Commission to William de Denum, Peter de Middelton, Adam de Bowes and Robert de Barton to make inquisition in the county of Cumberland, touching a petition of the abbot of St. Mary's, York, for relief under the following circumstances. Whereas king Henry [I.] granted to the abbot and monks of St. Mary's, York, the cell of St. Constantine, with the manor of Wederhale, the chapel of Werthewyk and a sluice and mill-pond of a fishery and a mill at Wederhale, and this grant the present king confirmed, with a further grant to the abbot and convent and their successors that they might repair the sluice and mill-pond, when necessary, without impediment from any of the king's ministers, John de Louthre, now escheator in the counties of York, Westmoreland, Northumberland and Cumberland, by pretext of an inquisition taken virtute officii, has prevented the abbot from making his profit of the sluice, mill-pond and fishery. The king having commanded the escheator to suffer the abbot to have his profit or to show cause in the Chancery why he did not, he has signified that he found by inquisition that the abbot has made sluices and a mill-pond in the river Eden which is a great river (ripa), wherein the king and divers men of those parts have fisheries, some free and several and some common, and that the abbot at all seasons of the year, in the close season as well as at other times, has taken salmon, kippers and others, in the river and sluices contrary to the statute, whereby the king and others having fisheries there have been damaged for twenty years to the extent of 100s. yearly, because the sluices are raised so high that scarcely any salmon can pass; but on the part of the abbot the king is informed that neither he nor his predecessors have made any new sluice or mill-pond in the river since the date of the grant, that neither the king nor any others have fisheries where the abbot has his several fishery and that the abbot has not taken any salmon contrary to the statute. The commissioners are to certify the king fully as to the true facts of the case.

The like to William de Herle, John de Stonore, John de Cantebrigge, John de Preston and Richard de Aldeburgh, on complaint that Hugh de Croydon, deputed by the sheriffs of London to the custody of Newgate gaol, and other ministers there have been guilty of oppressions and extortions by colour of their offices, confining men committed for trespasses other than felony among notorious felons, bailing out homicides, by torture and otherwise taking large ransoms and fines from those in their custody, and committing other excesses. The like to William de Denum, Robert de Insula of Chipches, Gerard de Wyderyngton and Robert de Tughale, in the county of Northumberland, on complaint by the prior of Tynemouth that, whereas he according to the law and custom of the realm had taken certain beasts of the plough for customs and services due to him, and impounded that in his fee of Bewyk and had also taken others in his fee of Eglyngeham, and would have impounded these, William Littel of Bewyk, Peter Littel of Bewyk, John Littel of Bewyk, and others broke the pounds, took away the beasts impounded there, reserved those that were not yet impounded, entered his free warren at Lilleburne and the said towns of Bewyk and Eglyngeham, hunted therein, depastured his crops and grass at Bewyk with their cattle, broke his houses there, felled his trees there and at Eglyngeham and carried these away, with other goods and hares, rabbits and partridges from the warren. Commission to Thomas de Lungevillers, supplying the place of the keeper of the forest on this side Trent in Shirewod Forest, and Roger de Baukwell, on evidence laid before the king on the part of Roger le Wyne that a pasture called ' Fullewod' in Penkeston, and Normanton, co. Derby, near the town of Kirkeby, co. Nottingham, is not within the metes of the said forest and for this reason is not liable to pay a custom for the king's use within that forest, called ' wardefet,' for which the said Thomas has distrained on him at various times, to make inquisition in the presence of the foresters, verderers and other ministers of the forest and to certify the king whether the said pasture is within the metes of the forest as defined by perambulation in the time of king John and a charter of that king wherein it is expressly contained that such perambulation began at the ford of Cunyngeswath ascending westwards by the river Medine to the town called Warshop, thence by the same river to Pleselegh park, and to Heytredebrigge, turning thence by the high road of Nottingham as far as Milneford bridge, thence ascending to Maunnesheved and thence between the fields of Herdewic and Kirkeby and Kirkeby moor as far as the corner called Nunneker.
