Tonstall versus Oxenbregge.

Whereas this Day was appointed for hearing Counsel, upon the Appeal of Barnabas Tonstall, from a Dismission in the Chancery, the Fifteenth Day of May, One Thousand Six Hundred Eighty-five, made in a Cause wherein the Petitioner was Plaintiff, against Robert Oxenbregge Esquire and others Defendants; as also upon the Answer of the said Robert Oxenbregge put in thereunto; the Appellant appearing in Person, and Counsel for the Respondent:

After Consideration of what was offered in this Case, it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Barnabas Tonstall shall be, and is hereby, dismissed this House.

Salt, Beer, &c. Duties on, to raise £.1,000,000, Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for granting to Their Majesties certain Rates and Duties upon Salt, and upon Beer, Ale, and other Liquors, for securing certain Recompenses and Advantages in the said Act mentioned to such Persons as shall voluntarily advance the Sum of Ten Hundred Thousand Pounds, towards carrying on the War against France."

ORDERED, That the said Bill shall be committed to a Committee of the whole House, presently.

Then the House was adjourned during Pleasure, and put into a Committee thereupon.

And, after some Time, the House was resumed.

And the Earl of Bridgewater reported, "That the Committee had gone through the said Bill, without any Amendment."

To which the House agreed.

ORDERED, That the said Bill shall be read the Third Time To-morrow Morning, at Eleven a Clock.

A Message from the House of Commons, by Mr. Waller and others:

Who brought up a Bill, intituled, "An Act for preventing frivolous and vexatious Suits;" to which they desire the Concurrence of this House.

Message from H. C. to return Stevens's Bill, and Mildmay's

A Message was brought from the House of Commons, by Mr. Perry and others:

Who returned the Bill, intituled, "An Act for Sale of the Estate of William Stevens deceased, for Payment of the Mortgage thereupon, and applying the Overplus for the Benefit of his Sons who are Infants;" that they have agreed to the Lords Amendments made therein.

A Message was brought from the House of Commons, by Sir William Yorke and others:

To return the Bill, intituled, "An Act to vest the Estate of Mary, Elizabeth, and Jane Mildmay, and Edward Dixie and Arabella his Wife, and Lucy and Anne Mildmay, in Trustees, to be sold, for Satisfaction of Mortgages and Debts thereupon, and preserving the Overplus for their Benefit;" and to acquaint this House, that they have agreed to their Lordships Amendments.

Braziers and others to be heard against the Bill for Exportation of Iron, &c.

Upon reading the Petition of the Braziers and Founders of England, on Behalf of themselves and Multitudes of others working in Brass and Copper; praying, "That they may be heard, by One Counsel, at the Committee to whom the Bill, intituled, "An Act for the Exportation of Iron, Copper, and Bell-metal," is referred:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioners shall be heard, by One Counsel, as desired, at the said Committee, on Saturday next, at Eleven of the Clock; as also One Counsel for the Bill.

Proceedings in the K. B. against the Person who claims the Title of Earl of Banbury.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mr. Attorney General do give this House an Account, in Writing, of the Proceedings in the Court of King's Bench, against the Person who claims the Title of Earl of Banbury.

Small Tithes, for more easy Recovery of, Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for the more easy Recovery of Small Tithes."

ORDERED, That the said Bill shall be committed to a Committee of the whole House on Monday next, at Eleven of the Clock.
