Whether Lords voting against a Bill, can be named of the Committee for it.

Then the House was put into a Committee, to debate, whether those Lords that vote against the committing of a Bill, can be named of that Committee.

The House being resumed;

It was moved, "That this Business might be referred to the Consideration of the Committee of Privileges."

The Question being put, "Whether this Matter shall be referred to the Committee for Privileges?"

It was Resolved in the Affirmative.

ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That it be referred to the Lords Committees for Privileges, to examine, whether the Lords who vote against the Commitment of a Bill can be of the Committee to which the Bill against which they voted is committed, and report their Opinion thereupon unto the House.

Manner of proceeding against the E. of Pembroke for killing Coney.

Then the Lord Privy Seal reported, "That the Lords Committees for Privileges have fully debated and considered the Case of the Earl of Pembrooke, to them referred; and, upon View of Precedents, they are humbly of Opinion, That the Way for the said Earl's Trial ought to be by Commission of Oyer and Terminer first issuing under the Great Seal to Commissioners, before whom the said Earl may be indicted, and the said Indictment committed to a Grand Jury to be empannelled for that Purpose; and if the Indictment shall be found, that the whole Record be returned into Parliament in due Form, and His Majesty be desired to name a Lord High Steward for this Time to be assigned, that the said Earl may receive his Trial in full Parliament by all the Peers; and that in order thereunto His Majesty be forthwith desired by the House to issue such a Commission of Oyer and ` Terminer."

ORDERED, That this House agrees with the Committee in this Report.

To be communicated to the King.

ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lords with White Staves now present do attend His Majesty, from this House, to present to His Majesty the Resolution this Day passed in the Cafe of the Earl of Pembrooke; and humbly to desire His Majesty in the Behalf of this House, That a Commission of Oyer and Terminer be issued out accordingly.

L. Freschevile, Precedency.

The House this Day heard His Majesty's Attorney General to argue on His Majesty's Behalf, concerning the Petition of John Lord Frescheville to His Majesty; praying, "That he, being Heir Male to Ralph Freshevile of Stavely, who had Summons to Parliament in the 25 of Edw. I. might be admitted to the same Place and Precedency in Parliament as his said Ancestor had:"

The House, upon full and mature Consideration, gave His Majesty an Account thereof, as follows:

"That the Lords Spiritual and Temporal in Parliament assembled have examined the Matter referred by His Majesty to this House, upon the Petition of the Lord Freschevile's claiming a higher Place in Parliament, as Heir Male and General to Ralph Freschevile of Stavely, summoned to Parliament in the 25th of Edward the First, and do not find sufficient Ground to advise His Majesty to allow the Claim of the Petitioner."

ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Privy Seal, the Earl of Aylesbury, the Lord Viscount Mountagu, the Lord Bishop of London, the Lord Bishop of Durham, the Lord Bishop of Lyncolne, the Lord Wharton, the Lord Maynard, and the Lord Colepeper, be, and are hereby, appointed to attend His Majesty, with the Resolution of this House, in the Case of the Lord Freschevile.

Winsteed Manor Bill.

ORDERED, That the Bill concerning the Manor of Winsteed shall be read To-morrow Morning, the First Business.

The Lord Hunsdon and the Lord Grey de Wark are added to the Committee for Privileges, the Committee for Petitions, and the Committee for the Bill concerning Prisoners.
