Commission to Thomas Lercediakne, John Inge and Henry de Chaumbernon touching a complaint by Sanccius de Froniz and John de Burgis, merchants of Spain, that, whereas a ship called the ship of St. Bartholomew of Bilvau, of Spain, laden at La Swyne in Flanders with cloth, jewels, herrings and other goods of the said complainants and other merchants of Spain, to the value of 6,000l., in returning to Spain was wrecked upon the coast near the Lysard, co. Cornwall, certain persons took and carried away the said goods when cast on shore to the great loss of the complainants. Upon this matter John son of Alfonso, sometime king (regis) of Castile and Leon, having prayed the king to cause restitution of their goods to be made to the complainants, the king,—although by an inquisition made at his suit by John de Foxle, John de Stonore and William de Fulbourn on these goods it was found that no animal had escaped alive from the said ship, whereby the wares ought to belong to the king as wreck of sea,—wishing full justice to be done to the complainants the more so as the prayers of his said kinsman have been made on their behalf, assigns the above-named justices to enquire by oath as well of merchants and mariners as of other good men of the county of Cornwall whether the said ship was cast upon that coast, and when; what goods were cast ashore, how much of them belonged to the complainants and of what value, and how much to others and of what value, and by whom were the same taken and carried away and by whom are they now detained; whether any animal escaped ashore alive; and whether the complainants by themselves or others sued for restitution of their goods within a year and a day of the said tempest; and to do justice by causing restitution of the goods to be made, or the value thereof, and to hear and determine the trespass committed against them in this behalf. Commission to William de Claydon and Hugh de Hampslape,—after recital that whereas in the time of Edward I and of the king wastes in the forests beyond Trent had been arrented by commissioners to divers men, which wastes some hold by charters of Edward I and of the king, and some without charters, by arrentations to be rendered at the Exchequer, and whereas many of such tenants have occupied a great part of the soil in the said forests beyond the number of acres arrented to them, and many others hold divers wastes in the same forests of the demise of ministers and others who had no power to make such demises, without rendering anything to the king,—to survey all wastes in the said forests, from the date of the last eyre of the justices of the Forest of the late king to the date hereof, whether arrented by Edward I or the king; to re-measure by the perch of the forest those wastes in the presence of those to whom they had been arrented or of their heirs or of the tenants thereof, viewing also all charters and arrentations which they have thereof; to enquire by oath as well of foresters, verderers and other ministers of the forest as of other good and lawful men of the said forests what wastes in the same forests have been committed by ministers or others not having power to do so, to tenants, and to whom and in what manner, viz. whether to the king's loss or prejudice, or not; to take into the king's hand the entire soil, which beyond the number of acres arrented as aforesaid, they shall find by such re-measurement unduly occupied, and also those wastes which have been so committed by ministers and others having no authority; and to certify the king of their entire action therein, and of the quantity of wastes taken by them into his hand. Commission of oyer and terminer to John de Foxle and John de Ifeld, on complaint by John Junctyn and his fellows, merchants of the society of the Peruchi of Florence, that, whereas they had laded a ship with 35 sacks of wool of the price of 500 marks at London, to be taken thence to Sandwich for sale, Robert Six of Sandwich, William Hardy of Gravesende, Robert Doget of Smalliden, John de Markesham of Smalliden, Funtanus de Middelton, Brian de Scesaltre, and Geoffrey Joye of Hoo with others boarded the ship in the river between the isle of Shepeye and Greyston on her way to Sandwich, and took and carried away the wool; the jury to be of the county of Kent.

The like to Robert de Stokheye, John de Treiagu, and John de Fosse, on complaint by William de Ebbeworth of Tavystok, by petition exhibited before the king and Council, that, whereas he lately freighted a ship called the 'Edmund of Plemmewe' with cloth, linen, canvas, iron, wax, and other goods for conveyance to Sutton, certain persons of the towns of Waymewe and Portland and the neighbouring parts attacked the ship on her voyage to Sutton during one whole day and more, and at last boarded her in the port of the water of Lyme on the confines of the counties of Devon and Dorset, carried away the said merchandise, scuttled the ship, and sunk her in the said port, and assaulted the mariners, merchants and others that were in her; the jury to be of the said counties. Commission of oyer and terminer to John Inge, Nicholas de Wedergrave, and John de Fosse, on complaint by William de Sancto Albino, prior of Goldeclyve, in the Marches of Wales, which is of the king's patronage and is a cell of the abbey of Bec Hellouin, that, whereas the abbot of Bec Hellouin removed Ralph de Runcevill, his fellow monk, late prior thereof, and presented the said William thereto as prior, and the king had admitted him and had commanded the temporalities of the priory to be delivered to him, the said Ralph disobeying his abbot therein and resisting the king's mandates, held the said priory during half a year after the said tenth year, not permitting the said William, the prior, to enter the priory or to dispose of or order the possessions thereof as pertain to his office, William le Walsh of Lanwaryn, John Ythel, Adam son of Robert le Walsh, William son of Robert le Walsh, Griffin ap Henry, Lewelin ap Meurick, William Machon, Nicholas Machon, Walter de Preston, and John Wolrich within the said half-year broke the treasury of the priory at Goldeclyve within the prior's liberty, took and carried away cups, bowls (pelves), and other vessels of silver and gilt, and other goods and muniments of the house, broke a chest secured with four locks, wherein the prior's seal was kept, took the seal and sealed with it divers quit-claims, alienated many lands and tenements belonging to the priory, granted certain pensions and corrodies, and bound the priory in bonds for debts which the prior and convent did not owe. The like to Hugh le Despenser, earl of Winchester, Henry le Scrop, Walter de Norwyco and William de Bereford, on complaint by John de Britannia, earl of Richmond, that Henry son of Hugh, Robert de Ellerton, Goderic de Neusum, Thomas de Laton, knight, Thomas de Rokeby, William Tailleboys, William de Mabanhou, Henry de Tesedale, John de Laton, Richard de Crossethwayt, William de Boghes and John le Gynour, and others, while the earl was coming by the king's command to the Parliament at Westminster summoned for three weeks after midsummer last, came to his castle of Boghes, co. Mandate to Robert de Sapy, keeper of the land of Powys, which is in the king's hands, to the following effect. Commission of oyer and terminer to John de Vaus, Nicholas Scot, William de Denum and Richard de Emeldon, on representation by William Grubbe of Suthfen, merchant of Almain, by petition exhibited before the king and Council, that in crossing the sea in his ship laden with timber, herrings, and other goods from Norway to Lenne or Yarmouth to trade with, he came to Raveneser and from there was driven by a tempest to a place in the sea called Cousterde by Baumburgh, and not wishing or daring to go further North for fear of the Scots, for the safety of himself, his ship and goods, he anchored there, when Roger de Horsle and John son of Juliana de Neubigging and others boarded his ship, assaulted him and his mariners, took them and the ship whither they wished, imprisoned him and the mariners in prison at Baumburgh until the said William and the mariners swore on the holy gospels that they would go from thence to Scotland, and conducted them three leagues in the direction of Berewyk, but as soon as their said conductors had left them they turned immediately towards Newcastle on Tyne; and that his said ship and goods are still detained. Commission of oyer and terminer to John Inge, Nicholas de Wedergrave, and John de la Fosse on petition before the king and Council by the prior of Goldeclyve in the Marches of Wales showing that, whereas that priory is of the king's advowson and the temporalities belonging to the priory are held of the king and are of his fee, and the prior is a lord of the Marches and has his liberty in those parts like other lords of the Marches there, and ought not to answer elsewhere for the lands or tenements belonging to his priory, and that neither he nor his predecessors in times past ought to answer except as lords of the Marches, William le Walshe of Lanwaryn and Griffin ap Henri, with the assent of Roger Damory, then a lord of the Marches of the adjoining lands, designing to usurp and attract the demesne of the priory to the said Roger, procured certain writs from the chancery of the said Roger in these parts against the said prior and others his tenants concerning certain tenements of the prior in Goldeclyve and Multon, within the prior's liberty of Goldclyve, to be pleaded in the court of the said Roger in Lembenith and Kaerliol, and sued out process thereof there ; and although the king prohibited the said Roger and his bailiffs from holding such pleas in his courts to the king's prejudice and commanded the said William and Griffin to implead the said prior and his tenants elsewhere according to law and the custom of those parts, if they should deem it expedient, nevertheless the said Roger and his bailiffs continued the said pleas in the said courts and the said William and Griffin prosecuted the same pleas there until the tenements were by judgment of the said courts adjudged to them, to the prejudice of the king and the danger of the disherison of the church of the said prior. The king therefore, being bound by reason of his superior lordship to show justice to his subjects, as well for his own right as wishing on behalf of the said prior to provide a remedy herein, commissioned the above justices to cause as well the said prior as the said William and Griffin to come before them and to hear their cases (rationes) and to enquire therein, if necessary, in their presence by oath of good men of the lands of Caldecote, Kaerlion and Edelegan at present in the king's hands, and also of the liberty of Thomas, earl of Norfolk and Marshal of England, the king's brother, of the land of Stroguill, which are adjacent to the liberty of Goldeclyve. The like to John de Cherleton, Mayor of the merchants of the staple of wools and wool-fells, Adam de Brom and Peter de Lodyngton, on information that the collectors of custom of wools and wool-fells in the ports within the counties of Northumberland, York, Lincoln, Nottingham, Norfolk, Suffolk, Surrey, Sussex, Southampton, Devon, Somerset, Dorset and the city of London, as well the present collectors as those who have been collectors from the date of the statute of the staple, 20 May, 6 Edward II, and their controllers, have permitted divers merchants fraudulently to export wools and fells contrary to the king's prohibition and have appropriated a great part of the money accruing from the ½ mark on every sack of wool, on every last of hides and on every three hundred fells granted in the eleventh year beyond the right custom by natives, and from the 10s. on every sack of wool, on every last of hides and on every three hundred fells by foreign merchants, granted in the eleventh year beyond the right custom ; that those who have held the office of the tronage in the same ports have taken money from divers merchants, natives and foreigners, to permit the passage out of the realm of their wools, some unweighed and some insufficiently weighed, to the loss of the custom ; that divers merchants, with the counsel and assent of certain persons, in other places in the said counties than those in which there is a coket, have exported unweighed wools, the custom being unpaid ; and that very many persons in the said counties have received the goods of foreign merchants, who have exported wools and wool-fells contrary to the statute, and have avowed the same for their own, that so the said foreign merchants should remain unpunished for their offences.
