Bunker versus Cooke et al.

Whereas Saturday next was appointed, for hearing of the Errors argued upon the Writ of Error depending in this House, wherein Joseph Bunker is Plaintiff, and William Cooke and Robert Bokenham are Defendants:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Errors argued in this Case, on Monday the Three and Twentieth Day of this Instant February, at Eleven a Clock; and that all the Judges do then attend.

Stephens's Bill.

The Duke of Beaufort reported from the Lords Committees, the Bill, intituled, "An Act for selling the "Estate of Thomas Stephens Esquire, in the Counties of Chester and Stafford; and for settling of another Estate, of as great or greater Value, in the County of Gloucester, to the same Uses," as fit to pass, without any Amendment.

Ordered, That the said Bill be engrossed.

Messages from H. C. with Bills.

A Message from the House of Commons, by Sir Richard Onslow and others:

Who brought up a Bill, intituled, "An Act for the Importation of Cochincal, during the War, and for Six Months after;" to which they desire the Concurrence of this House.

Who brought up a Bill, intituled, "An Act to enable Sir Ralph Milbank Baronet to make a Jointure and Settlement upon such Woman as he shall marry, as if he were of full Age;" to which they desire the Concurrence of this House.

War in Spain.

Whereas this Day was appointed, for the House to be put into a Committee, to consider further of the State of the Nation, in relation to the War in Spain, and the Papers relating thereunto:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House shall be put into a Committee thereupon, on Friday next, at Twelve a Clock.

Salt Duties Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act to explain the Act of the last Session of Parliament, for the Ease of Her Majesty's Subjects, in relation to Allowances out of the Duties upon Salt carried Coastwise; and also an Act of the First Year of Her Majesty's Reign, in relation to certain Salt-works, near the Sea Side, and Bay of Holy-head, in the County of Anglesey."

Ordered, That the Consideration of the said Bill be committed to a Committee of the whole House, on Monday next.

Cherrill to Studley Highway, Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for the better Amendment of that Way which leads from Cherril through Calne to Studley Bridge, in the County of Wilts."

Ordered, That the Consideration of the said Bill be committed to the Lords following; (videlicet,)

Their Lordships, or any Five of them; to meet on Tuesday next, at Ten a Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.

Killingworth's Bill.

Hodie 1^a vice lecta est Billa, intituled, "An Act for the Sale of a Piece of Ground, late of John Killingworth Esquire, deceased, on which stood several old and decayed Tenements; and applying the Purchasemoney for the Benefit of his Wife and Daughters."

Alston et Ux. versus Alston et al.

After hearing Counsel, upon the Petition and Appeal of Sir Joseph Alston Baronet and Dame Elizabeth Alston, from a Decree made in the Court of Chancery, by the Master of the Rolls, in Cross Causes, the One and Twentieth Day of July One Thousand Seven Hundred and Four, and several subsequent Orders and Reports, on the Behalf of Anne Alston, Clare Alston, Margaretta Alston, Martha Alston, Rebecca Maria Alston, and Mary Alston Widow; and praying, "That the said Decree and Proceedings, in the said Court of Chancery, may be reversed, in the Particulars mentioned in the Appeal:" As also upon the Answers of the said Mary Alston Widow, Anne Alston, Clare Alston, Margaretta Alston, Martha Alston, and Rebecca Maria Alston, put in thereunto; and due Consideration of what was offered thereupon:

Judgement affirmed, with Costs.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Sir Joseph Alston and Dame Elizabeth Alston shall be, and is hereby, dismissed this House; and that the Decree, Orders, and Proceedings, therein complained of, shall be, and they are hereby, affirmed: And it is further Ordered, That the said Sir Joseph Alston and Dame Elizabeth Alston shall pay, or cause to be paid, unto the said Mary Alston, Anne Alston, Clare Alston, Margaretta Alston, Martha Alston, and Rebecca Maria Alston, the Sum of Forty Pounds, for their Costs.
