His recent petition contained that the late John cardinal priest of St. Balbina's and archbishop of York (in virtue of a faculty granted to him motu proprio by Nicholas V, to dispense eight persons in the realm of England on account of illegitimacy to be promoted to all even holy orders and receive and retain two benefices, namely one with cure and the other without) dispensed him on account of illegitimacy, as the son of a canon regular and a married woman, to be promoted etc. as above, after which he obtained and now possesses the parish church of Excet in the said diocese and a canonry of Chichester and the prebend of Sidelsham [values not expressed]. The pope hereby dispenses him to receive and retain any benefices with or without cure of any number and kind compatible with one another and with the aforesaid, even if they be canonries and prebends, dignities etc., and to resign them and the said parish church and canonry and prebend, simply or for exchange, as often as he pleases, and grants that in future impetrations from the apostolic see or its legates he need not mention the said illegitimacy and dispensations. To the bishop of Exeter. Mandate, as below. The recent petition of John Chiellod, priest, of the diocese of Exeter, S.T.M., contained that he formerly, wishing [not] to show a certain sin and his quick or rather hasty tongue, made a vow never to fall into that sin, and to say masses and the canonical hours and lessons and sermons, both in English and Latin, and also benedictions at sermons, with as little speed as possible, and added, for the purpose of more firmly observing the aforesaid, that if he infringed any of them he would within a month visit the Holy Land and the shrines of the Apostles [SS. Peter and Paul, Rome,] and perhaps that of St. James at Compostella; that afterwards, having at the instigation of the Evil One fallen into the said sin, and again become discouraged because he had broken his firm resolve, and striving with all his strength not to incur the said crime again, or hurry over the words in the said masses and canonical hours, he exclaimed ‘I vow and bind myself as far as I can that if I fall into the said sin, or do not distinctly pronounce masses, canonical hours and graces as aforesaid, and notably fail in any part thereof, forthwith to give all my goods to the poor, resign all my benefices and accept no benefice in future, leave my master and seek religion in the Carthusian order. Moreover,’ said he, ‘I bind myself to everything to which I can bind myself, as far as I can bethink myself, even to the utmost that it is lawful or possible for me to be bound, and will not seek dispensation of any of these nor of any other oath or vow concerning these matters or any of them, nor, if I obtain it, will I accept it or make use of it.’ Subsequently, when giving benediction at a sermon, moved by strong feeling and especially by fear, he pronounced the words indistinctly, wherefore he fears that he is bound by the said vows. At the said petition, adding that he has not solemnized them otherwise than as aforesaid, but that nevertheless, moved by conscience he desires them to be commuted into other works of piety, and to be absolved from the aforesaid and all his other sins, etc., the pope (fn. 2) therefore orders the above bishop, if the facts be as stated, to commute the above vows into other works of piety, and to decree that John is not bound to observe the said oaths. He further grants indult to John to choose his confessor, secular or regular, who may absolve him from the said and any other sins etc., even in cases reserved to the apostolic see, and enjoin penance, and may dispense him on account of irregularity, and rehabilitate him. The recent petition of the said William, to whom Calixtus III made provision of the said church, contained that he has not yet obtained possession thereof nor received any of the fruits, and is not likely to be able to do so, and that at the time of the said provision he was holding and is still holding the Augustinian priory of SS. Peter and Paul, Brenkburne, in the diocese of Durham, which is conventual and elective, and whose net value does not exceed 20 ducats of gold of the camera, and which, on account of the wars etc. between the border English and Scots, is plundered of its animals and other goods, and its possessions burned and wasted by the said Scots. The pope therefore decrees and declares that the said priory did not become void by his promotion to the said church, and shall not become void by the consecration which is to be administered to him, or by the lapse of the time for the consecration of bishops, until he has obtained peaceable possession of the rule and administration of the said church, and that meanwhile he [may retain] the said priory or, if he resign it, may receive any other priory of the said order or any other benefice with cure, secular or regular of any order, with or without cure, even if a parish church etc., and may hold the same in commendam with the said church of Clonmacnoise, and resign such commenda, simply or for exchange, as often as he pleases. The pope exemplifies the letters:— Universis Christifidelibus … In auctore salutis of the said late Robert bishop of Durham, sealed and dated 7 Oct. 1448, the 11th year of his translation, wherein the said bishop sets forth the recent petition of the above prioress and convent, containing that their said monastery was at the time of its foundation sufficiently endowed for their maintenance and for hospitality etc.; that, its revenues decreasing, it was helped by the late Robert (fn. 8) bishop of Durham with a yearly pension of 10 marks from the church of Wasschington; that on account of fires and other misfortunes and especially the non-payment of the said pension, which could not be paid on account of the notorious poverty of the said church of Wasschington, the monastery's fruits etc. have become so slender that they are insufficient; that the said church has been exempted from payment of the said pension, and that in compensation therefor provision has been made by the said bishop Robert from the fruits etc. of the church of Ryton in his diocese, which was well known to exceed that of Wesschyngton [sic] in value; and (inasmuch as litigation may arise between the curate of Ryton, which has cure, and the said nuns, even as has often happened between them and the rector of Wasschyngton) supplicating for the appropriation to the said monastery of the chapel of St. Edmund the Bishop in Gatesheved, in the said bishop's collation and diocese. He therefore makes, with consent of the prior and chapter of Durham, the desired appropriation in perpetuity, so that on the resignation or death etc. of the present master or warden the prioress and nuns may take possession of the said chapel, whereupon the said pension of 10 marks from the church of Ryton shall be forthwith annulled, the said prioress and convent being required moreover to provide two fit chaplains to celebrate mass and other divine offices daily in the said chapel in perpetuity for the souls of its founders, at their own cost, and to keep it in repair etc., and also to pay yearly pensions to the bishop and the said prior and chapter and their successors of 6s. 8d. and 3s. 4d. respectively for ever on the Nativity of St. John Baptist: (ii) The letters of consent of the said prior and chapter, dated, as regards the appending of their common seal, in their chapter-house on 20 Oct. in the above year. |
| Besides confirming the said appropriation the pope hereby orders the bishop of Carlisle and the archdeacon of Northumberland to publish all the aforesaid, and cause the same to be inviolably observed, and the prioress and convent to enjoy for ever peaceable possession of the said chapel, as they do at present in virtue of the said appropriation, the values of the said monastery and chapel being taken as expressed hereby, etc. Ad fut. rei mem.
