriff of Nottinghamshire on the matter, who were accused before the king's beloved and faithful Peter de Maulay and his colleagues, the king's justices appointed to hear and determine various trespasses etc., of various plots and conspiracies, to appear at the king's parliament at Carlisle at the octave of Hilary next to hear their judgment etc. And he is to produce there the aforesaid writ before the treasurer etc. Witness the treasurer, 5 December etc. And the record which was delivered to the exchequer on this matter is delivered by the aforesaid justices to J. of Kirkby, the other remembrancer, with a certain writing relating to the aforesaid plots, to be taken to the aforesaid parliament.
Walterus de Faucumberge, Radulphus filius Willelmi, Adam de Everyngham, Nicholaus de Meynyll', Johannes de Valence, Johannes Spring', Cecilia de Bello Campo habent respectum per thesaurarium ad ostendendum quod fecerint regi servicium suum in Scocia anno .xxxiiij. to . Walter de Faucumberge, Ralph FitzWilliam, Adam of Everingham, Nicholas de Meynyll, John de Valence, John Spring and Cecily de Beauchamp are respited by the treasurer in regard to showing that they performed their service to the king in Scotland in the thirty-fourth year.
The dorse of m.1 is blank, apart from the word 'parliament'' at the foot.

Appendix: Additional Information and Related Material for Roll 16
