Treasury reference to the Barons of the Exchequer, Scotland, of the petition of Robert Rutherford et al., late Commissaries of the Army in Scotland, shewing that they are fitting and clearing their accounts of the Army in Scotland preceding the Union before the Auditors of the Exchequer in Scotland; that the Auditors decline to allow articles [not detailed] amounting to 500l. therein unless the Barons of the Exchequer give directions for that effect: therefore praying a recommendation to said Barons to give such direction. Upon my Lord Treasurers discoursing with the Duke of Argyll about the affairs of the Garrison of Port Mahon the Duke advises directions to be given that none of the Officers of the Garrison be allowed to receive any part of their subsistence but upon the place. Same to the Excise Commissioners enclosing for their consideration a petition [missing] of Christopher Powell, late an officer of Excise, praying to be restored. Ibid.

Sept. 3. William Lowndes to Lord Chief Justice Parker to report on the estimate by the Board of Works for fitting up the large room adjoining to Westminster Hall for a Treasury to the Court of Queens Bench. My Lord Treasurer is a little surprised at the greatness of the [proposed] expense. Out Letters (General) XX, p. 265.
Same to Mr. Brydges [Paymaster General of the Forces Abroad]. Major General Newton has applied to my Lord Treasurer for 686l. to answer two warrants signed by the Earl of Portmore and charged on your Deputy in Portugal to be paid to Newton out of the non-effective money of his [Newtons] Regiment [and is] to defray the charge of recruits. My Lord Treasurer desires to know if there be any irregularities in those warrants, since the General has been at the trouble of soliciting their payment here. If there be none, my Lord directs you to order your Deputy Paymaster to comply therewith. Ibid., p. 267.

Sept. 4. William Lowndes to Mr. Howe, Paymaster of Guards and Garrisons. My Lord Treasurer finds by your report of July 21 last on the petition of the several merchants concerned in bills drawn by Col. Vetch [on account of the Expedition to Canada] to the amount of 27,550l. 4s. 10d., that only 17,412l. 3s. 4d. thereof is included in the sums voted by Parliament. My Lord is willing to issue the 17,412l. 3s. 4d. and desires a list of the services for which all the said bills to that total have been drawn by said Vetch. Disposition Book XXII, p. 23.
Same to Sir Robert Smith enclosing the Attorney Generals opinion on Edward Wilcoxs representation of the liberty taken of felling trees in New Forest wherein any vermin have been found under pretence of a right to the same as vermin trees and giving an instance of one being sold after it had been seized and the broad arrow fixed thereon. If you do not forthwith pay into the Exchequer what money you have received for sale of any vermin trees and your son recede from his pretensions thereto my Lord will direct the filing a bill against you and your son for [the purpose of legally deciding or] settling the pretended right in this matter. Same to Secretary Dartmouth enclosing the Customs Commissioners report [missing] on your letter of July 29 last containing Capt. Graves letter to Mr. Burchett complaining of the behaviour of a riding officer of the Customs. Ibid., p. 266.
Sept. 4. Same to Secretary Bolingbroke enclosing the Customs Commissioners presentment and information [missing] on the oath of Matthew Reevely and Hugh Mackrea, lately escaped from on board the Skedland, a Dutch man of war, relating to the murther of James Woolley, an officer of the Customs at Plymouth, in June last by some of the said ships crew. The said Commissioners desire a protection to Reevely and Mackrea in order to their giving evidence for her Majesty. Ibid.
Report to the Queen by Treasurer Oxford on the petition of William Warren, a prisoner in the Marshalsea, on his surety bond for Thomas Hammond for tobacco Duties, petitioner praying to be removed to the Queens Bench prison or to have his liberty. I have referred this petition to the Customs Commissioners and submit their report thereon.
Prefixing: said Commissioners report consenting to his removal or release, he having been eight or nine months a close prisoner and in an ill state of health. Out Letters (Customs) XV, pp. 437–9.

William Lowndes to the Comptrollers of Army Accounts. Mr. Brydges has applied to my Lord Treasurer for 1,730l. 15s. 11½d. to clear an arrear of subsistence to Brigadier Dormers Regiment to 1710 Dec. 23. Please examine the reasons for this arrear and report to my Lord what is fit to be done. Out Letters (General) XX, p. 266.
Treasury reference to the Customs Commissioners of the petition of Richard Gotley, surety for Thomas Perin for Customs bonds which he was incautiously drawn to enter into, but perceiving the ill designs of the said Perin he made a full discovery of his own and of Perins effects by which several thousand pounds were seized to the use of the Queen, and seized and delivered to the officers at the peril of his life the said Perin, and yet petitioners estate is extended and he confined: therefore praying to be enlarged. Same to the Comptrollers of Army Accounts of the petition of Nathaniel Carpenter on behalf of Col. Creightons Regiment, shewing that said Regiment was mustered upon the English Establishment to 24 Aug. 1709 and was transferred to Ireland, where they were paid but from the 27th of the said August: therefore praying the three days pay from the 24th to the 27th Aug. 1709. Same to Mr. Brydges [Paymaster of the Forces Abroad] of the petition of Richard Mead shewing that on 31 July 1711 said Brydges was directed to pay (out of the King of Portugals subsidy) a bill of exchange for 115,336 pieces of Eight drawn by the Marquis das Minas in favour of John Mead, Deputy Paymaster of the Forces in Spain, [being] for the subsistence of the Portugal Troops; which bill is unpaid, Mr. Brydges alleging that he hath no money in his hands to satisfy the same: therefore praying payment thereof, amounting to 27,392l. 6s. 0d., the King of Portugals Envoy here being ready to give a discharge for the same. Sept. 8. William Lowndes to the Navy Commissioners. My Lord Treasurer directs you to prepare an estimate of the sums which will be called for or be necessary to be supplied before Jan. 1 next for laying up the squadrons of [Admiral John] Baker or any others expected home by that time; and for paying off the cruizers: and for any payments to the Yards, Course, bills of exchange or any other services under your care. (A like letter dated Sept. 8 to the Victualling Commissioners; to the Transports Commissioners; and dated Sept. 12 to the Board of Ordnance.) Out Letters (General) XX, p. 267.
Warrant by Treasurer Oxford to the Customs Commissioners to stay process against John Loyd of Chester, merchant, on his tobacco bonds given in 1705 and 1707, which he is disabled to meet by reason of great losses at sea by the war.

Sept. 9. Royal warrant dated Windsor Castle to the Clerk of the Signet for a privy seal as follows for allowance of travelling charges to the Band of Gentlemen Pensioners: the Duke of Beaufort, Captain of the said Band, having represented that they are obliged to the same duty in their attendance on her Majesty at Hampton Court as at Windsor, but have no allowance for same. The Gentlemen of said Band are hereby to receive the like allowance of 6s. 8d. a day for attendance there as is allowed by the royal warrant of 1708 Oct. 2 for their attendance at Windsor: to date as from the year 1709: and the Clerk of the Cheque and the Harbinger of said Band are to have the like allowance from Lady day past for their attendance on the Queen at Windsor and at Hampton Court, they being obliged to the same charges in their attendance, but were omitted from the said previous warrant. Same to same for a same for passing the accounts of Monsieur Hiob De Wildt for transport service in the time of the late King William as follows, viz. the heirs of the said De Wildt, late Secretary of the Admiralty of Holland, deceased, are now upon their accounts (before the Auditors of Imprests) of money received from Wm. III. for taking up shipping in Holland for transporting Forces thence to Ireland towards the reduction of that kingdom in 1690 and 1691. They are therein charged with 10,000l. received from William Harbord, late Paymaster of the Forces, Ireland; 10,000l. issued to Sir Joseph Herne to be by him remitted to Holland and so remitted by him to De Wildt in Sept. 1690; and 600l. received by De Wildt in June 1694 from the Commissioners for Transportation by bill of exchange from William Blathwaite, late Secretary at War; and 3,846 guilders 3 stivers 4 penningen received by De Wildt for provisions sold at the end of the service; and 954l. sterling being the value of 9,643 guilders 13 stivers at the rate of 10 guilders 2 stivers to the pound sterling, "which upon our said Auditors enquiring into the course of the exchange at the times the said moneys were received appears to have been gained on the said 20,600l. sterling, which surcharge of 9,643 guilders 13 stivers being added to the aforegoing sums charged on the said accompt will make the charge thereof to amount in the whole to the sum of 219,866 guilders 15 stivers 4 penningen and in sterling money at 10 guilders 2 stivers to the pound sterling to 21,769l." In discharge thereof the said heirs crave allowances as follows, viz. 167,340 guilders paid to masters of 53 ships hired to transport the said Forces, "which appears to have been deducted from the said masters when their accounts were made up with our Commissioners of Transportation in England, in order to give them debentures for the remainder of their freight according to their charter parties": and 4,886 guilders 15 stivers paid Henry Buijs, employed by the said De Wildt in buying hay, paying labourers and freights: and 4,516 guilders 15 st. paid to Engelfregt Saassenraad, deceased, late doorkeeper of the Court of Admiralty in Holland, employed in buying several provisions and necessaries: 23,359 guilders paid to John Tengs, the Water Bailiff of the said Court, employed in providing necessaries for the stallings for the horses and oats, water casks, sacks and other things: and 11,002 guilders 17 stivers 12 penningen paid to the Lt. Admiral, William Bastiaenz, for his disbursements in this service about the transporting the Life Guards commanded by the Duke of Ormonde and Lord Oxfords Regiment of Horse in May 1690, the accounts and vouchers for which said sums amounting to 43,765 guilders 7 stivers 12 penningen have been returned from Holland and examined by the said auditors (except for 2,035 guilders 2 stivers 8 penningen, which are for the travelling charges and other expenses of the said persons employed in this affair and for several petty disbursements of such a nature as seem not well to admit of vouchers). The said sums being allowed will make the said De Wildts payments to amount in the whole to 211,105 guilders 7 stivers 12 penningen, or in sterling (at 10 guilders 2 stivers to the pound sterling) to 20,901l. 10s. 0d. It is the Queens pleasure that the said accounts be passed accordingly (total charge, 21,769l. sterling; total discharge, 20,901l 10s. 0d.) and that the said heirs be allowed 100l. further "over and above the charges and expenses of the persons employed in this affair for the pains and service of the said Monsieur De Wildt, the same being equal to three months salary of a Commissioner of Transportation in England." Royal warrant to Treasurer Oxford to pay 1,000l. to William Penn as in part of 12,000l. which is agreed to be paid him in four years time in return for and from the date of a surrender and conveyance to be made by him to the Queen of the several powers of government granted to him by patent of Charles II. and by deed of James II. (when Duke of York) in Pennsylvania and other places in those parts: the present sum being to be paid on his bequest as an advance in part of said 12,000l. until such time as the said deeds of surrender and conveyance can be drawn and perfected. Sept. 9. Treasury reference to the Taxes Commissioners of the petition of Robert Ewen, Surveyor of Windows in Co. Middlesex, praying leave to go to Holland for the service of her Majestys Stables. Reference Book IX, p. 90.
Same to the Attorney General and Solicitor General of the query of Mr. Edwyn whether the clause in the Act of 8 Anne [c. 10] for the 1,500,000l. [Lottery] anno 1710 is not a sufficient warrant to the Lord Treasurer and the Exchequer to pay the salaries and incidents attending the same out of the moneys arising by the Duties granted by said Act [for the service thereof] "over and above what will satisfy all the annuities belonging to the fortunate and other lots." And from and after the said Aug. 23 last the said Regiments are to be paid upon the Establishment of Ireland according to their muster rolls: and supernumeraries are to be reduced in accordance with the said royal letter of July 25 last. Mr. Brydges report on Miles Corbetts memorial for 258l. 10s. 0d. for his pay as a Captain in Brigadier Wythers Regiment of Dragoons. How does the arrear happen? Is he mustered and will his pay be placed to the said Regiments accounts?
Mr. Brydges memorial of Sept. 2 inst. with the Duke of Ormondes letter relating to the Hospitals in Flanders and Mr. Hudsons state thereof and an estimate of what is wanting to carry on that service. How and in what manner are the affairs of the Hospitals chequed and controlled?
Mr. Brydges memorial of Sept. 2 inst. with the letter from Mr. Medlycott, Deputy Paymaster of the Garrison of Gibraltar, for directions how to govern himself as to the paying the Officers and men belonging to Regiments broke in Portugal which may be called supernumerary, being more than the Regiments in Garrison (where they are to come) want to complete their numbers. Please consult the Secretary at War as to this case and take care that a copy of the said memorial and letter be sent to the Inspectors of Army Accounts in Spain for their information.
Mr. Watkins report dated 29 Aug. last on Mr. Brydges memorial for the advance due to Monsieur Beaumont on his contract for forage 1711–12: with Mr. Watkins letter from Gand Sept. 9 [? new style] enclosing said report; as also the Prussian Ministers letter to Mr. Watkins about the King of Prussias Troops of Augmentation in the Queens pay.
The Duke of Ormondes letter to my Lord Treasurer dated Gand the 9th inst. [? new style] enclosing the reports of the General Officers concerning the state of the Regiments commanded by Lord North and Grey, Col. Leigh and Major Gen. Wynn, which are all greatly indebted, and proposing a monthly supply to subsist the effective men of those Regiments till some method can be proposed to discharge the said debts.
