Ewelme Hospital versus Town of Andover.

Whereas the Twelfth Day of January next is appointed for hearing the Cause, wherein Ewelme Hospital is Plaintiff, against the Town of Andover Defendant:

It is this Day ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Friday the Two and Twentieth Day of January next, at Ten of the Clock in the Forenoon.

Fidler versus Hanham.

Upon reading the Petition and Appeal of Thomas Fidler Gentleman, from a Decree made in the High Court of Chancery, on the Sixteenth Day of November last past, wherein the Respondent Dame Elizabeth Hanham was Plaintiff, and the said Appellant Thomas Fidler and others were Defendants:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Dame Elizabeth Hanham may have a Copy of the said Petition and Appeal; and she is hereby required to put in an Answer thereunto, in Writing, on Monday the Eight and Twentieth Day of this Instant December, at Ten of the Clock in the Forenoon.

Vernon's Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for the better assuring to George Vernon, and his Heirs and Assigns, Four Acres of Land in Ebisham, in the County of Surrey."

ORDERED, That the Consideration of this Bill is committed to the Lords following:

Martin's Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for the Sale of the Manor of Manworthy, with the Appurtenances, in the County of Devon, being the Lands and Estate of Nicholas Martyn Esquire, by Trustees herein after named, for the Payment of the Debts of the said Nicholas Martyn."

ORDERED, That the Consideration of this Bill is committed to the same Committee as the Bill, intituled, "An Act for the better assuring to George Vernon, and his Heirs and Assigns, Four Acres of Land in Ebisham, in the County of Surrey."

Dod & al. versus Burrowes.

Upon reading the Petition of Anne Dod Widow, Magdalen Johnson Widow, Rob't Colbach Gentleman, Anne his Wife, Sarah Dod Spinster, and Priscilla Cooper Widow, against Thomas Burrowes:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Thomas Burrowes may have a Copy of the said Petition; and do put in his Answer thereunto, in Writing, on Monday the Eight and Twentieth Day of this Instant December, at Ten of the Clock in the Forenoon.

ORDERED, That Mr. Shelton's and Mr. Pember's Committee be, and is hereby, revived; to sit at Six of the Clock this Afternoon.

ORDERED, That the Lord Steward and the Earl of Rochester (fn. 2) be added to the Bill concerning Bay Salt.

Zouch versus Colwall.

The House being moved, "That a Day may be appointed for hearing the Cause wherein James Zouch is Plaintiff, and Foot Onslow for Colwall Defendant:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Friday the Eighth Day of January next, at Ten of the Clock in the Forenoon.

Excise Bill.

The House was put into a Committee, upon the Bill, intituled, "An Act for granting to Their Majesties certain Impositions upon Beer, Ale, and other Liquors, for One Year."

And, after some Time spent therein, the House was resumed.

And the Lord Cornwallis reported, "That the Committee had gone through the Bill, without any Amendment."

The Lord Chief Justice Holt, in the usual Manner, brought up Two Writs of Error:

Public Accompts:

The House was put into a Committee, to consider of the Book of Accompts, and Observations thereon, sent to this House by the Commissioners for taking the Public Accompts of the Kingdom.

And the Clerk to the Commissioners delivered in a Paper, pursuant to the Order of this House, upon the First and Second Heads of the Observations.

The House was resumed.

And the Earl of Fauconberge reported, "That the Committee had made some Progress upon the Observations sent from the Commissioners of Accompts; and have agreed upon the Questions following, to be asked of the Commissioners:

"1st, To explain what is meant by fictitious Tallies.

"2dly, Whether all the Monies that Tallies have been struck for was actually lent; and whether Part thereof were not old Debts included in the said Tallies; and if there were any such, to give the House an Account thereof: And desired, from the Com mittee, another Day may be appointed, for the House to be put into a Committee, upon the said Accompts and Observations."

To which the House agreed; and ordered as followeth:

"It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Commissioners appointed by a late Act of Parliament, for taking the Public Accompts of the Kingdom, be desired to explain what is meant by fictitious Tallies, and whether all the Monies that Tallies have been struck for, was actually lent, and whether Part thereof were not old Debts included in the said Tallies; and if there were any such, to give the House an Account thereof Tomorrow, at Ten of the Clock in the Forenoon."

"It is Resolved, by the Lords Spiritual and Temporal in Parliament assembled, That the House shall proceed upon the Public Accompts, and Observations thereon, de Die in Diem; and whatever other Business shall be in Action at Twelve of the Clock, it shall be immediately put off, to go on with this Business."

Keck versus Mordaunt.

The House being moved, "That Samuell Keck may have some Time longer to answer to the Appeal of Sir John Mordant:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Samuell Keck hath hereby Time given him for answering thereunto, until Thursday the Four and Twentieth Day of this Instant December, at Ten of the Clock in the Forenoon.

Answer to Address about the Playhouse Guard.

The Duke of Norfolke reported His Majesty's Answer to the Address, "That His Majesty hath given Order, That no Soldiers shall be admitted to guard the Playhouse, as desired."

Moore's Bill.

Hodie 3^a vice lecta est Billa, intituled, "An Act for enabling Francis Moore Esquire to sell the Manor of Baybowse and Lands in West Thorrock, in the County of Essex, and to purchase and settle other Lands in Lieu thereof."

The Question was put, "Whether this Bill shall pass?"
