On the presentation of the abbot of Bee, the king lately took the fealty of the said Philip as prior and caused the temporalities of the priory to be delivered to him; but afterwards, at the suit of William Martel, a monk of Tyntern of the Cistereian order, claiming to be prior by presentation of the Pope, and at the request of certain magnates of the realm, he removed him therefrom in favour of the said William, notwithstanding that the latter had not brought the usual letters of presentation directed to the king from the Pope or letters from the abbot of Bec. Subsequently, on information that the papal bull whereon William founded his claim to be prior was forged and also because of wastes committed by him in the possessions of the priory, the king caused the temporalities with the goods of the priory to be taken into his hands and appointed the aforesaid Peter and Thomas to hold the custody thereof at his will. Since that time, by a petition of the said Philip before the king and council in the present Parliament, and by evidence shewn in the Chancery, it plainly appears that the papal bull was a forgery and that he was unjustly removed from his possession of the priory. Inspeximus and confirmation of letters patent of William, archbishop of York, reciting that it has been intimated to him on the part of John de Hesellarton, knight, the patron, that in the church of Louthorp, whose profits are now large enough to support many persons, there are but few ministers and that many persons there, who are attached to the worship of the Trinity and St. Mary and are desirous of daily service in their honour and for the departed, grow lukewarm because of the frequent absence of any one to celebrate in the church when their minister is engaged in the visitation of the sick or in discharge of other duties of his office; reciting also letters of the said patron, dated 25 March 1333, and of Robert de Alesby, the rector, dated two days later, placing the church at his absolute disposal to order as he would; and that, with the advice of the dean and chapter, in full convocation, and consent of all parties concerned, he has made the following ordinances for the said church, now void by the resignation of the said Robert:

There shall be a rector always resident in the church, serving the same by himself and others, and celebrating chantries therein three times in each week at the least, and he shall be responsible for the charges of the church and the management of all things connected therewith.

Further, six perpetual chantries are created therein for the glory of God and St. Mary and for the salvation of the quick and repose of the dead, for the good estate of Edward III. in life, for his soul after death, and for the souls of his ancestors and heirs, as well as of others mentioned below, to be known by the following titles :

1. Chantry of the Trinity.

2. Chantry of St. Mary.

3. Chantry of the archbishop; for the present archbishop, his predecessors and successors in the see, and for Edward II.

4. Chantry of the Chapter; for deans and canons of the church of York, quick and dead, and their successors, and for Sir William de Ros the second, sometime lord of Hamlak.

5. Chantry of the Founder for the said Sir John de Hesellarton, Marjory his wife, their children, heirs and fathers and mothers, the quick and dead, and for John de Hothum, bishop of Ely.
6. Chantry of the Patron;

Also, there shall be six perpetual priests, one to serve each chantry and bearing the title of his chantry, who at every mass shall say suitable collects for, and make special remembrance of, the king, the said Sir John, Mariota, their heirs, children, fathers and mothers. They shall assemble daily in the church with the clerks mentioned below, wearing surplices at the least, saying together the canonical services at fitting times, to wit, on the ferial days, they shall chant matins, high mass and vespers at least, and, in addition, on the feasts of the nine lections, the hour of prime. On double feasts and Sundays they shall chant together high mass and all the canonical hours. Further they shall, on ferial days altogether in the choir, and on other days two by two in the choir or without, say the commendation and the office of the dead. These priests shall each have his seat in the choir according to the order of his chantry and shall each in turn take the services in the choir for a week, unless otherwise hindered, and then the rector shall appoint one of the others in place of the one unable to serve, and shall each rank according to the date of his appointment. They shall wear garments of cloth, either black or the nearest shade to that colour, or of ' cainet ' not approximating to red or green, black surcoats fastened and without birri, and other garments fastened from the top; to live in common in a house within the manse of the rectory all, four or two at least in one room, and to bear themselves lowly and reverently; to swear obedience to their rector in matters canonical on pain of deprivation ; and never to be absent without his licence and then for such time as he shall fix. The rector shall also, at his pleasure, appoint one of them to rule the others in his absence.

Further, there shall be hereafter three clerks—two to be deacons or one at least a deacon and the other a sub-deacon—to be present in surplices at all the services in the church.

For their sustenance, the priests shall have within the manse of the rectory a hall, a chamber or chambers, a kitchen, a bakehouse and a brewhouse and a toft belonging to the church now in the tenure of John Skey, lying between one late of Richard Lyrpyn, the king's highway and a garden late of Walter Martyn, with a croft common of pasture and other easements of the same, with a sufficient curtilage, and enough turbary to be assigned to them yearly by the rector for them to get therefrom, at their own expense, peat sufficient for their own use, and a clear yearly stipend of 6½ marks each, from the rector, payable at the Invention of the Holy Cross, St. Peter ad Vincula, All Saints and the Purification.

The deacons, or deacon and sub-deacon, shall receive yearly 40s. each as his portion, and the third clerk shall live of the holy water (aqua benedicta) perquisites and alms of the parishioners and such other things as the parish clerk has hitherto lived of.

The presentation to the chantries of the archbishop and of the dean and canons is to be in the archbishop, or the dean and chapter, when the set is void, and to these also the rights to present to the four others and to the church shall lapse whenever the said John or his heirs shall not present within four months from the date of voidance in cash of the rectory, and within one month in case of the chantries.

The rector shall have power to appoint or remove the three clerks, but the right to make provision for their sustenance and lodging is reserved entirely to the archbishop.

Dated at York so far as relates to the archbishop and the dean and chapter, and at Sutton-upon-Derwent so far as relates to John de Hesellarton, on 26 March 1333.

And afterwards this ordinance was repeated word for word under the same date with the addition of a clause protecting all parties concerned from being disturbed at any time by the king, his heirs or their ministers by reason of the preraises.

Inspeximus and attestation, at the request of Robert de Valoignes, prebendary of Warthull, and John Giffard, prebendary of Grendale, in the church of St. Peter, York, king's clerks, of the record and process of a cause before Gilbert de Thornton and his fellows, justices of the King's Bench, in Trinity Term 21 Edward I., between the king and the abbot of Newenham touching the advowson of the church of Axminster, co. Devon, wherein Nicholas de Warr[ewyk], king's serjeant, produced from the Exchequer a record of this tenor ; Pleas before the king at Westminster of Trinity Term, 4 Edward I. The king by John de Coweye seeks against the abbot of Newenham the advowson of the church of Axminster as his right by succession from king John, who was seised thereof in his demesne as of fee. And the abbot comes and puts himself on the country, in place of the great assise, whether he has not the advowson as the right of him and the church of St. Mary, Newenham. Afterwards, in three weeks of Easter, by the oath of the knights, it is found that the king has the right and it is adjudged that he recover the advowson. Wherefore the sheriff is commanded to summon the abbot to be here in fifteen days of Midsummer to shew wherefore the king should not have the advowson. And the abbot comes, and also Master John de Craucoumbe, who follows for the king. And the abbot says that the king, after he had recovered the advowson, gave the same to God, St. Mary, and the abbot and convent of Newenham, in frank almoin, and thereof he produces a charter dated 28 April, 5 Edward I., and the abbot is asked whether the king ever presented to the church after the judgement was given, to which he answers nothing. And the said John says that the judgement was given long after the charter was made, and this is proved to be the case by comparison of the dates. Accordingly he is directed to sue out a writ of execution of judgement for the king, and a mandate is sent to the bishop of Exeter to admit to the church on the king's presentation. Afterwards before the king and council the abbot by Master John de Cadomo, clerk of the council, resigned any right he might have in the advowson, and the king grants that the church and the advowson shall remain for ever to the church of St. Peter, York, to be held as a prebendal church by the prebendaries of Warthull and Grendale, And the abbot with his own hand cancelled in court the aforesaid charter, and grants that he will, at his own charges, procure the resignation of his clerk whom he instituted to the church so as the prebendaries may have free administration thereof; and that in the octave of Michaelmas he will surrender to them before the king all writings, muniments, bulls, processes, etc., in the possession of himself and the convent of his house. And for this resignation, quit claim, removal of clerk and surrender, William de Hamelton, archdeacon of York, and the said Master John de Craucoumb. archdeacon of the East Riding, the prebendaries, owe to the abbot 200 marks to be paid as appointed by Anthony de Bek, bishop of Durham, and Robert de Typetot. And afterwards, in the octave of the Purification, 22 Edward I., Richard de Petherton, the abbot, and Ralph de Shapwyk one of the monks, acknowledged before G. de Thornton and Master J. Lovel, that they had received the 200 marks.

Kent, with the hundreds and other appurtenances, late of Master John de Florencia, deceased, to hold, for life, as of the yearly value of 240l. with knight's fees, advowsons, marriages, escheats, chaces, parks, assart lands, purprestures, liberties, free customs and all other appurtenances as fully as the king would hold the same if it were in his hands, and with all the rights he would have therein. Devon, held in chief; and for him to re-grant the manor, 13 marks of rent excepted, to the grantor, for life, with successive remainders to William his son, Elena his wife, and the heirs of the body of Elena, and to the right heirs of William the elder, and the rent of 13 marks, excepted as above, to William the son, Elena his wife and the heirs of the body of Elena, with remainder in default of such heir to the right heirs of William the elder.
